# ATO penalties and interest workpapers

## Inputs

The ATO notice or account statement showing each liability, its original due date, payment dates and amounts, and any charge already raised; lodgment due dates and actual lodgment dates; amended assessment notices and the original assessment due date; the entity type and its PAYG withholder size or significant global entity status in the month a document was due; the entity's income years, including any substituted accounting period, and any GIC or SIC already claimed as a deduction or later remitted; and the facts and evidence for any remission or safe harbour request.

## Workflow

1. List each liability separately with its type, original due date, payments and running unpaid balance. Tie the opening balances to the ATO notice or statement. A liability without a due date stays `UNVERIFIED`.

2. General interest charge: split the unpaid period by the ATO's calendar quarters. For each day, take the GIC rate for that quarter from the ATO GIC rates page, and use the daily rate the page publishes rather than dividing the annual rate yourself. Verify the compounding and accrual rules in Part IIA of the Taxation Administration Act 1953 before computing. Show the rate, quarter and source row beside each segment.

3. Shortfall interest charge: confirm the period runs from the due date under the first assessment to the day before the amended assessment notice, as the governing provision for that tax type states. Take each quarter's SIC rate from the ATO SIC rates page. Check whether GIC accrues on any SIC left unpaid after its own due date, and cite the provision.

4. Deductibility: split each GIC and SIC amount by the date it was incurred, before 1 July 2025 and on or after it, and by income year. Open the ATO page on [denying deductions for ATO interest charges](https://www.ato.gov.au/about-ato/new-legislation/in-detail/businesses/deny-deductions-for-ato-interest-charges) and the *Treasury Laws Amendment (Tax Incentives and Integrity) Act 2025* for the work's period, including the later start for an entity with a substituted accounting period. List the amounts a draft return treats as deductible and any remission of an amount that was previously deducted. The tax treatment of each amount is a reviewer decision.

5. Failure to lodge penalty: count the days overdue per document and convert them to periods of 28 days or part thereof, capped at the maximum number of penalty units on the ATO page. Take the penalty unit value for the date the infringement occurred, not the calculation date. Apply the multiplier for the entity's withholder size or significant global entity status in the month the document was due. Where withholder size is unknown, show each possible multiplier and leave the result `UNVERIFIED`.

6. Note the ATO's stated practice on late returns that result in a refund or nil amount, and its exceptions, without assuming a penalty was or will be raised.

7. Remission and safe harbour: assemble the facts the ATO page asks for (the event, how it caused the delay, whether it was beyond the taxpayer's control, and why more time was not requested). For safe harbour, test both conditions on the ATO page: evidence that all relevant information reached the registered tax or BAS agent in time to lodge by the due date, and whether the agent's failure was not due to recklessness or intentional disregard of the tax law. The second condition is a reviewer judgement; record the facts and leave it open. Prepare a draft request; do not send it.

## Hand-off and checks

A liability schedule tied to the ATO notice, a GIC and SIC schedule by quarter with rate sources, the same charges split at 1 July 2025 and by income year for deductibility, a failure to lodge schedule by document showing days late, periods, penalty unit value and multiplier, and a remission or safe harbour evidence pack with a draft request. Computed charges agree to the ATO statement or the difference is explained. Whether to request remission, and what to say, remain reviewer decisions.

For each unresolved item record evidence needed, owner, status and next action. Keep dependent results conditional until the item is resolved.

## Source and review boundary

Before applying a rule, open the relevant primary authority for the work's period and jurisdiction. Record its title, direct URL, provision or paragraph, effective period, check date and the exact fact used. The adjacent `sources.json` records the figures Ryan Duguid reviewed on 24 September 2026 with their effective periods; use them only as a cross-check against the live page, not as current-law approval. A record in it that carries a `reverify_by` date expires after that date: do not use it even as a cross-check, and mark results that depend on it `UNVERIFIED` until the live source has been read. Search snippets and prior-year instructions do not establish the applicable rule. If authority or evidence is unavailable, mark the affected result `UNVERIFIED`, leave dependent calculations blank and identify what the reviewer needs. Never supply rates, thresholds, labels or deadlines from memory.

Keep real client data in the firm's approved environment, outside repositories and unapproved cloud prompts; omit unnecessary identifiers. Write client output only to a configured firm-approved secure path. If none is configured, ask before creating output; do not change `.gitignore` or repository configuration to accommodate it.

An authorised human decides tax and accounting positions, communicates, signs, posts, locks, pays, declares and lodges. This skill only prepares work for review and provides no audit or assurance conclusion. It is not tax, legal or financial advice.

## Fabricated acceptance example

A company lodged three activity statements late, one due before 1 July 2026 and two after, and its PAYG withholding records for those months are missing. Do not apply one penalty unit value to all three or assume the base multiplier.
