# Svalbard: residence and cross-border tax in 2026 v0.3
> **Source-cited draft.** Tax year 2026, checked 24 October 2026. General reference for working papers; a qualified professional must review the facts and filing position. Independent AI review does not confer accountant review.
## Who this applies to
This is the pack's **XB** guide. It concerns Svalbard within [Svalbard Tax Act §1-1](https://lovdata.no/dokument/NL/lov/1996-11-29-68); the shared SJ catalogue code does not extend it to Jan Mayen. Apply residence, source and the relevant income category separately.
An individual taking permanent residence is resident. A stay lasting **at least 12 months** counts as residence **from the beginning**, not from month 13 (§2-1). Real residential attachment is factual; a brief holiday/business absence does not necessarily break it ([residence guidance](https://www.skatteetaten.no/person/skatt/hjelp-til-riktig-skatt/svalbard/hvem-er-skattemessig-bosatt-pa-svalbard/)). A company is resident only with an **office on Svalbard and management from there** (§2-3).
A nonresident's local work/business income is liable after **at least 30 continuous days** of stay for an individual (§2-2), or business activity for a company (§2-4). Company activity and employee presence are separate tests. Property and installations on Svalbard are independently taxable under §2-2(3), including property income and qualifying property wealth, without a 30-day condition.

## The base
**Newcomers:** no Norwegian residence, including Svalbard, in the preceding ten years restricts liability to the §2-2 scope for the first five years of Svalbard residence. This is a limited-liability regime, not a general tax holiday. The office can set it aside for an income year where a significant amount, defined by the Act as **12 G**, is excluded (§2-1(2)). Keep the prior residence history and all excluded income/wealth. Do not hardcode the payroll G timing into this separate discretionary provision without an official determination.
**Residents:** worldwide income/wealth is the starting point for individuals and worldwide income for companies, subject to the Act's exceptions. For employment or business **performed outside Svalbard**, show that it is taxable under other Norwegian tax or in a foreign state before applying §§2-1/2-3 exclusions. Property/installations outside Svalbard and their income have a separate location-based exclusion. A foreign payer alone proves neither foreign work nor taxable foreign source. Allocate related costs, interest and debt consistently under Act §3-2 and Income Tax Act §§4-31, 6-91; do not deduct costs of exempt income against taxable Svalbard profit by default.
**Departure:** resident liability ends from the income year in which outside days exceed **183 in a rolling twelve-month period**. Whole or part outside days count and absences need not be continuous. It is **more than** 183, not at least 183. Necessary medical treatment or similarly weighty reasons allow a specific office decision preserving residence after an overall assessment ([Svalbard regulation §8](https://lovdata.no/dokument/SF/forskrift/1997-12-15-1305)); it is not an automatic travel-day exclusion. When residence ceases from the start of that income year, recheck each local work stay for limited liability and reconsider that year's pension/capital-income allocation. Remaining local property stays within source liability. Unconditionally earned unpaid salary is brought into charge at departure under [Act §3-1 / Income Tax Act §14-3(4)(b)](https://lovdata.no/dokument/NL/lov/1999-03-26-14/KAPITTEL_14).
**Distributions:** for a Svalbard company paying a shareholder resident abroad within Income Tax Act §10-13, apply the enacted **20%** withholding rate. Establish recipient status and any domestic-law exemption first, including the actual §2-38 conditions for qualifying corporate recipients. Do not extend foreign-shareholder withholding mechanically to every mainland recipient: [Income Tax Act §2-35(2)(a)](https://lovdata.no/dokument/NL/lov/1999-03-26-14/KAPITTEL_2) expressly preserves exceptions for §§2-38 and 10-13. The personal shareholder shielding deduction is excluded for Svalbard assessment by Act §3-2. Establish each recipient’s residence and statutory exemption position before applying withholding.
## Deadlines and filing
A resident with ordinary assessed income/wealth uses the annual return, ordinarily **30 April after the income year**; companies/sole traders use **31 May**, with the applicable non-working-day/extension rules ([Administration regulation §§8-2-3, 8-2-5](https://lovdata.no/dokument/SF/forskrift/2016-11-23-1360/KAPITTEL_7)). Business allocation requires the business specification and supporting attachment ([business guidance](https://www.skatteetaten.no/person/skatt/hjelp-til-riktig-skatt/svalbard/naring-pa-svalbard/)). Withholding-only temporary work is administered through the employer; assessed property/business income is a separate return obligation. Notify Skatteetaten of residence/source corrections and establish identity/reporting access.
For foreign-shareholder dividends, report the withholding under Administration Act §8-8(3) within **seven days after withholding**, or **one month for VPS-registered companies** ([regulation §8-8-3](https://lovdata.no/dokument/SF/forskrift/2016-11-23-1360/KAPITTEL_7)). Payment is due on the same day as that reporting deadline ([Payment Act §10-13](https://lovdata.no/dokument/NL/lov/2005-06-17-67)). This is separate from next-working-day payroll remittance. Retain the resolution, gross dividend, recipient evidence, withholding and payment proof.
