# Arizona Employment Law

> **NOT LEGAL ADVICE.** Arizona employment claims are
> deadline- and forum-sensitive, and several governing figures
> drift. The **minimum-wage rate is annually indexed** and
> changes every January 1, the ACRA administrative-charge
> windows and judicial SOLs are short, and the **A.R.S. 23-355
> wage-treble** remedy has element- and good-faith-defense
> nuances. Verify SOLs, employer-coverage thresholds, current
> wage / sick-time figures, and forum selection against the
> current A.R.S. and the reference corpus before drafting, and
> consult a licensed Arizona attorney about your specific case.

Use this subject-matter bundle for Arizona employment civil
actions — wrongful discharge, discrimination / harassment /
retaliation, unpaid wages, minimum wage and paid sick time,
non-compete enforcement, and tort-overlay claims against the
workers'-compensation exclusive remedy.

## At a glance

- **At-will baseline.** Arizona employment is presumptively
at-will, and the **Arizona Employment Protection Act (AEPA),
A.R.S. § 23-1501**, is the **exclusive** statutory channel for
  common-law / public-policy wrongful-discharge claims — it
narrowly cabins them to the enumerated categories below.
- **Right-to-work.** Arizona is a constitutional right-to-work
state — **Ariz. Const. art. 25** — so the closed shop and
compelled union membership/dues as a condition of employment
  are barred.
- **Discrimination** is governed by the **Arizona Civil Rights
Act (ACRA), A.R.S. § 41-1461 et seq.**, administered by the
**Civil Rights Division of the Attorney General's Office** — it
mirrors Title VII and carries an **administrative-charge
  prerequisite** before suit.
- **Wages.** The **Arizona Wage Act, A.R.S. § 23-350 et seq.**,
governs timely payment and final pay, with a **treble-damages**
remedy for wrongfully withheld wages at **A.R.S. § 23-355**.
- **Minimum wage + paid sick time.** The **Fair Wages and Healthy
Families Act** sets an **annually indexed** minimum wage
  (A.R.S. § 23-363) and **earned paid sick time** (A.R.S. § 23-371
et seq.). Treat the dollar figure as **corpus-driven**.
- **Workers' comp** is the **exclusive remedy** for work injuries
under **A.R.S. § 23-1022** (subject to the narrow
  willful-misconduct / employee-election carve-outs).
- **Enforcement agencies**: AG Civil Rights Division (ACRA);
Industrial Commission of Arizona (ICA) Labor Department (wages,
  minimum wage, earned paid sick time) and ICA for workers'-comp;
EEOC and U.S. DOL for the federal overlay.

## SOL / deadline catalog (the most-used)

> **VERIFY all day counts against the corpus** — administrative
> windows and limitations periods drift and have tolling
> carve-outs.

| Claim | Deadline | Citation (verify) |
|---|---|---|
| **ACRA discrimination — charge to AG Civil Rights Division** | file the **charge first** (short administrative window) | A.R.S. § 41-1481 |
| **ACRA — civil suit after charge** | runs from the AG's right-to-sue / statutory clock | A.R.S. § 41-1481 |
| **Arizona Wage Act (unpaid wages)** | general statutory limitations period | A.R.S. § 12-541 / § 12-543 (verify) |
| **AEPA wrongful discharge (written contract)** | contract limitations | A.R.S. § 12-548 / § 12-543 (verify) |
| **AEPA tort/statutory wrongful discharge** | personal-injury / statutory period | A.R.S. § 12-542 (verify) |
| **Title VII / ADA / ADEA (federal)** | **300 days** to EEOC (deferral state) | 42 U.S.C. § 2000e-5(e) |
| **FLSA (federal)** | 2 yr / 3 yr willful | 29 U.S.C. § 255 |

Because the AG Civil Rights Division is an EEOC **work-share
agency**, the federal **300-day** charge deadline applies to
dual-filed Title VII / ADA / ADEA claims. Confirm the current
ACRA charge window and judicial clock against the corpus before
calendaring.

