# Substance Abuse Professional (SAP) Program Implementation (49 CFR Part 40 Subpart O)
A driver who tests positive or refuses must complete the Substance Abuse Professional (SAP) process before returning to safety-sensitive functions. The carrier role is limited but specific.
## Driver receives notice
After positive test or refusal:
1. Carrier removes driver from safety-sensitive functions immediately
2. Carrier provides driver list of qualified SAPs at no charge to the driver (driver pays for SAP services unless carrier offers EAP)
3. Driver is reported to FMCSA Clearinghouse within 3 business days
## SAP qualifications
Per § 40.281, SAP must hold one of:
- Licensed physician (medical or osteopathy)
- Licensed psychologist, social worker, or counselor
- Certified Employee Assistance Professional (CEAP)
- DOT-qualified addiction counselor (NAADAC, ICRC, etc.)
AND complete the DOT SAP qualification training + pass the SAP qualification exam.
## SAP process
1. **Initial evaluation** — face-to-face clinical assessment
2. **Treatment/education plan** — SAP prescribes treatment, education, or both
3. **Driver completes the plan** (carrier does NOT need to verify completion)
4. **Follow-up evaluation** — SAP confirms compliance with plan
5. **SAP issues report** to carrier with recommendation: driver may return to duty (with follow-up testing schedule)
## Return-to-duty test
After SAP clearance:
- Carrier directs driver to take a return-to-duty test (observed collection per § 40.67)
- Must be negative before driver returns to safety-sensitive work
- Failure = back to the SAP process
## Follow-up testing
SAP-prescribed follow-up testing schedule:
- Minimum 6 tests in first 12 months
- May extend up to 60 months
- Driver is responsible for completing all tests on schedule
## Common pitfalls
- Carrier verifies SAP qualifications before forwarding the SAP list to the driver
- SAP report is the FINAL authority — carrier may not override
- Follow-up testing schedule travels with the driver to subsequent employers (per Clearinghouse)
