# Division 296 tax workpapers
## Inputs
Income year, the individual's total superannuation balance (TSB) reported for each super interest at the dates the year requires, each fund's reported relevant superannuation earnings for the year, whether any interest is a defined benefit interest, a prescribed interest or an excluded interest, any limited recourse borrowing arrangement amounts included in a reported TSB, date of death if relevant, and any Division 296 notice already issued. For an SMSF, the fund's Division 296 fund earnings workings and any cost base election for assets held at the end of 30 June 2026.
## Workflow
1. Confirm the law applies to the year. Division 296 of the Income Tax Assessment Act 1997 was inserted by the Treasury Laws Amendment (Building a Stronger and Fairer Super System) Act 2026 and applies from the 2026-27 income year. Read the large and very large superannuation balance thresholds for the year from sections 296-30 and 296-35 or the ATO page; they are indexed after 2026-27.
2. Work out the TSB reference amount. For 2026-27, use the TSB at the end of the year only. From 2027-28, use the greater of the TSB just before the start of the year and at the end of the year. Remove limited recourse borrowing arrangement amounts. Tie each interest's value to the fund's report.
3. If the reference amount does not exceed the large threshold, or total superannuation earnings are nil or less, record that no taxable superannuation earnings arise and stop. Keep the supporting balances.
4. Total superannuation earnings: add the relevant earnings each fund reports, including interests held as a reversionary retirement phase recipient or notionally through a family law split. Treat excluded interests and foreign fund interests as nil. A missing fund report leaves the total `UNVERIFIED`.
5. Compute the proportion above each threshold: (reference amount less threshold) divided by reference amount, times 100, rounded to 2 decimal places as section 296-40 directs. Apply the proportion to total superannuation earnings for the large threshold component and, where relevant, the very large threshold component.
6. Apply the rates in the Superannuation (Building a Stronger and Fairer Super System) Imposition Act 2026 for each component, cross-checked against the ATO page. Show each component, its rate and the source separately.
7. Defined benefit and prescribed interests: identify the tax attributable to them, which is deferred to a Division 296 debt account, and record it apart from the amount due. Note that a liability not deferred is due 84 days after the notice of assessment.
8. Death: if the individual died in 2026-27, record that no Division 296 tax is payable for that year. For a later year of death, follow the ATO rules on TSB being nil after death and on later earnings being assessed in the year of death.
9. SMSF: check whether the fund made, or can still make, the irrevocable cost base election for assets held at the end of 30 June 2026 before its 2026-27 return is due. Prepare the facts for the trustee; the election is theirs.
## Hand-off and checks
A TSB schedule by interest and date, an earnings schedule by fund, the proportion and component calculations with rounding shown, a deferred amount for defined benefit or prescribed interests, and a reconciliation to any notice. Every earnings figure agrees to a fund report or is marked missing. Elections, objections and payment choices are reviewer and trustee decisions.
For each unresolved item record evidence needed, owner, status and next action. Keep dependent results conditional until the item is resolved.
## Source and review boundary
Before applying a rule, open the relevant primary authority for the work's period and jurisdiction. Record its title, direct URL, provision or paragraph, effective period, check date and the exact fact used. The adjacent `sources.json` records the figures Ryan Duguid reviewed on 24 September 2026 with their effective periods; use them only as a cross-check against the live page, not as current-law approval. A record in it that carries a `reverify_by` date expires after that date: do not use it even as a cross-check, and mark results that depend on it `UNVERIFIED` until the live source has been read. Search snippets and prior-year instructions do not establish the applicable rule. If authority or evidence is unavailable, mark the affected result `UNVERIFIED`, leave dependent calculations blank and identify what the reviewer needs. Never supply rates, thresholds, labels or deadlines from memory.
Keep real client data in the firm's approved environment, outside repositories and unapproved cloud prompts; omit unnecessary identifiers. Write client output only to a configured firm-approved secure path. If none is configured, ask before creating output; do not change `.gitignore` or repository configuration to accommodate it.

## Fabricated acceptance example
An SMSF member's TSB at 30 June 2027 is above the large threshold, the SMSF has not calculated its Division 296 fund earnings, and a second APRA fund has not reported earnings. Do not estimate the earnings or apply a start-of-year balance to 2026-27.
