# Division 293 tax workpapers
## Inputs
Income year, the individual's income tax return or its components (taxable income, reportable fringe benefits, net financial investment loss, net rental property loss, amounts on which family trust distribution tax was paid, super lump sum taxed elements with a zero rate, assessable first home super saver released amounts), each fund's concessional contribution report for the year including defined benefit contributions, any excess concessional contributions determination, any Division 293 notice already issued, and details of super guarantee amnesty contributions or constitutionally protected fund membership.
## Workflow
1. Read the Division 293 threshold and rate for the income year from the ATO key superannuation rates page. Do not assume the threshold has not moved.
2. Build Division 293 income from the return components the ATO lists, adding and subtracting as the ATO page directs and disregarding reportable super contributions. Tie each component to the return.
3. Build Division 293 super contributions from each fund's report: concessional contributions, including any counted under a carried-forward higher cap, less excess concessional contributions. Exclude super guarantee amnesty contributions the ATO says do not count. A fund report that is missing or late leaves the result `UNVERIFIED`; do not treat it as nil.
4. If Division 293 income plus Division 293 super contributions does not exceed the threshold, taxable contributions are nil. Otherwise they are the lesser of Division 293 super contributions and the excess over the threshold, that is max(0, min(contributions, income + contributions - threshold)). Apply the rate to that amount and show both limbs of the comparison. A nil result still needs every fund report; a missing report keeps it `UNVERIFIED`.
5. Defined benefit interests: identify the part of the tax attributable to defined benefit contributions, which the ATO defers to a debt account. Record the deferred amount separately and note the end-of-year interest the ATO applies to a debt account in debit.
6. For constitutionally protected fund members and Commonwealth judges, follow the ATO's separate treatment: those contributions count for the threshold test but not in taxable contributions.
7. If a notice has issued, reconcile it line by line to the workpaper. Note the 60-day window to elect to release money from super and that the election does not move the payment due date. Prepare the election details; do not lodge it.
## Hand-off and checks
A Division 293 income schedule tied to the return, a contributions schedule by fund, the lesser-of calculation, a deferred amount for defined benefit interests, and a reconciliation to any notice. Differences from a notice are traced to a return error, a fund reporting error or an open question. Objection, correction and release elections are reviewer decisions.
For each unresolved item record evidence needed, owner, status and next action. Keep dependent results conditional until the item is resolved.
## Source and review boundary
Before applying a rule, open the relevant primary authority for the work's period and jurisdiction. Record its title, direct URL, provision or paragraph, effective period, check date and the exact fact used. The adjacent `sources.json` records the figures Ryan Duguid reviewed on 24 September 2026 with their effective periods; use them only as a cross-check against the live page, not as current-law approval. A record in it that carries a `reverify_by` date expires after that date: do not use it even as a cross-check, and mark results that depend on it `UNVERIFIED` until the live source has been read. Search snippets and prior-year instructions do not establish the applicable rule. If authority or evidence is unavailable, mark the affected result `UNVERIFIED`, leave dependent calculations blank and identify what the reviewer needs. Never supply rates, thresholds, labels or deadlines from memory.
Keep real client data in the firm's approved environment, outside repositories and unapproved cloud prompts; omit unnecessary identifiers. Write client output only to a configured firm-approved secure path. If none is configured, ask before creating output; do not change `.gitignore` or repository configuration to accommodate it.

## Fabricated acceptance example
An individual's Division 293 income is just under the threshold, one of two funds has not reported its concessional contributions, and a Division 293 notice has not issued. Do not treat the missing report as nil or conclude that no Division 293 tax applies.
