# Working holiday maker workpapers
This workflow has two modes. Run the one the engagement needs, and do not let a fact from one mode settle a question in the other: an employer's withholding does not decide the person's tax, and a visa does not decide tax residency.
## Inputs
Employer mode: the employer's PAYG withholding registration and its working holiday maker employer registration with dates, each worker's Tax file number declaration answer and its date (TFN quoted, exemption claimed, TFN application or enquiry lodged, none, or unknown, never the number itself), the visa subclass, dates and Visa Entitlement Verification Online (VEVO) result the employer recorded, pay runs and STP reports with income types and country codes, and super guarantee contributions and fund details.
Individual mode: income statements or payment summaries for the income year, the visa history with dates, every nationality the person holds, the facts that bear on tax residency, deductions against income earned as a working holiday maker, other Australian and foreign income, and any departure date and super fund details.
## Employer mode
1. **Status.** Record each visa the worker held in the period, with dates and the employer's VEVO evidence rather than the worker's word alone. Section 3A of the *Income Tax Rates Act 1986* defines a working holiday maker by visa and includes certain bridging visas. Read the section in force for the period rather than assuming only subclasses 417 and 462 count. Without visa evidence, working holiday maker status is `UNVERIFIED`, and so is every withholding result below.
2. **Registration.** From the Australian Business Register or ATO correspondence, record the employer's PAYG withholding registration, which the ATO requires first, and when the employer registered as an employer of working holiday makers, and compare both with the date of the first payment to a working holiday maker. Missing evidence of either leaves the withholding basis below `UNVERIFIED`. Read the ATO's current registration and employer pages for what an unregistered employer must withhold and the penalty position. Record a missing or late registration as a reviewer item, not as a corrected figure.
3. **Withholding.** Recompute each pay with the ATO's Schedule 15 tax table for working holiday makers in force on the payment date, using the registered or unregistered basis the evidence supports and the column for a worker without a tax file number only where Schedule 15's conditions for it are met. A worker who declared a TFN application or enquiry has a set period to provide the number before that column applies, so date each pay against the declaration. Apply it to the payment types the ATO's employer page lists, including termination payments, unused leave and back payments. Do not reduce working holiday maker withholding for Medicare levy adjustments or tax offsets. Schedule 15 says they do not apply to it. A different amount needs its own evidence: an ATO PAYG withholding variation notice for the worker, or evidence of an upward variation the worker arranged, either by asking the employer in writing or through a withholding declaration in ATO online services. Ask for it wherever the payroll figure differs.
4. **STP.** Check that payments made while the worker held a working holiday maker visa use the WHM income type, and that the country code is the country of the nationality under which the visa was granted, which can differ from where the worker lives. Where the visa changed during the year, check the amounts are split at the change date and that payments after it use the income type the STP guidance gives for the new visa. Carry any coding left unresolved into the hand-off.
5. **Super.** The ATO says working holiday makers are entitled to super like other employees. Reconcile contributions to ordinary time earnings and the fund, and apply the employee and contractor tests and any exception current for the period rather than treating a temporary visa as an exception.
6. **Contractors.** A worker who quotes an ABN is not a contractor for that reason. Apply the employee and contractor tests. If the arrangement is employment, the working holiday maker withholding applies despite the ABN.
## Individual mode
1. **Working holiday maker income.** List the Australian-source income derived while the person was a working holiday maker, using the WHM income type on income statements and any income earned on such a visa that a statement does not mark, less the deductions that relate to it. Employment termination remainders are not working holiday maker income. Use `au-etp-redundancy` for them.
2. **Residency.** Work out tax residency on the facts with `au-tax-residency`. The ATO says most working holiday makers are foreign residents for tax purposes, but the visa decides nothing either way. An unresolved residency leaves steps 3 and 4 `UNVERIFIED`.
3. **Treaty non-discrimination.** In *Addy v Commissioner of Taxation* [2021] HCA 34 the High Court applied Article 25(1), the non-discrimination article of the convention between Australia and the United Kingdom. The ATO now taxes an Australian-resident working holiday maker who is a national of a country whose treaty non-discrimination article covers working holiday maker rates on the same basis as a resident Australian national where that gives less tax. Read the ATO's current list of eligible and excluded countries, and treat it as guidance rather than a complete survey: for each nationality the person holds, read that treaty's non-discrimination article and current ATO or Treasury guidance before concluding either way. Nationality without residency changes nothing, and residency without an eligible nationality changes nothing.
