# Netherlands tax objections and appeals (bezwaar and beroep), 2026

## Who this applies to

This skill covers anyone who disagrees with a decision of the Belastingdienst on a national tax (rijksbelasting): income tax, corporate tax, VAT, wage tax, dividend tax, gift and inheritance tax and the other taxes under the Algemene wet inzake rijksbelastingen (AWR). The general procedure is in the Algemene wet bestuursrecht (Awb), chapters 6 and 7. The AWR changes it for tax.

You can object to:

- a tax assessment (aanslag), an additional assessment (navorderingsaanslag) or a top-up assessment (naheffingsaanslag);
- a decision the law makes open to objection (voor bezwaar vatbare beschikking), such as a fine, belastingrente, or the refusal of an income tax ex officio reduction (Wet IB 2001 art. 9.6(5));
- tax paid on a return (VAT, wage tax, dividend tax) or tax withheld. The payment counts as a decision you can object to (AWR art. 26(2)).

Several assessments can go in one objection letter (AWR art. 24a(1)). A decision printed on the assessment (for example belastingrente) is part of that assessment (AWR art. 24a(2)).

You cannot object to a provisional income tax assessment (voorlopige aanslag). You ask for it to be changed. If the Belastingdienst refuses in whole or part, it issues a deviation decision (afwijkingsbeschikking), and you can object to that.

Out of scope: allowances (toeslagen), local taxes such as WOZ and municipal taxes, customs, criminal tax cases, and a complaint about service (klacht). A complaint does not replace an objection.

## The taxable base

An objection does not change what is taxed. It asks the inspector to recompute the assessment on the right facts and the right law for that year. For each disputed item, set out: what the inspector used, what the taxpayer says it should be, the facts, the rule for that tax year, the evidence, and the amount of the correction.

What the letter must contain (Awb art. 6:5(1)): it is signed, and it gives the name and address of the person objecting, the date, a description of the decision (the assessment or decision number), and the grounds. If grounds are missing, the inspector must give a chance to fix it before declaring the objection inadmissible (Awb art. 6:6). That is the basis for a protective (pro forma) objection: file on time, identify the decision, sign it, and ask for time to give the grounds. The Belastingdienst invites this: "Kunt u uw bezwaar niet binnen die termijn motiveren? Vraag dan in uw bezwaar of u dat later mag doen." Meet the date it sets. The decision clock stops while a defect is being fixed (Awb art. 7:10(2)).

Burden of proof. If the required return was not filed, or an information decision has become final, the assessment stands unless the taxpayer shows that, and by how much, it is wrong (AWR art. 25(3)). This reversed burden does not apply to the part of the objection aimed at a fine for intent or gross negligence (vergrijpboete).

Hearing. In tax, the inspector hears the taxpayer on request (AWR art. 25(1)), not automatically. Ask for a hearing in the letter, and ask to see the file. A hearing can be skipped where the objection is clearly inadmissible or clearly unfounded, the taxpayer waives it, or the objection is granted in full (Awb art. 7:3).

Costs. Professional costs are paid only on request, made before the inspector decides, and only where the decision is reversed because of an error the Belastingdienst is to blame for (Awb art. 7:15(2)-(3)). A correction that follows from facts first supplied during the objection does not qualify. The standard award for professional help is EUR 666. It is not the adviser's full invoice. A change to a provisional assessment is not an objection, so it earns no cost award.

Refund to whom. A refund of withheld or remitted tax after an objection goes to the person who objected. If both the withholding agent and the person withheld from object on the same facts, only the person withheld from gets it (AWR art. 25b).

Mass objections. Where the minister designates a mass objection (aanwijzing massaal bezwaar) on one legal question, the decision period is suspended, there is no hearing, and the inspector decides all of them in one collective decision within 6 weeks of the final court answer. No court appeal lies against the collective decision. The inspector reduces the assessments within 6 months if the taxpayers win (AWR art. 25c-25e). Only timely objections filed before the collective decision are in. Check the Belastingdienst list of current mass objections before drafting an individual one, for example on box 3.

Fill in every placeholder before sending. Do not send this letter to the court after an objection decision; that needs an appeal.

## Deadlines and filing

Objection period. 6 weeks (Awb art. 6:7). For tax it starts the day after the date printed on the assessment or decision, unless that date is before the day it was made known (AWR art. 22j(a)). For tax paid on a return or withheld, it starts the day after the payment, withholding or remittance (AWR art. 22j(b)). The tax year in the document is not its date.

