# Irland Supreme Court Proportionality

## Verfassungsrahmen

declaration of incompatibility fuehren (Section 5 ECHR Act 2003).

## Heaney Test (1994)

In **Heaney v Ireland [1994] 3 IR 593** (High Court, Costello J) und
**Heaney v Ireland [1996] 1 IR 580** (Supreme Court) hat die irische
Rechtsprechung den **Oakes-Test aus R v Oakes [1986] 1 SCR 103
(Kanada)** rezipiert und als irischen Proportionality-Test
verankert:

1. **Rational connection**: das Mittel ist rational zur Erreichung
   eines pressing and substantial objective.
2. **Minimal impairment / least restrictive means**: das Mittel
   beeintraechtigt das Recht moeglichst wenig.
3. **Proportionate effect**: die Vorteile für das Allgemeinwohl
   ueberwiegen die Belastung des Betroffenen.

Bestaetigt und fortentwickelt in:

- Re Article 26 and the Employment Equality Bill 1996 [1997] 2 IR 321,
- Re Article 26 and the Planning and Development Bill 1999 [2000] 2 IR
  321,
- Tuohy v Courtney [1994] 3 IR 1 (statute of limitations),
- Damache v DPP [2012] IESC 11 (Hausdurchsuchungsbefugnis,
Verfassungswidrigkeit von Section 29 Offences against the State Act),
- NVH v Minister for Justice [2017] IESC 35 (Arbeitsrecht von
  Asylbewerbern),
- Friends of the Irish Environment v Government of Ireland [2020]
  IESC 49 (Klimaplan, declaratory relief).

## Unenumerated Rights und Art 40 3 Constitution

Aus Art 40 3 1 Constitution hat die Rechtsprechung eine Reihe nicht
ausdruecklich genannter Rechte abgeleitet:

- Recht auf koerperliche Integritaet (Ryan v AG 1965),
- Recht auf Privatleben (Kennedy v Ireland [1987] IR 587),
- Recht auf Reisefreiheit (The State (M) v Attorney General [1979] IR
  73),
- Recht auf gerichtsfoermige Verfahrensgarantien.

Eingriffe in diese Rechte werden ebenfalls am Heaney Test gemessen.

## Strukturunterschiede

| Deutschland | Irland |
| --- | --- |
| Vier Stufen sequenziell | Drei Stufen Heaney Test (Oakes-Rezeption) |
| Wesensgehalt Art 19 II GG | Kein expliziter Wesensgehalt; abwaegungsfeste Kerne über Art 40 3 und EMRK Art 3 |
| Schutzbereich-Eingriff-Rechtfertigung getrennt | Prüfung in Heaney-Schritten integriert |
| Einschaetzungspraerogative national | Margin of appreciation des Oireachtas, eng kontrolliert bei Eingriffen |
| Praktische Konkordanz | Balancing exercise (von kanadischem Oakes-Test uebernommen) |
| Untermassverbot ausgeprägt | Positive duty to protect aus Art 40 3 1 |

## Bedeutung für den Prüfer

Bei irischen Bezuegen:

- Heaney Test als Drei-Stufen-Test ausdruecklich benennen; Pressing and
nutzen, die im deutschen Recht in Art 2 I iVm Art 1 I GG aufgehen.
- ECHR Act 2003 als sub-konstitutionellen Rezeptionskanal benennen;
EMRK-Konformitaet über declaration of incompatibility (Section 5).
- Bei Klimaschutz Friends of the Irish Environment v Government of
Ireland [2020] IESC 49 als methodisches Pendant zu BVerfGE 157, 30
  zitieren.
