Use for ordinary domestic taxable goods or services, tax-exclusive versus fixed tax-inclusive prices, invoice numbers, sale dates and ledger reconciliation. It gives two executable examples and names the actual seller and completion-tax-point rules. It does not extend the general rate into sectors where current authority summaries conflict with the regulation. Registration, exemptions, digital split payment, current return fields, deadlines, receipts and cross-border credit or reverse-charge treatment remain explicit gaps. The prior blanket VAT-mechanism claims are held as unsupported. This is a bounded invoice method with independent source review limited to this conditional baseline, not a completed return, country-completion claim or licensed accountant attestation."

# Somalia ordinary domestic sales-tax invoice method v0.1
> **General reference only.** This skill is general tax/accounting reference material for AI-assisted workflows. It has not been reviewed for any specific person's facts, documents, elections, deadlines, residency, filing status, or local procedures. Do not rely on it to file, pay, amend, or take a tax position without review by a qualified professional in the relevant jurisdiction.
## Who this applies to
**Partial ordinary domestic sales-tax invoice method for2026 preparation.** The governing source read here is signed regulationMOF/OM/0089/23 of9December2023, recovered from an official-site [archive captured15April2025](https://web.archive.org/web/20250415080835id_/http://revenuedirectorate.gov.so/sites/default/files/pdf/Xeer-Nidaamiyaha%20Balaarinta%20Nuucyada%20Ganacsiyada%20iyo%20Shirkadaha%20Lagu%20Dabaqayo%20Canshuurta%20Gadidda_0001.pdf). Current direct/browser downloads failed. Its general5% rate agrees with the current authority's ordinary goods/wholesale table, but the authority publishes different rates for some sectors without the supporting later instrument. Resolve date, location, sector and any later amendment before applying this method. No complete2026 amendment/exemption audit is claimed. [Regulation arts.1–3,8, PDF 1–5](https://www.revenuedirectorate.gov.so/sites/default/files/pdf/Xeer-Nidaamiyaha%20Balaarinta%20Nuucyada%20Ganacsiyada%20iyo%20Shirkadaha%20Lagu%20Dabaqayo%20Canshuurta%20Gadidda_0001.pdf); [current authority table](https://www.revenuedirectorate.gov.so/indirect-tax).
The regulation expands the businesses covered by the1984sales-tax law and says other payroll/profit taxes remain unaffected. It includes retail, professional and other named services, with a broader goods/services catch-all. Do not interpret that list as proof that every sector currently bears the same rate. VAT-style credit, reverse charge, import services and exemptions remain specifically unresolved; none is set to zero because the label is sales tax. [Arts.1–2, PDF 2](https://www.revenuedirectorate.gov.so/sites/default/files/pdf/Xeer-Nidaamiyaha%20Balaarinta%20Nuucyada%20Ganacsiyada%20iyo%20Shirkadaha%20Lagu%20Dabaqayo%20Canshuurta%20Gadidda_0001.pdf).
## Rates, bands and thresholds
| Item | Source rule and application gate | Official source |
|---|---|---|
| General sales-tax baseline | 5% of value of goods/services exchanged; apply only after ordinary domestic taxable sale and current sector treatment established | [Art.3(1), PDF 3](https://www.revenuedirectorate.gov.so/sites/default/files/pdf/Xeer-Nidaamiyaha%20Balaarinta%20Nuucyada%20Ganacsiyada%20iyo%20Shirkadaha%20Lagu%20Dabaqayo%20Canshuurta%20Gadidda_0001.pdf) |
| Tax point and responsible seller | Seller business/company owes tax when goods exchange or service provision is completed; a return-payment deadline is a separate question | [Art.3(1), PDF 3](https://www.revenuedirectorate.gov.so/sites/default/files/pdf/Xeer-Nidaamiyaha%20Balaarinta%20Nuucyada%20Ganacsiyada%20iyo%20Shirkadaha%20Lagu%20Dabaqayo%20Canshuurta%20Gadidda_0001.pdf) |
| Invoice | Each sale shows goods/service value and5% tax; the invoice series is consecutive starting1 each year, with sale date | [Art.3(2)–(3), PDF 3](https://www.revenuedirectorate.gov.so/sites/default/files/pdf/Xeer-Nidaamiyaha%20Balaarinta%20Nuucyada%20Ganacsiyada%20iyo%20Shirkadaha%20Lagu%20Dabaqayo%20Canshuurta%20Gadidda_0001.pdf) |
| Sector conflict | Unverified legal reconciliation: current authority table differs for telecom, banks/remittance and supply-chain services; obtain supporting instrument instead of extrapolating general5% | [Authority sector table](https://www.revenuedirectorate.gov.so/indirect-tax) |
No registration threshold, exemption, credit entitlement, interest or currently reconciled penalty amount is supplied. No absence is inferred.
