# Qatar payroll and social insurance v0.1

## Who this applies to

For 2026, use [Social Insurance Law 1/2022](https://almeezan.qa/legislations/ff5e6696-5502-42af-b342-c2f9882cec6a) with [Cabinet Decision
3/2025, its implementing regulations (SR)](https://almeezan.qa/legislations/2248f9c5-1f1b-4183-af84-ab8fbaf71bae), not the replaced 2002 rules.
The authority's current site is [Daman](https://www.daman.gov.qa/Arabic/Pages/default.aspx).
Law arts. 2–3 cover Qatari nationals in government and private employment,
subject to the statutory exclusions, aged at least 18 and in regular employment
for at least one continuous or intermittent year. Check the authority's actual
coverage determination for a new engagement; do not wait a year to register an
otherwise covered permanent employee. Family members working in the specified
private family employment and people covered by the excluded military or superior
private schemes require the arts. 2 and 5 exclusions to be tested.

Other GCC citizens working in Qatar use their home-state scheme through the
mandatory GCC extension system, not an automatic Qatari 7%/14% calculation.
Non-GCC expatriates are outside these nationality-based pension schemes.
End-of-service benefits and other employment obligations require separate labour
law analysis. Employment salaries, wages and similar remuneration are excluded
from income tax by [ITL promulgation art. 2(3)](https://almeezan.qa/legislations/d444f6ad-68b1-4244-af96-6bf9ee39e065); this is not an exemption
for independent business income.

## The base

For an ordinary Qatari employee, obtain gross basic salary, social allowance and
housing before payroll deductions. Compute included housing as
`min(cash/equivalent housing, 6000)`, then the ordinary monthly base as
`min(basic + social allowance + included housing, 100000)`. Apply 7% employee
and 14% employer separately. Other allowances are not automatically basic salary
or a social allowance. Establish the actual contractual classification and the
authority's in-kind valuation. Sources: [Law arts. 1, 11–14](https://almeezan.qa/legislations/ff5e6696-5502-42af-b342-c2f9882cec6a) and
[SR art. 16](https://almeezan.qa/legislations/2248f9c5-1f1b-4183-af84-ab8fbaf71bae). Use a separate documented legacy-base calculation where
art. 13 applies; do not reduce every existing above-cap record to QAR 100,000.

Housing is part of the base, not a benefit taxable at a separate rate. Law art. 12
requires at least 15 years' housing contributions when service ends: on death,
disability or retirement the employer completes the prescribed missing housing
contributions; in the other stated cases the employee chooses payment of the
shortfall or refund of their housing contributions. Returning pensioners have
the separate eight-year rule in that article. These settlement rules do not
permit dropping housing from monthly payroll after 15 years.

For multiple jobs, [SR art. 13](https://almeezan.qa/legislations/2248f9c5-1f1b-4183-af84-ab8fbaf71bae) selects one insurance relationship:
government, then the specified public-benefit/state-participated bodies, then
other private employment; within a class use earlier service, and if the same
start date, higher wage. Obtain the authority's notification, rather than charging
both jobs or choosing whichever costs less.

For reduced sick pay, [SR art. 23](https://almeezan.qa/legislations/2248f9c5-1f1b-4183-af84-ab8fbaf71bae) keeps the full normal contribution
base. The employee pays 7% on actual paid contributory salary; the employer pays
its normal 14% plus the difference between the normal employee share and the
share actually paid by the employee. During unpaid sick leave the employer pays
the full 21%. SR art. 22 maintains contributions on the prescribed pre-reduction
wage for its listed secondment, mission, leave and employment situations.
Under SR art. 25, the specified unpaid non-sick leave/secondment cases instead
require an employee election within 30 days to continue at their own 21% of the
last base; the regulation terminates that continuation after 90 consecutive or
180 intermittent days of nonpayment. Classify the leave before computing.

Law art. 4 provides optional self-employed Qatari participation on income slices
at 21%, under a separately approved category/slice regime. This Guide does not
invent income bands or treat that opt-in regime as ordinary employer payroll.
Obtain the authority's operative enrolment decision and assessed slice before
calculating a voluntary self-employed contribution. Benefit/pension calculations
and this specialist voluntary scheme are outside the ordinary payroll scope.

## Deadlines and filing

Register the covered employer and each employee with the authority, supplying
registration, identity, nationality, appointment/contract and pay evidence under
[SR arts. 2–8](https://almeezan.qa/legislations/2248f9c5-1f1b-4183-af84-ab8fbaf71bae). Report employer changes within 30 days and submit the
wage and paid/unpaid-days data by the end of each month: SR art. 5. Joining and
leaving have their own 30-day notices. Keep the authority's acknowledgement and
match each employee identifier to the monthly schedule.

Reconcile January pay changes under Law art. 14 and SR art. 20, alongside the
monthly reporting requirement. Contributions become due on the first of the next
month and must be paid by its fifth day: SR arts. 17 and 28. Thus ordinary
November 2026 contributions must be paid by 5 December 2026. Other amounts
notified by the authority are due within 30 days under SR art. 28. Do not turn a
payment timetable into permission to omit joiners or monthly pay changes.

For merger/liquidation, notify within 14 days and deal with successor records
and liabilities under SR art. 9. Maintain employee-by-employee wage, contribution,
leave, joining/leaving and payment evidence; keep any authority-assessed joining
month adjustment instead of inventing a daily proration from the service-credit
rules. Use the authority's employer service linked on its site.