## The principal Arizona statutes

### 1. Arizona Employment Protection Act (AEPA) — A.R.S. § 23-1501

The AEPA codifies Arizona's at-will rule and is the **exclusive**
framework for common-law wrongful-discharge / public-policy
claims. It limits an employee's wrongful-termination action to
the following enumerated categories (A.R.S. § 23-1501(A)(3)):

- **(a) Breach of a written employment contract** — discharge in
breach of a *written* contract setting a term or restricting
the grounds for discharge (remedies limited to contract
damages). A handbook can qualify only on the statute's narrow
  written-contract terms.
- **(b) Discharge in violation of an Arizona statute** — but if
that statute itself provides a remedy, that remedy is the
**exclusive** remedy for the violation and the related public
policy (so, e.g., ACRA discrimination claims run through ACRA,
  not a freestanding tort).
- **(c) Retaliatory discharge / whistleblowing** — including
refusal to commit an act that would violate the Arizona
Constitution or statutes, and disclosure (in a reasonable
manner) of a reasonable belief that the employer or a
coworker violated Arizona law, or exercise of statutorily
protected rights (workers'-comp claims, jury service, etc.).

**Key consequence:** the AEPA displaces the broader common-law
public-policy tort. A wrongful-discharge claim that does not fit
one of the § 23-1501 categories is not actionable in Arizona.
Plead the specific statutory hook.

### 2. Arizona Civil Rights Act (ACRA) — A.R.S. § 41-1461 et seq.

Arizona's core anti-discrimination statute, administered by the
**Civil Rights Division of the Arizona Attorney General's Office**.
It closely **mirrors Title VII** in protected classes and
analysis.

- **Coverage**: "employer" means one with **15 or more employees
for each working day in each of 20 or more calendar weeks in the
current or preceding calendar year** (tracking Title VII; A.R.S.
§ 41-1461(7)(a)). Note the statutory carve-out extending coverage
to a person with **one or more employees** for **sexual-harassment**
  claims and related retaliation (A.R.S. § 41-1461(7)(a)).
- **Protected classes** (A.R.S. § 41-1463): race, color,
religion, sex, age, national origin, and disability (the ACRA
also reaches pregnancy and, in the housing context, additional
classes — confirm employer-context coverage in the corpus).
- **Administrative-charge prerequisite**: a claimant must file a
**charge with the AG Civil Rights Division** (dual-filed with
the EEOC under the work-share agreement) and exhaust that
process before filing suit — A.R.S. § 41-1481. Calendar the
short charge window first; the judicial action runs on a
  separate statutory clock.
- **Remedies**: injunctive relief, reinstatement, back pay, and
compensatory relief under the ACRA framework; confirm
  cap/fee mechanics against the corpus.

### 3. Arizona Wage Act — A.R.S. § 23-350 et seq.

Governs **timing of wage payment** and **final pay**, with a
potent treble-damages remedy.

- **Regular paydays**: wages due on designated regular paydays at
least twice a month, within statutory limits (A.R.S. § 23-351).
- **Discharge**: an employee who is **discharged** must be paid
all wages due within the statutory deadline (whichever is
sooner of a set number of working days or the next regular
payday — A.R.S. § 23-353); an employee who **quits** is paid by
the next regular payday. **Confirm the current day count in the
  corpus.**
- **Treble damages — A.R.S. § 23-355**: an employee may recover
in a civil action **an amount that is treble the amount of the
unpaid wages** (i.e., 3x the unpaid wages as the total award —
not the wages *plus* a separate treble amount) where the
employer fails to pay wages due, subject to a good-faith /
reasonable-dispute defense. This is the marquee remedy — plead
it expressly and document the demand.

### 4. Minimum wage + earned paid sick time — Fair Wages and Healthy Families Act

**Minimum wage — A.R.S. § 23-363.**

> **VERIFY — annually indexed.** Arizona's minimum wage is set by
> the Fair Wages and Healthy Families Act and is **adjusted for
> inflation every January 1**. Do **not** assert a fixed dollar
> figure here — **pull the current rate, the tipped-employee
> credit, and the next scheduled adjustment from the corpus**
> (`az-statutes-debt/` A.R.S. § 23-363) or the Industrial
> Commission of Arizona minimum-wage page for the live number.