Received in time. The objection must be received before the period ends (Awb art. 6:9(1)). By post, it is in time if posted before the end and received no later than 1 week after (Awb art. 6:9(2)). That is not an extra week to post. Keep proof of posting or the portal receipt. If the last day falls on a Saturday, Sunday or public holiday, the Algemene termijnenwet moves it to the next working day.

Late objection. It is still admissible if the taxpayer cannot reasonably be blamed for the delay (Awb art. 6:11). Record what stopped timely filing, when it ended, and act at once. If that fails, use the ex officio reduction route below.

Where to file. Income tax: online in Mijn Belastingdienst (DigiD or European login), the pdf form Bezwaar particulieren, or a letter. VAT and corporate tax: Mijn Belastingdienst Zakelijk, or a letter. Motor vehicle tax, inheritance and gift tax and some others: the pdf form. VAT paid on a return and refusal of the VAT cash-accounting scheme: by letter. Send a letter to the address on the assessment. The Belastingdienst confirms receipt within 2 weeks (3 weeks for income tax).

Representation. A representative needs authority. A paper authorisation names who acts and for what, and both sign. The Belastingdienst says an intermediary filing through commercial software under its intermediary arrangement needs no separate authorisation for the objection.

Decision. The inspector decides within 6 weeks from the day after the objection period ends, so 12 weeks from the assessment date for a timely objection (Awb art. 7:10(1)). It can extend once by up to 6 weeks (Awb art. 7:10(3)), to 18 weeks. Further delay needs the taxpayer's agreement or another statutory ground (Awb art. 7:10(4)).

Late decision. When the period has passed, send a written default notice (ingebrekestelling). The Belastingdienst form is "Dwangsom bij niet tijdig beslissen", posted to Belastingdienst, t.a.v. Ingebrekestellingenteam, Postbus 4660, 6803 EP Arnhem, with "Dwangsom" on the envelope. From 2 weeks after it is received, a penalty payment runs (Awb art. 4:17(3), applied to objections by Awb art. 7:14). If there is still no decision, the taxpayer can appeal to the court for failure to decide.

Ex officio reduction (ambtshalve vermindering). After the objection period, ask the inspector to reduce an assessment that is too high. For income tax and corporate tax, the request must be received within 5 years after the tax year (income tax 2021: by 31 December 2026). Inheritance tax: 5 years after the death. Gift tax: 5 years after the gift. Other decisions: 5 years after the year the decision covers. After 5 years the Belastingdienst only looks at it if there is a good reason for the delay, and a clearly excessive assessment can go to the collector (ontvanger) for marginal review. For income tax, a refusal of a reduction request is a decision open to objection (Wet IB 2001 art. 9.6(5)). The Belastingdienst decides within 8 weeks. A provisional assessment cannot be reduced this way; change it instead.

Court appeal. 6 weeks, starting the day after the date on the objection decision, unless that date is before it was made known (AWR art. 26c; Awb art. 6:7). The same postal rule applies. File online at rechtspraak.nl ("In (hoger) beroep tegen een beslissing van de overheid", with DigiD) or by letter to the court named in the decision. A taxpayer living abroad files with Rechtbank Midden-Nederland in Utrecht unless the decision names another court. An appeal against the amount of an assessment covers all decisions on it (belastingrente, revisierente, fine). A court fee (griffierecht) is charged once per appeal: EUR 54 for an individual, EUR 200 for an individual where the decision is on dividend tax, VAT, bpm, excise, consumption tax on soft drinks or environmental taxes, and EUR 397 for a company or other non-individual (Awb art. 8:41(2) and Bijlage 3). Pay it within 4 weeks of the registry's notice or the appeal is inadmissible (Awb art. 8:41(5)-(6)). If the inspector concedes in whole or part and the appeal is withdrawn, the inspector refunds it (Awb art. 8:41(7)). A lawyer is not required. After the court, follow the remedy clause in the judgment: a simplified decision may need verzet, a full judgment can go to the court of appeal.

## Penalties and interest

Payment while objecting. For an objection against an assessment, the disputed part gets postponement of payment until the objection decision. The undisputed part must be paid on time. Name the disputed amount and ask for postponement in the letter. Postponement stops enforced collection (Invorderingswet 1990 art. 25(1)).

Invorderingsrente still runs on the postponed amount from the day after the payment due date until payment, at 4.3% from 1 January 2026. The Belastingdienst formula is: days x rate x amount / 36,000, counting a month as 30 days (February 28) and a year as 360, rounded down to whole euros. It is not charged if it comes to EUR 49 or less on the only or last payment. Paying in full on time avoids it. If the taxpayer paid in full and the objection is then granted, the Belastingdienst pays invorderingsrente on the refund.

