# Non-resident rental income tax on Kenyan property: a guide for foreign landlords
If you live outside Kenya and earn rent from property you own in Kenya, you now owe non-resident rental income tax. It is a final tax on that rental income, it runs on a monthly cycle tied to the month the rent is paid, and it started on 1 July 2026. This guide explains who it applies to, what you have to do, and the mistakes to avoid.
## Does this apply to you
It applies if you are a non-resident person, whether an individual or a company, earning rent from immovable property situated in Kenya. It does not apply if you are a Kenyan tax resident, in which case a different rental regime covers you. Get professional advice before you act if you are unsure of your residency status, if you hold the property through a company or trust, or if a double tax treaty may exist between Kenya and your country.
## Work out your situation first
- Are you genuinely non-resident for Kenyan tax purposes across the whole period?
- Who collects your rent: you directly, or a Kenyan agent or property manager on your behalf? This changes how the tax is paid.
- Is the property residential or commercial? Commercial letting can bring in other taxes on top of this one.
- Does a double tax treaty exist between Kenya and your country of residence?
- Do you already have a Kenyan PIN or any prior filing history?
- What is your gross rent each month, and are there months with no rent?
## What you need to do
1. Confirm your residency status for the period. Everything below depends on it.
2. Settle how your rent is collected, because that decides how you pay. If you collect the rent directly, you register and file monthly. If a Kenyan agent collects it for you, that agent withholds the tax and remits it, and you may not need to file monthly yourself. Getting this wrong leaves tax unpaid on the other route.
3. Register under the simplified registration framework the Commissioner provides.
4. Work out the tax on your gross rent for the month at the applicable rate (confirm the current rate before you file).
5. File the return and pay by the 20th day of the month following the month the rent was paid.
6. Because it is a final tax, do not declare the same rental income again in any other return.
7. Keep your records and match rent received to the amounts you declare.
## Common mistakes to avoid
- Assuming you can freely switch between filing it yourself and letting your agent withhold. Only one route applies to your situation, and picking wrong leaves a live liability.
- Treating it as an annual return and missing the monthly deadlines.
- Declaring the income a second time elsewhere, forgetting it is a final tax.
- Overlooking a treaty that could change the rate or Kenya's right to tax the income.
- Registering late and running up penalties you could have avoided.