- The Act is enforced by the **Industrial Commission of Arizona
(ICA) Labor Department**; a private civil action is also
available, with anti-retaliation protection. Confirm the
private-action and damages mechanics against the corpus.

**Earned paid sick time — A.R.S. § 23-371 et seq.**

> **VERIFY — figures drift.** The Act requires accrual of paid
> sick time (the statutory baseline is **1 hour per 30 hours
> worked**), with **annual usage caps that vary by employer size**
> (a larger-employer cap and a smaller-employer cap) and
> permitted uses (the employee's or a family member's health,
> plus public-health-emergency and certain
> domestic-violence-related absences). **Confirm the current
> accrual rate, the size threshold, the usage caps, the
> carryover/frontload options, and the notice rules against the
> corpus** — these are subject to amendment.

### 5. Workers' Compensation — exclusive remedy, A.R.S. § 23-1022

Workers'-compensation is the **exclusive remedy** for an injury
or death arising out of and in the course of employment —
**A.R.S. § 23-1022** — adjudicated administratively through the
**Industrial Commission of Arizona** (with judicial review by the
Court of Appeals), **not** the Superior Court. The principal
exceptions are narrow:

- **Willful misconduct / wilful act** — the statutory carve-out
for an employer's wilful act done with intent to injure (and
  the employee's own wilful misconduct).
- **Election / rejection of coverage** — Arizona's
constitutional election regime (Ariz. Const. art. 18, § 8 /
A.R.S. § 23-906) lets an employee preserve a tort remedy by
rejecting compensation in advance, in writing, on the
statutory schedule. Confirm the current election mechanics in
  the corpus.

Plead the specific exception with care; ordinary negligence (and
even gross negligence) is barred by § 23-1022.

## At-will employment and the AEPA's exclusivity

Arizona is an at-will state. Before the AEPA, courts recognized a
common-law public-policy wrongful-discharge tort (*Wagenseller v.
Scottsdale Memorial Hospital*, 147 Ariz. 370 (1985)). The AEPA
(A.R.S. § 23-1501) now **supersedes and narrows** that tort —
wrongful-discharge claims must fit one of the statute's
enumerated categories (written-contract breach, discharge in
violation of an Arizona statute, or enumerated retaliatory
discharge). A claim that does not map to § 23-1501 is **not
cognizable**; and where the violated statute supplies its own
remedy, that remedy is **exclusive** (so an ACRA-type claim runs
through ACRA, not a parallel tort). Identify the statutory hook
and plead it precisely.

## Non-compete and restrictive covenants

Arizona has **no general non-compete statute**; enforceability is
governed by **common-law reasonableness** — the covenant must be
no broader than necessary to protect a **legitimate business
interest** and reasonable as to **duration**, **geographic
scope**, and **activity / scope of restricted work**.

- ***Valley Medical Specialists v. Farber*, 194 Ariz. 363, 982
P.2d 1277 (1999)** — the Arizona Supreme Court refused to
enforce a physician non-compete, applying **heightened
scrutiny** to restrictive covenants (especially where a public
interest such as patient access to physicians is implicated)
and **declining to judicially rewrite an overbroad covenant**.
Arizona courts will sever a grammatically divisible, distinctly
unreasonable provision ("blue-pencil" in the narrow sense) but
will **not add to or rewrite** the covenant to make an
unreasonable restraint reasonable. An overbroad covenant risks
  being struck **in its entirety**.
- The employer bears the burden of showing reasonableness and a
protectable interest; mere suppression of ordinary competition
is not protectable. Trade-secret protection runs through the
Arizona Uniform Trade Secrets Act (A.R.S. § 44-401 et seq.) —
  see `az-commercial-disputes`.

