## §26. What's Live — verified August 2026
> **⚠️ Both items below change what you must DO before and during a trip. Verify current
> status against official sources before travelling — this area moves.**
### 26.1 ⚠️ EU border systems: EES is live, ETIAS is not yet
**⚠️ The most consequential practical change to European travel in decades, and it is
widely misunderstood in both directions.**
- **⚠️ The Entry/Exit System (EES) is FULLY OPERATIONAL.** ⚠️ **Per the European
Commission, the phased rollout began 12 October 2025 and the system became fully
operational on 10 April 2026 across 29 European countries.** **⚠️ It replaces passport
stamping with a digital record.**
- **⚠️ What happens at the border**: ⚠️ **the system registers name, travel document data,
BIOMETRIC DATA (facial image and fingerprints — reportedly except fingerprints for
children under 12), and the date and place of entry and exit.** ⚠️ **Registration is on
first entry; subsequent crossings may need only facial recognition.** **It also records
refusals of entry.**
- **⚠️ THERE IS NOTHING TO APPLY FOR IN ADVANCE for EES**, ⚠️ **which is the point most
commonly got wrong** — **the French foreign ministry states plainly that there is nothing
to do before travelling.** **⚠️ An optional "Travel to Europe" mobile app allows
pre-registration of passport data and facial image within 72 hours of reaching an EES
border, at participating crossings.**
- **⚠️ The 90/180 rule is now calculated automatically**, ⚠️ **which matters if you have
previously been relaxed about counting — overstay detection is now systematic.**
**Commission figures reported over 45 million crossings registered with over 24,000
refusals of entry in the first phase; a later report cited 60 million crossings and
32,000 refusals.**
> **⚠️ GOTCHA — the rollout has been genuinely rough, and you should plan time for it.**
> ⚠️ **Reported problems include system crashes and longer processing, with Airports
> Council International cited as reporting processing times up 70% in some locations;
> queues reported at 2–5 hours at peak; inconsistent application between airports; and
> some countries pausing EES at specific crossings.**
> ⚠️ **The regulation explicitly permits countries to partially suspend EES operation in
> exceptional circumstances during peak travel, and the Commission has stated this
> flexibility was always part of the legislation.** **⚠️ Practical implication: allow
> substantially more time at Schengen external borders than you would have pre-2026,
> especially in summer and especially on first entry.**
- **⚠️ ETIAS is NOT yet in force.** ⚠️ **It is a travel authorization (like ESTA or the UK
ETA), not a visa, and is reported as scheduled for the last quarter of 2026 with
mandatory enforcement following in 2027.** ⚠️ **You cannot currently apply, and the date
has slipped repeatedly.**
- **⚠️ Therefore, be alert to scams**: ⚠️ **sites charging for ETIAS applications now are
selling something that does not exist yet.** **⚠️ When it launches, apply only through the
official EU channel** (§12 → `travel-documents-insurance-health-safety-and-money`).
### 26.2 ⚠️ EU air passenger rights: reformed, and largely preserved
**⚠️ Directly relevant to §25 → `travel-groups-long-term-travel-and-handling-disruption`, and the outcome surprised most observers.**
- **⚠️ On 15 June 2026 the European Parliament and Council reached a political agreement on
the first comprehensive revision of EU261 since 2004**, **after what is described as a
13-year deadlock.**
- **⚠️ THE HEADLINE: the three-hour threshold and the €250/€400/€600 compensation grid were
RETAINED.** ⚠️ **The Council, backed by airlines, had pushed for thresholds of four hours
on shorter flights and six on longer ones; Parliament refused and the three-hour standard
stayed.** **⚠️ IATA's own commentary describes the outcome as "two losses" and notes the
original proposal to extend the threshold to five hours "remains at three hours."**

> ⚠️ **The agreement still requires formal adoption, and reporting indicates the rules
> apply 12 MONTHS after publication in the Official Journal — most likely 2027.**
> **⚠️ Until then, the EXISTING EU261 rules remain fully applicable, unchanged.**
> ⚠️ **Also note the compensation amounts were set in 2004 and have never been
> inflation-adjusted, which consumer advocates flag as a real-terms halving — so
> "preserved" means preserved in nominal terms.**
**⚠️ Scope, since travellers routinely guess wrong**: ⚠️ **EU261 applies to any flight
DEPARTING an EU airport regardless of airline nationality, and to flights ARRIVING in the
EU operated by an EU carrier.** ⚠️ **Iceland, Norway and Switzerland are within the zone.**
**⚠️ So a Lisbon–New York flight on a European carrier is covered; a New York–Lisbon flight
on a US carrier is not.**
**⚠️ Other jurisdictions differ substantially** — ⚠️ **the UK has its own retained version,
Canada has APPR, and the US has no equivalent compensation regime for delays, only rules
around denied boarding and refunds.** **⚠️ Know which applies to your specific route before
you need it** (§25 → `travel-groups-long-term-travel-and-handling-disruption`).