4. **Tax and levies.** Apply the working holiday maker rates for the income year from Part III of Schedule 7 to the *Income Tax Rates Act 1986* in force for that year. Where step 3 may apply, prepare both calculations the ATO describes as conditional workpapers, with the evidence each depends on. Prepare the Medicare levy workings for the person's residency and entitlement with `au-medicare-review`. The applicable tax and levy positions are for the authorised reviewer to decide.
5. **Lodgement.** Read the income year's return instructions for when a working holiday maker must lodge. They set an income-year threshold for someone whose income was all salary and wages earned as a working holiday maker. Wages earned after the person stopped being a working holiday maker, for example after moving to a visa section 3A does not list, fall outside it. Record whether a return is still worth lodging, for deductions or a residency position, as a decision for the person or their agent.
6. **Departure.** A departing Australia superannuation payment has its own eligibility: the ATO lists the visa having ceased and the person having left Australia without another active Australian visa, among other conditions. If the payment includes amounts attributable to contributions made while the person held a working holiday maker or associated bridging visa, the ATO applies the working holiday maker rates to the entire payment, including super earned under another visa: the taxable component takes the working holiday maker rates and the tax-free component keeps its own treatment. Record the evidence for each condition. The person or their agent applies.
## Hand-off and checks
Employer mode: a visa and registration timeline, a withholding recomputation by pay reconciled to payroll and STP, an income type and country code check, a super reconciliation, and registration, variation and characterisation items for the reviewer.
Individual mode: a working holiday maker income schedule reconciled to income statements, the residency facts and tests from `au-tax-residency`, the treaty analysis with both conditional calculations where it may apply, the Medicare levy workings, a lodgement decision note and a departure checklist.
For each unresolved item record evidence needed, owner, status and next action. Keep dependent results conditional until the item is resolved.
## What this skill does not do
- Infer tax residency from the visa, nationality or days in Australia alone.
- Conclude that the *Addy* treatment applies without supported residency and treaty findings.
- Decide visa status, work rights or any other immigration question.
- Treat an employer's withholding or registration as settling the person's own tax.
- Register the employer, lodge a return, apply for a departing Australia superannuation payment or make any declaration.
- Record a tax file number, passport number or visa grant number in a workpaper outside the firm's approved system.
## Source and review boundary
Before applying a rule, open the relevant primary authority for the work's period and jurisdiction. Record its title, direct URL, provision or paragraph, effective period, check date and the exact fact used. The adjacent `sources.json` records the sources reviewed on 29 September 2026 at Ryan Duguid's direction, with their effective periods; use them only as a cross-check against the live page, not as current-law approval. A record in it that carries a `reverify_by` date expires after that date: do not use it even as a cross-check, and mark results that depend on it `UNVERIFIED` until the live source has been read. Search snippets and prior-year instructions do not establish the applicable rule. If authority or evidence is unavailable, mark the affected result `UNVERIFIED`, leave dependent calculations blank and identify what the reviewer needs. Never supply rates, thresholds, labels or deadlines from memory.
Keep real client data in the firm's approved environment, outside repositories and unapproved cloud prompts; omit unnecessary identifiers. Write client output only to a configured firm-approved secure path. If none is configured, ask before creating output; do not change `.gitignore` or repository configuration to accommodate it.

An authorised human decides tax and accounting positions, communicates, signs, posts, locks, pays, declares and lodges. This skill only prepares work for review and provides no audit or assurance conclusion. It is not tax, legal, immigration or financial advice.

## Fabricated acceptance example
A farm withholds at the registered rate from a worker on a 417 visa but cannot show when it registered as an employer of working holiday makers. The worker, a national of an eligible NDA country, says they became an Australian resident after signing a lease. Do not treat the withholding as correct, and do not apply resident rates in the return, until the registration evidence and the residency facts are resolved.