Belastingrente is a different charge on the assessment itself; its rates are in nl-income-tax and nl-corporate-tax. Object to it as part of the assessment.

For an ex officio reduction request or a court appeal, postponement is not automatic. Ask for it separately by letter, with a copy of the appeal (Belastingdienst, Postbus 100, 6400 AC Heerlen; for bpm and transfer tax, Postbus 2584, 6401 DB Heerlen). Postponement on a reduction request covers only the amount you want reduced and ends with the decision.

Fines. A fine on the same notice is objected to with the assessment. An objection to a fine also covers its publication when both are in one document, unless the letter says otherwise (AWR art. 24a(3)).

Penalty payment owed by the Belastingdienst. EUR 23 a day for the first 14 days, EUR 35 for the next 14, EUR 45 for the rest, for at most 42 days (Awb art. 4:17). The maximum is EUR 1,442. The inspector sets it by decision within 2 weeks after the last day it was due (Awb art. 4:18). No penalty payment is due if the default notice came unreasonably late, the person is not an interested party, or the objection is clearly inadmissible or clearly unfounded (Awb art. 4:17(5)).

## Cross-border points

- Non-residents use the same procedure and deadlines. Notification abroad can be slower, so record the date the assessment arrived; the period still runs from the date on it unless that date is before it was made known (AWR art. 22j).
- By post from abroad, the 1-week postal rule still needs receipt in the Netherlands within that week. File online with European login where the tax allows it.
- A taxpayer living abroad appeals to Rechtbank Midden-Nederland, Utrecht, unless the decision names another court.
- Dividend tax or other tax withheld: both the withholding agent and the person withheld from can object to the withholding. A refund goes to the person withheld from when both object (AWR art. 25b). A treaty refund claim on a separate form follows its own rules (see nl-dividend-withholding).
- Where an assessment breaches EU law and was paid, ask for invorderingsrente within 6 weeks after the Belastingdienst says so.

## Worked examples

**Example 1: objection to part of an income tax assessment, then rejected.** An income tax assessment of EUR 20,000 is dated 1 March 2026 with a due date 6 weeks later. The taxpayer disputes EUR 12,000. They file an objection within 6 weeks, ask for postponement of the disputed EUR 12,000 and pay the undisputed EUR 8,000 on time. The objection is rejected. They pay the EUR 12,000 and it lands 150 days (counted the Belastingdienst way, 30-day months) after the due date. Invorderingsrente: 150 x 4.3 x 12,000 / 36,000 = EUR 215. That is above EUR 49, so it is charged. Paying the EUR 12,000 on time would have avoided it, and a successful objection would then have earned interest on the refund.

```oa-check
name: Partial objection, postponed EUR 12,000 paid 150 days late (2026)
inputs:
  assessment: 20000
  disputed: 12000
  days_late: 150
  rate_pct: 4.3
steps:
  - undisputed_paid_on_time: assessment - disputed
  - interest_raw: days_late * rate_pct * disputed / 36000
  - invorderingsrente: floor(interest_raw)
expected:
  undisputed_paid_on_time: 8000.00
  interest_raw: 215.00
  invorderingsrente: 215.00
```

**Example 2: the Belastingdienst decides late (edge: extension and penalty payment).** A VAT top-up assessment is dated 2 February 2026. The objection is filed in time. The decision is due 6 weeks after the objection period, so 12 weeks after the date. The inspector extends by 6 weeks, to 18 weeks. No decision comes. The taxpayer sends the default notice. 2 weeks after it arrives, the penalty payment starts. The decision comes 20 days later. Penalty: 14 days x EUR 23 = EUR 322, plus 6 days x EUR 35 = EUR 210, total EUR 532. The cap for 42 days would be EUR 1,442.

```oa-check
  - band3: min(max(days_running - 28, 0), 14) * 45
  - dwangsom: band1 + band2 + band3
  - cap: 14 * 23 + 14 * 35 + 14 * 45
## Ask the client first
- Which tax, year and taxpayer, and the exact document or payment disputed (number and date printed on it, or payment date)?
- When did it arrive, and is there proof (envelope, portal message)? Is the 6-week period still open?
- Which items and amounts are disputed, what correction is wanted, and what evidence is there?
- Was the return filed? If not, the taxpayer must prove the assessment is wrong (AWR art. 25(3)).
- Has the disputed amount been paid, postponed or neither?
- Is there a fine, a representative, or an earlier objection or reduction request already?
