# FMCSA Driver Disqualification and Reinstatement

A CDL disqualification ("DQ") is FMCSA's hammer — it bars the driver from operating any CMV, regardless of who employs them. Carriers must verify a driver is not disqualified before letting them drive (49 CFR 391.15). Sources: MVR, Clearinghouse, PSP, and the driver's signed gap-employment record.

## Triggers and durations (49 CFR 383.51)

### Major offenses — 1-year first conviction, lifetime second

- DUI/DWI in any vehicle (BAC 0.04+ in CMV; 0.08+ in personal vehicle)
- Refusing alcohol/drug test
- Leaving the scene of an accident involving a CMV
- Using a CMV to commit a felony
- Felony involving manufacture, distribution, or dispensing of a controlled substance
- Driving CMV when CDL is revoked/suspended/canceled

HAZMAT offenses double penalties (3-year first / lifetime second).

### Serious traffic violations — 60-day DQ after 2 in 3 years; 120 days after 3

- Excessive speeding (15+ mph over)
- Reckless driving
- Improper or erratic lane changes
- Following too closely
- Texting while driving CMV
- Hand-held mobile phone use while driving CMV
- Driving CMV without CDL/required class/endorsement

### Railroad-grade-crossing violations — 60 / 120 / 1-year DQ for 1st / 2nd / 3rd

### Out-of-service violations — 180 days–1 year first; 2–5 years second; 3–5 years third

### Imminent hazard — up to 30 days by FMCSA emergency order

## Clearinghouse prohibited status (49 CFR Part 382 Subpart B)

A driver becomes **prohibited** when they:
- Test positive on a DOT drug or alcohol test
- Refuse a DOT test (including shy bladder / dilute / adulterated)
- Have actual knowledge use reported by employer

Status flips to **not prohibited** only after completing the Return-to-Duty (RTD) process under 49 CFR Part 40 Subpart O.

## Substance Abuse Professional (SAP) process

The carrier hiring the driver back enforces the follow-up plan. Cannot be transferred to another employer's testing program.

## Reinstatement workflow

1. **Driver checks status** in their own Clearinghouse account (or carrier checks pre-employment)
2. **Driver finds SAP** at clearinghouse.fmcsa.dot.gov SAP directory
3. **SAP uploads RTD-completion** documentation to Clearinghouse
4. **Negative RTD test** uploaded by collector/MRO
5. **Driver downgrade resolved** — return to "not prohibited"
6. **State CDL reinstated** — may require additional state fees, written test, road test (state-dependent)
7. **Driver must self-query Clearinghouse** and provide consent for new employer query (Full Query)
8. **Carrier conducts Pre-Employment Full Query** before employment offer is finalized

## State CDL downgrade

When state DMV receives notice via Clearinghouse, state must **downgrade the CDL to non-commercial** (49 CFR 383.73 — implemented November 18, 2024 rule). Driver loses the CDL until reinstated.

## Hiring a reinstated driver — extra diligence

- Pre-Employment Full Query → confirms "not prohibited"
- Verify SAP follow-up testing plan and accept obligation to enforce it
- Document the SAP report and RTD test result in the DQF
- Onboard into your random testing pool immediately
- Set calendar for each follow-up test
- Reasonable suspicion training for supervisors is mandatory regardless

## Common mistakes

- Hiring driver before Clearinghouse Full Query clears (carrier liable if status changes)
- Failing to enforce follow-up testing plan (carrier risk if positive)
- Treating a Limited Query as sufficient pre-employment (must be Full Query)
- Letting a driver drive while reinstatement paperwork is "in progress" — even if state CDL still appears valid
- Missing the state-level CDL downgrade — federal status separate from state CDL