**§1–§25 → `travel-trip-type-destination-constraints-and-budget`, `travel-airfare-flights-points-accommodation-and-booking-order`, `travel-documents-insurance-health-safety-and-money`, `travel-pacing-packing-jet-lag-connectivity-and-culture`, `travel-groups-long-term-travel-and-handling-disruption` rests on stable travel practice** — **constraints-based planning, revenue
management mechanics, circadian principles, risk base rates, and standard disruption
handling.** ⚠️ **None of it needed verification; airline fare buckets and the physiology of
jet lag are not new.**
**Two searches were run in August 2026**, on **EU border systems** and **EU air passenger
rights** — ⚠️ **both chosen because they change what a traveller must actually DO, and both
are widely misreported.**
**Confidence.** **High** in §17 → `travel-pacing-packing-jet-lag-connectivity-and-culture` and §3 → `travel-trip-type-destination-constraints-and-budget`, which are the sections I'd most want read.
⚠️ **Under-scheduling is the single most reliable improvement available to any itinerary,
and "decide the number of bases before the number of places" is the version of that advice
that actually changes behaviour.** **§25 → `travel-groups-long-term-travel-and-handling-disruption` is the close third — disruption handling is mostly
preparation, and the specific tactics (call while queuing, know what you want before
reaching an agent, document everything, claim directly before using an agency) are what
separate outcomes.**
**High** in §6 → `travel-airfare-flights-points-accommodation-and-booking-order`'s debunking. ⚠️ **The Tuesday-booking and incognito-mode myths are
persistent, and understanding fare buckets explains why they were never true.**
**High** on §26.1's core facts, which come from the European Commission's own pages and a
national foreign ministry: ⚠️ **phased from 12 October 2025, fully operational 10 April
2026, 29 countries, biometric registration on first entry, and — importantly — nothing to
apply for in advance.** ⚠️ **The disruption figures (70% processing increase, 2–5 hour
queues) come from industry and travel-sector reporting rather than the Commission, and
I've marked them as reported.** ⚠️ **The ETIAS Q4 2026 date has slipped repeatedly and one
source notes the timeline is under review — treat it as provisional and do not act on it.**
**High** on §26.2's substance, which traces to the Council of the EU's own press release
and is corroborated across trade and consumer sources: ⚠️ **three-hour threshold and
€250/€400/€600 retained, 96-hour information duty, 30-day claim response, cabin baggage
included in fare, no-show ban.** ⚠️ **The most practically important point is the one most
coverage buries: NONE OF IT APPLIES YET, with application likely in 2027 and current rules
unchanged until then.**
⚠️ **Sourcing note worth stating: much of the EU261 commentary comes from claims agencies,
which have a direct commercial interest in the compensation regime surviving, and from
IATA, which represents airlines and describes the same outcome as a failure.** **I anchored
on the Council's own announcement and reported both characterizations, because the fact
that the two sides describe the identical agreement in opposite terms is itself the most
honest summary of what happened.**
