# Driver-Side Conviction Reporting Requirements
Drivers have legal obligations to report convictions to their employer per § 391.27. Carriers should ensure drivers understand this.
## Annual driver's certificate of violations (§ 391.27)
- Filed annually in the DQF
- Driver certifies all CMV-related convictions in the past 12 months
- Includes federal violations + state CDL violations
- Driver signature + date
- Carrier retains for 3 years
## Mid-year conviction reporting (§ 383.31)
Drivers must notify their CDL issuing state AND their employer within:
- **30 days** of conviction for a moving violation in any state (federal or state CDL)
- Notification includes the date, jurisdiction, charge, and disposition
## What counts as a conviction
- Pleading guilty
- Pleading no contest (nolo contendere)
- Forfeiting bail/collateral
- Finding of guilt by court
- Adjustment under deferred adjudication
- Administrative finding of violation
## What does NOT count (for federal CDL reporting)
- Pending charges (not yet adjudicated)
- Civil infractions (some states classify minor traffic this way)
- Dismissed charges
## Carrier obligation
- Receive driver's mid-year notification
- Document receipt in driver's file
- Investigate impact on driver's CDL status
- Update annual driver's certificate of violations at next renewal
## State-issued notifications
States with CDL conviction reporting to FMCSA:
- All US states have agreement to report
- Reported to CDLIS within 10 days of conviction
- Available to continuous MVR monitoring services
## Compass automation

- Mid-year notifications received from drivers
- Cross-reference with continuous MVR data (any conviction the driver hasn't self-reported is a red flag)
- Carrier reminder if driver fails to provide annual certificate