## Penalties and interest

| Breach | Consequence | Official provision |
|---|---|---|
| Late contribution | Additional 2% per month | [Law art. 21](https://almeezan.qa/legislations/ff5e6696-5502-42af-b342-c2f9882cec6a) |
| Unregistered worker or contribution on understated wage | Additional 10% of the true contributions in the provision | [Law art. 22](https://almeezan.qa/legislations/ff5e6696-5502-42af-b342-c2f9882cec6a) |
| Nonregistration, false wage/service data or unlawfully charging employer contributions to employees | Up to 6 months' imprisonment and/or QAR 30,000 fine, subject to offence wording | [Law arts. 74–75](https://almeezan.qa/legislations/ff5e6696-5502-42af-b342-c2f9882cec6a) |
| Specified bad-faith data/withholding offence | Up to 3 months and/or QAR 50,000 | [Law art. 76](https://almeezan.qa/legislations/ff5e6696-5502-42af-b342-c2f9882cec6a) |
| Obstructing authorised inspection | Up to 3 months and/or QAR 10,000 | [Law art. 77](https://almeezan.qa/legislations/ff5e6696-5502-42af-b342-c2f9882cec6a) |

Read the actual offence before applying a fine: art. 74 includes multiplication
by affected employees; art. 78 doubles the penalty for qualifying repetition
within four years. Art. 79 addresses responsible management. Settlement under
art. 81 requires the authorised decision, half the maximum fine and remedying
the violation; it is not an automatic payroll discount. A late contribution
calculation does not settle criminal liability.

## Cross-border points

[GCC extension Law 4/2007](https://almeezan.qa/legislations/3a0c705a-eb50-4db8-a7d1-0a1edd28743f), arts. 2, 4 and 8–11, applies the employee's
home-country insurance conditions when nationality and covered-employer tests
are met. Register using home-state forms through the host authority. Obtain the
home scheme's actual rates, wage components, ceiling and effective date; the
Qatar-resident employer does not substitute the Qatari national's rates.

Compute the full home-state liability. The employer funds its share only within
the host-state limit under art. 11, and the employee bears the difference unless
the home state takes it over. The [authority's current guidance](https://www.daman.gov.qa/Arabic/Pensions/InsuranceProtection/Pages/default.aspx)
expressly includes rate differences and differences in wage components: the
employee bears both shares on housing above QAR 6,000 and on the contribution
wage above QAR 100,000. For each component separate the employer-funded amount
within the Qatar limits from the additional home-scheme liability. Deduct the
employee's own share plus the unfunded difference and remit to the designated
home-state account using host-state timing. Arts. 13 and 15 apply host-state
penalties and employment-ending notification deadlines. Art. 19 refers matters
not addressed by the system to the home-state insurance law; do not assume the
Qatari employee leave calculation applies to every GCC home scheme. A current home-authority assessment is required to
populate this calculation; this Guide supplies no invented GCC-wide rate.

[Law 5/2021, art. 1](https://almeezan.qa/legislations/38bdc1f3-21db-4df2-8169-f657597d41b3) inserted art. 2 Bis in the promulgation provisions:
For GCC employees covered by this system, the employer is not obliged to pay
the end-of-service benefit under the listed labour/HR laws, contracts and private
arrangements.
Do not repeat the blanket expatriate gratuity statement for a covered GCC worker.
A move between states requires coverage/transfer evidence, not two simultaneous
assumptions of domestic national coverage.

## Two worked examples that recompute

### 1. Ordinary salary and housing cap

A covered Qatari employee has QAR 20,000 basic pay, QAR 5,000 social allowance
and QAR 8,000 housing. No legacy-base exception applies. Law arts. 11–12 and
SR art. 16 include only QAR 6,000 housing: base QAR 31,000; employee QAR 2,170;
employer QAR 4,340; total QAR 6,510.

```oa-check
name: Qatar ordinary monthly social insurance housing cap
inputs:
  basic: 20000
  social: 5000
  housing: 8000
  housing_cap: 6000
  base_cap: 100000
  employee_rate: 0.07
  employer_rate: 0.14
steps:
  base: min(basic + social + min(housing, housing_cap), base_cap)
  employee: base * employee_rate
  employer: base * employer_rate
  total: employee + employer
expected:
  base: 31000
  employee: 2170
  employer: 4340
  total: 6510
```

### 2. Reduced sick pay transfers the missing employee share

Assume normal contributory salary QAR 30,000, actual sick pay QAR 15,000 and
no cap exception. Under SR art. 23, total contributions remain QAR 6,300.
The employee funds QAR 1,050; the employer funds its normal QAR 4,200 plus the
missing QAR 1,050 employee share, hence QAR 5,250. Charging only 21% of actual
sick pay would underpay the authority.

```oa-check
name: Qatar reduced sick pay employer contribution adjustment
inputs:
  normal_base: 30000
  paid_base: 15000
  employee_rate: 0.07
  employer_rate: 0.14
steps:
  employee: paid_base * employee_rate
  missing_employee: (normal_base - paid_base) * employee_rate
  employer: normal_base * employer_rate + missing_employee
  total: employee + employer
expected:
  employee: 1050
  missing_employee: 1050
  employer: 5250
  total: 6300
```

## Ask the client first

- What is each worker's nationality, age, coverage decision and home insurance scheme?
- What are the actual basic, social and cash/in-kind housing components, including any legacy above-cap record?
- What are the joining/leaving dates, other jobs and any sick/unpaid leave or secondments?
- Which home-state rates/base and host-state limits apply to each GCC employee?
- What registrations, monthly schedules, payments and authority notices exist?
- Does a service-ending housing settlement, merger or successor liability arise?

Not yet confirmed: none within ordinary employee payroll and GCC coordination.
Optional self-employed income-slice enrolment and pension/benefit computations
require separate current authority decisions and are outside this Guide's scope.