## The base
1. **Classify the transaction and administration.** Obtain seller identity, TIN, location, activity, customer, supply description and completion date. Separate domestic goods, domestic services, imports, exports and cross-border services. This method only computes an ordinary domestic sale whose taxable status and current rate have been confirmed. Hold sector-rate conflicts, exemptions, territorial questions and imports for their own instrument analysis. [Arts.1–3](https://www.revenuedirectorate.gov.so/sites/default/files/pdf/Xeer-Nidaamiyaha%20Balaarinta%20Nuucyada%20Ganacsiyada%20iyo%20Shirkadaha%20Lagu%20Dabaqayo%20Canshuurta%20Gadidda_0001.pdf).
2. **Establish price terms.** Reconcile contract, order, delivery/service evidence and invoice. Record explicitly whether an amount is the goods/service value before tax or a fixed total including tax. Do not add tax twice or assume every receipt is exclusive. Article 3 supplies the tax/value rule; interpreting the actual agreed price requires the contract facts. [Art.3(1)–(2)](https://www.revenuedirectorate.gov.so/sites/default/files/pdf/Xeer-Nidaamiyaha%20Balaarinta%20Nuucyada%20Ganacsiyada%20iyo%20Shirkadaha%20Lagu%20Dabaqayo%20Canshuurta%20Gadidda_0001.pdf).
3. **Compute and check invoice.** On established exclusive taxable value, multiply by the verified rate and add the result. If a contract explicitly fixes an inclusive total for that same taxable sale, divide that total by one plus the rate and take the difference as tax. These algebraic alternatives do not grant a legal right to increase an agreed total. Show value, tax rate, tax and invoice total separately. [Art.3(1)–(2)](https://www.revenuedirectorate.gov.so/sites/default/files/pdf/Xeer-Nidaamiyaha%20Balaarinta%20Nuucyada%20Ganacsiyada%20iyo%20Shirkadaha%20Lagu%20Dabaqayo%20Canshuurta%20Gadidda_0001.pdf).
4. **Maintain the invoice register.** Allocate consecutive numbers beginning1 for each year and show the sale date. Reconcile the invoice series, cancelled/adjusted documents and ledger without silently deleting a number. The numbering/date duties are statutory; the reconciliation schedule is an evidence recommendation. Make invoices available when the responsible revenue officers request them. No statutory retention period is claimed here. [Arts.3(3),4](https://www.revenuedirectorate.gov.so/sites/default/files/pdf/Xeer-Nidaamiyaha%20Balaarinta%20Nuucyada%20Ganacsiyada%20iyo%20Shirkadaha%20Lagu%20Dabaqayo%20Canshuurta%20Gadidda_0001.pdf).
5. **Reconcile collection and treasury settlement.** Record tax charged, money received, payment-processor deductions and actual treasury receipts separately. A tax point does not establish the digital split-payment or monthly-return method. Obtain that current instrument, accepted reporting form, period/deadline, payment reference and acknowledgement before asserting settlement. The output ends as a sales-tax schedule while those steps remain unresolved.
