# HOS Adverse Driving Conditions Extension (§ 395.1(b))
**49 CFR § 395.1(b)** allows up to **2 additional driving hours** beyond the 11-hour limit AND extends the 14-hour duty window by up to 2 hours when adverse driving conditions could not have been known when the driver started.
## What qualifies as "adverse driving conditions"
Per the regulation:
- **Snow, sleet, fog, or other adverse weather conditions**
- **Highway covered with snow or ice**
- **Unusual road or traffic conditions**
All conditions must be **unforeseeable** at dispatch — could not reasonably have been known when the trip began.
## What does NOT qualify
- Routine congestion (rush-hour traffic, predictable urban backups)
- Construction zones listed in trip planning
- Weather forecasts available before dispatch (FMCSA position: if it was on the forecast, it was foreseeable)
- Driver-caused delays (route deviation, fueling decisions)
- Mechanical breakdowns of the vehicle (use roadside-repair exception logic instead)
## How the extension works
- Driver may drive up to **13 hours total** (11 base + 2 adverse)
- The **14-hour duty window extends to 16 hours** (corrects 2020 rulemaking previously limited to 14)
- The **30-minute break requirement** at 8 cumulative hours of driving still applies
- The **60/70-hour cycle** is NOT extended
## Documentation
Driver must note "adverse conditions" on RODS with specific facts:
- Time conditions encountered
- Type of condition (e.g., "white-out snow on I-80 between Cheyenne and Laramie")
- Why conditions were unforeseen
- Time conditions cleared
Vague "weather" without specifics typically fails roadside scrutiny.