When drafting for an employer, narrow the covenant to a defensible
duration/geography/scope and tie it to a specific protectable
interest; when defending, identify the failing factor and argue
the *Farber* no-rewrite rule.

## Federal overlay — the deferral-state framework

The AG Civil Rights Division is an EEOC **work-share agency**, so
a charge filed with either is dual-filed and the federal
**300-day** charge deadline applies to Title VII / ADA / ADEA
claims. State parallels: Title VII (15+) ↔ ACRA (15+); ADA (15+)
↔ ACRA disability; ADEA (20+) ↔ ACRA age provision; FLSA wage/hour
overlays the Arizona Wage Act and the Fair Wages and Healthy
Families Act minimum wage. GINA and the FMLA have no state analog.
The federal **right-to-sue** clock and the ACRA judicial clock run
independently — calendar both.

## Forum strategy

| Claim | Forum | Notes |
|---|---|---|
| ACRA discrimination | AG Civil Rights Division charge **then** **Superior Court** | Administrative charge is a prerequisite; calendar the charge window first |
| AEPA wrongful discharge | **Superior Court** (Justice Court if within its jurisdictional cap) | Must fit a § 23-1501 category |
| Wage Act (unpaid wages + § 23-355 treble) | ICA Labor Department wage claim **or** civil action (Justice/Superior by amount) | Treble remedy + good-faith defense |
| Minimum wage / earned paid sick time | **ICA** complaint **or** civil action | Anti-retaliation protection; figures corpus-driven |
| Non-compete enforcement | **Superior Court** | TRO / preliminary injunction is the standard ask; verified complaint + bond under Ariz. R. Civ. P. 65 |
| Workers' Compensation | **Industrial Commission of Arizona** | Administrative; **not** Superior Court |
| Federal claims (Title VII / FLSA) | **U.S. District Court (D. Ariz.)** | Removal possible; supplemental jurisdiction over parallel ACRA claim |

## Drafting checklist

- [ ] For any wrongful-discharge theory, **map it to an A.R.S.
      § 23-1501 category** — written-contract breach, violation of
an Arizona statute, or enumerated retaliatory discharge — and
confirm no statute-specific exclusive remedy displaces it.
- [ ] For discrimination, **file the ACRA charge with the AG Civil
Rights Division first** and calendar both the charge window
      and the post-charge judicial clock (A.R.S. § 41-1481); apply
      the **15-employee** coverage threshold (A.R.S. § 41-1461(7)(a);
      **1+** employee for sexual-harassment claims).
- [ ] For unpaid wages, **plead A.R.S. § 23-355 treble damages**
expressly, document the written wage demand, and anticipate
      the employer's good-faith / reasonable-dispute defense.
- [ ] For minimum-wage / paid-sick-time claims, **pull the current
rate, accrual rate, usage caps, and employer-size threshold
from the corpus** — the minimum wage is indexed annually.
- [ ] For non-compete enforcement, narrow the covenant to a
defensible duration / geography / scope tied to a protectable
interest; for defense, invoke ***Farber***'s heightened
      scrutiny and **no-rewrite** rule.
- [ ] For workers'-comp tort-overlay suits, plead a **specific
§ 23-1022 exception** (wilful act to injure, or a valid
written rejection of coverage); ordinary negligence is barred.
- [ ] Confirm Arizona's **right-to-work** (Ariz. Const. art. 25)
where union-security or compelled-dues issues arise.

## Damages and remedies

**ACRA**: injunctive relief, reinstatement, back pay, and
compensatory relief (confirm caps/fees in the corpus). **AEPA
written-contract claim**: contract damages only. **Wage Act**:
**treble the unpaid wages** (3x total) under A.R.S. § 23-355
(good-faith defense). **Minimum wage / paid sick time**: unpaid amounts plus
statutory penalties and anti-retaliation relief — confirm the
multiplier in the corpus. **FLSA**: unpaid wages + 100% liquidated
(good-faith defense) + mandatory fees (29 U.S.C. § 216(b)).
**Title VII**: compensatory + punitive on a size-graded cap +
mandatory fees.
