# Subrogation + Insurance Claim Workflow
When your driver is hit by another party (not at fault), subrogation may recover your losses. The process takes 6-24 months typically.
## When subrogation applies
- Your driver not at fault
- Other party identifiable + insured
- Your insurance carrier paid damages
- Your carrier wants to recover from the other party's insurance
## How subrogation works
1. Insurance company pays your claim
2. Your insurance company seeks reimbursement from other party's insurance
3. Other party's insurance pays (usually after negotiation)
4. Your insurance reimburses you (or your insurance comp)
5. Process complete
## Timeline
- **Hour 0**: crash occurs
- **Day 1**: police report obtained
- **Day 7**: insurance claims filed
- **Day 30-60**: damage assessments
- **Day 60-180**: settlement negotiations
- **Day 180-365**: settlement or litigation
- **Day 365-730**: payment + closure
## What carrier provides
- Police report
- Insurance claim documentation
- Driver statement
- Witness statements
- Dashcam footage
- Vehicle damage assessment
- Cost of cargo + downtime
- Other documented losses
## Common subrogation challenges
- Other party's insurance disputes liability
- Other party uninsured
- Other party undocumented
- Damage assessment disputes
- Cargo loss valuation disputes
## When NOT subrogated
- Your driver at fault (you're paying)
- Crash declared no-fault (some states)
- Other party already paid you directly
- Hard to identify or contact other party
## Recovery typical %
- Clear other-party fault: 80-95% recovery
- Disputed fault: 30-70% recovery
- Hard-to-identify other party: 0-30% recovery
## Compass support
- Tracks claim through subrogation cycle
- Documents losses (vehicle damage, cargo loss, downtime cost)
- Generates carrier statement for claim
- Coordinates with insurance carrier on subrogation status
## CFR citations
- **Insurance Industry Practice**
- **Tort Claim Law**
## How Compass surfaces this
Searchable in Compass Ask. Runs against carrier fleet data when invoked from the relevant tracker. Read-only; no actions without explicit user approval.