Annual advance and residual payments follow Payment Act §§10-20–10-21, detailed in the individual/company guides. On cessation submit outstanding reports, final results and tax-position schedules; cessation does not cancel payment obligations. Under Income Tax Act §10-70(11), mainland exit-tax changes must be disclosed without undue delay; deferred exit-tax obligations need continuing reporting.
## Penalties and interest
Under [Svalbard Act §4-1](https://lovdata.no/dokument/NL/lov/1996-11-29-68), the Tax Administration Act applies. Missing mandatory information can trigger a daily coercive fine, ordinarily **0.5 court-fee units per day**, capped at **50 units** for the ordinary information failure ([Administration Act §14-1](https://lovdata.no/dokument/NL/lov/2016-05-27-14); [regulation §14-1-1](https://lovdata.no/dokument/SF/forskrift/2016-11-23-1360/KAPITTEL_13)). The authority's notice sets the start date; this is not an automatic charge on every late return.
Incorrect or incomplete information producing a tax advantage attracts **20%** additional tax, reduced to **10%** for the specified third-party-reported information. Intentional or grossly negligent failures can attract a further **20% or 40%**. Excusable circumstances, qualifying voluntary correction and other statutory exceptions must be tested ([Administration Act §§14-3 to 14-6](https://lovdata.no/dokument/NL/lov/2016-05-27-14)). These percentages apply to the tax advantage, not turnover.
Unpaid tax bears interest from the due date under [Payment Act §§11-1 and 11-6](https://lovdata.no/dokument/NL/lov/2005-06-17-67). The [authority's 2026 interest table](https://www.skatteetaten.no/satser/forsinkelsesrenter/) gives **12% a year for 1 January–30 June 2026** and **12.25% for 1 July–31 December 2026**. Split arrears at the change date. A payment falling due in 2027 needs the rate then in force; do not extrapolate 2026 rates.
## Cross-border points
**Mainland interaction:** [Income Tax Act §2-35(2)(c)](https://lovdata.no/dokument/NL/lov/1999-03-26-14/KAPITTEL_2) removes mainland tax on income/wealth **taxed to Svalbard** for mainland residents/companies. Keep proof of the Svalbard assessment. Moving does not itself prove mainland fiscal emigration; §2-1(3)'s separate residence/departure conditions still matter. The 2026 [authority S-23-2.2](https://oppslag.rettskilder.skatteetaten.no/rettskilder2/type/handboker/skatte-abc/gjeldende/skatteabc-S-23) explains the ongoing mainland residence link and why the rules must be tested separately.
**Treaties and foreign tax:** Norway's income-tax treaties do **not** apply to Svalbard ([current authority S-23-1.5 and 9.2.3](https://oppslag.rettskilder.skatteetaten.no/rettskilder2/type/handboker/skatte-abc/gjeldende/skatteabc-S-23)). The Nordic insurance convention is separate. Use the statutory Svalbard source exclusions first. For a fully liable resident with foreign-source capital income or wealth also included in the Svalbard base, [Act §3-2](https://lovdata.no/dokument/NL/lov/1996-11-29-68) imports the domestic credit rules in [Income Tax Act §§16-20–16-29](https://lovdata.no/dokument/NL/lov/1999-03-26-14/KAPITTEL_16). A credit requires the same taxpayer's final income/wealth tax imposed and paid in the foreign source state on the included item. Excluded income has no credit capacity, and a foreign levy is not automatically a qualifying income/wealth tax. Social contributions are outside this income/wealth-tax credit; §16-20(1) also excludes credit against the 3% dividend inclusion under §2-38(6).
Determine the Svalbard taxable base first, then allocate foreign income and costs under [FSFIN §§16-29-2–11](https://lovdata.no/dokument/SF/forskrift/1999-11-19-1158/KAPITTEL_16-3-1-1). Directly attribute income and associated costs; allocate deductible debt interest and unassignable common costs proportionately under §16-29-4, applying its specific exceptions only where their conditions hold. Do not import mainland deductions excluded by Svalbard Act §3-2. Use Norwegian tax timing under §16-29-5 and currency conversion under §16-29-6. The ordinary foreign-income credit is the **lesser of qualifying foreign tax and the part of Svalbard income tax proportionately attributable to included net foreign income**, calculated within the separate income categories in §16-21. Wealth tax is a separate credit calculation, capped at the Svalbard wealth tax proportionately attributable to included foreign wealth; income tax cannot absorb wealth-tax credit or vice versa.
Unused foreign **income-tax** credit can carry forward up to **five subsequent years** within the same category and capacity rules. It can carry back **one year** only where §16-22(2)'s prospective inability-to-use condition is proved. Use current-year foreign tax before brought-forward credits, and older brought-forward credits first (§16-22). Do not deduct the same foreign tax as an expense and a credit (§16-24).