## Deadlines and filing
The sourced completion tax point and annual invoice sequence are in the table above. The regulation does not itself settle the current electronic collection/reporting workflow. This Guide does not certify the predecessor's18August2024split-payment start date or monthly filing rule. Current registration/threshold, exact return fields, reporting/payment due dates, correction process, portal/provider integration and receipt reconciliation remain holds. Archive each invoice and actual submission/payment receipt once the accepted route is established. [Arts.3–4](https://www.revenuedirectorate.gov.so/sites/default/files/pdf/Xeer-Nidaamiyaha%20Balaarinta%20Nuucyada%20Ganacsiyada%20iyo%20Shirkadaha%20Lagu%20Dabaqayo%20Canshuurta%20Gadidda_0001.pdf).
## Penalties and interest
Regulation art.5 contains invoice/nonpayment and invoice-production sanctions and says outstanding tax remains due despite penalties. The older statute, current Revenue Administration instruments and later civil-penalty rules have not been reconciled, so this Guide does not compute a numeric penalty or treat those historic figures as exhaustive current sanctions. Article 7 describes a complaint committee and court appeal; its current relationship with the administration-law objection process remains unresolved. Preserve the notice and service date, and source the actual challenge route before advising a deadline. [Arts.5–7, PDF 3–4](https://www.revenuedirectorate.gov.so/sites/default/files/pdf/Xeer-Nidaamiyaha%20Balaarinta%20Nuucyada%20Ganacsiyada%20iyo%20Shirkadaha%20Lagu%20Dabaqayo%20Canshuurta%20Gadidda_0001.pdf).
## Cross-border points
Imports require the separate customs/sales-tax base and collection rules. An imported-service reverse charge cannot be accepted or rejected from the domestic sales-tax label. Export exemptions and input-tax/refund rights require their actual provisions. No domestic sale example grants an import exemption, reverse-charge exemption, export zero rate or input credit. Those predecessor topics are explicitly held.
## Two worked examples that recompute
**Exclusive ordinary sale.** Assume a current ordinary domestic taxable sale at the sourced general rate, confirmed applicable, with USD 1,000 value exclusive of tax. Tax is USD 50 and invoice totalUSD1,050. Show both amounts and the confirmed completion date on the properly numbered invoice.
```oa-check
name: Ordinary domestic exclusive sale
inputs:
exclusive_value: 1000
steps:
sales_tax: exclusive_value * 0.05
invoice_total: exclusive_value + sales_tax
expected:
sales_tax: 50
invoice_total: 1050
```
**Price-term decision.** The same rate/classification assumptions apply, but compare USD 1,000 exclusive value against a contract that explicitly fixes USD 1,000 inclusive total. The former gives USD 50 tax and USD 1,050 total. The latter yields valueUSD952.38 and taxUSD47.62 after rounding. The customer agreement decides the branch; do not issueUSD1,050 against a fixed inclusiveUSD1,000 contract merely because it gives the same desired net value.
```oa-check
name: Exclusive amount versus fixed inclusive total
inputs:
quoted_amount: 1000
steps:
exclusive_branch_tax: quoted_amount * 0.05
exclusive_branch_total: quoted_amount + exclusive_branch_tax
inclusive_branch_value: round(quoted_amount / 1.05, 2)
inclusive_branch_tax: quoted_amount - inclusive_branch_value
expected:
exclusive_branch_tax: 50
exclusive_branch_total: 1050
inclusive_branch_value: 952.38
inclusive_branch_tax: 47.62
```
## Ask the client first
- What seller, administration, activity and supply type/date apply?
- Which current sector-rate/exemption instrument and registration instructions apply to those facts?
- Does the contract state tax-exclusive value or fixed tax-inclusive total?
- What invoice sequence, delivery/service evidence and ledger/payment-processor records exist?
- Which import/export or cross-border-service facts change the analysis?
- What current return, settlement, treasury-receipt or assessment instructions have been supplied?