Claim in the annual return by its deadline, or, if the foreign assessment cannot yet be substantiated, within **six months after final foreign assessment**, with an absolute **ten-year** limit after the income year (§16-25). Retain foreign assessment/payment evidence, source/base/cost schedules and required translations, and disclose subsequent foreign assessment changes under FSFIN §§16-29-8–11. A foreign resident with limited Svalbard source liability must seek home-state relief under that state's law; no Norwegian treaty entitlement is supplied here.
**Mainland move to Svalbard:** Income Tax Act §2-35(2)(b) expressly extends §10-70 to a person becoming Svalbard-resident and to specified transfers to Svalbard recipients. Svalbard is treated as EEA for this specific rule. For a 2026 departure, §10-70 covers the listed share/account/fund/derivative assets, deems disposal just before the change, applies the **NOK 3m** departure gain allowance and a distinct **NOK 100,000** annual transfer threshold. Gain uses market value less the applicable tax basis, with statutory loss/immigration-basis rules. A qualifying deferral runs up to **12 years**, with security rules and annual-instalment or interest-bearing end-payment choices (§10-70(7)). Disposals, transfers and distributions can accelerate payment; **70% of distributions** is the statutory amount in §10-70(8), subject to its safeguards. A move to Svalbard is not a tax-free alternative to mainland exit tax. Full account-specific valuation and deferral administration are outside this guide's verified computation.
**Leaving Svalbard/business cessation:** check unpaid remuneration, final gains/losses and the continuing local-property source rule. Ordinary asset disposal and complete company liquidation use §§14-44–14-48, including settlement of negative tax pools/gain accounts and eligible loss deductions, as detailed in the company guide; final business losses also need §14-7 or the specific sole-trader rule. Those confirmed cessation mechanics are not the unresolved gap. Imported Income Tax Act §§9-14 and 10-71 address assets leaving the tax base and company emigration. The Svalbard territorial adaptation of those cross-border unrealised-gain/company-emigration provisions, their exclusions and payment computations are not established here, so no automatic tax-free exit or invented flat exit levy is stated. This remains a core XB gap in the README.
## Two worked examples that recompute
**Exactly 30 days qualifies.** A nonresident adult has exactly 30 continuous countable local days, excluding travel days, and NOK 90,000 covered salary below 12 G. Income tax is NOK 7,200. Membership must be established separately; insurance is excluded from this example. A foreign tax-treaty work threshold is not substituted.
```oa-check
name: Svalbard nonresident exactly thirty days 2026
inputs:
local_salary: 90000
steps:
income_tax: local_salary*0.08
after_income_tax: local_salary-income_tax
expected:
income_tax: 7200
after_income_tax: 82800
```
**Foreign capital-income credit is capped.** A fully liable resident has verified net ordinary income after allowable costs/allowance of NOK 200,000, of which NOK 50,000 is attributable to included foreign-source capital income after the required allocation. Assume NOK 10,000 final qualifying foreign income tax has been paid and no other credits. Svalbard income tax before credit is NOK 32,000, and the proportional ceiling is NOK 8,000. Credit is NOK 8,000, leaving NOK 24,000 Svalbard tax; unused foreign income tax NOK 2,000 enters the statutory carryforward test. The attributed bases are established inputs, not raw foreign receipts, and this example does not give credit for excluded foreign business income.
```oa-check
name: Svalbard foreign capital income credit ceiling 2026
inputs:
total_net_ordinary_base: 200000
attributed_foreign_base: 50000
qualifying_foreign_tax: 10000
steps:
svalbard_tax: total_net_ordinary_base*0.16
ceiling: svalbard_tax*attributed_foreign_base/total_net_ordinary_base
credit: min(qualifying_foreign_tax,ceiling)
net_tax: svalbard_tax-credit
unused: qualifying_foreign_tax-credit
expected:
svalbard_tax: 32000
ceiling: 8000
credit: 8000
net_tax: 24000
unused: 2000
```
## Ask the client first
- What are the exact arrival, departure and rolling absence dates, plus ten-year Norwegian residence history?
- Where are actual work, business, management and property, and which assessments prove taxability elsewhere?
- What foreign income/wealth, recipient identities, shareholdings and proposed distributions exist?
- What assets, tax bases and deferred mainland exit obligations exist on arrival/departure?
- Are there medical-absence decisions, foreign levies, prior returns or unresolved office determinations?

The current Skatte-ABC contains stale year labels in some rate paragraphs and numbering inconsistencies. The enacted 2026 decision and consolidated statute control all figures here.
Not yet confirmed: Svalbard territorial adaptation and computation/payment of cross-border unrealised-asset gains and company emigration. Ordinary disposal/liquidation and final-loss rules are covered. No unverified exit exemption or exit amount is supplied.
