# Malawi VAT: current domestic computation and digital-supply boundary v1.3

> **General reference only.** This Guide is general tax/accounting reference material for AI-assisted workflows. It has not been reviewed for any specific person’s facts, documents, elections, deadlines, residency, filing status, or local procedures. Do not rely on it to file, pay, amend, or take a tax position without review by a qualified professional in Malawi.

## Who this applies to

**Current-year source hold.** This is a draft reconstruction of the cited provisions, not confirmed operative 2026 coverage. The enacted [Taxation (Amendment) Act 3 of 2026](https://media.malawilii.org/media/legislation/15519/source_file/2e96ab6e73cdf961/mw-act-2026-3-publication-document.pdf) has now been read in full and its relevant changes are identified in the company, individual and TP drafts. Appointed commencement notices for the Tax Administration Act and the 2021 administrative cutover remain unread; period allocation and the complete operative chain are not approved. Do not use this draft to determine an actual 2026 tax position, file, pay or complete a live registration/notice response until those checks are closed. The examples illustrate the cited-text assumptions only. The 2026 year label identifies the intended research period, not completed verification.

Use for current ordinary domestic taxable transactions after Act 5/2026 applies. It replaces section 11(1) with registration for taxable goods/services or mining-project turnover at or above K50 million per annum. A non-resident digital supplier, intermediary or electronic marketplace operator is registrable whether or not that threshold is met. The digital definitions refer to automated internet/electronic-network services with minimal human intervention and a recipient who is a non-taxable person; do not extend that particular regime to every imported professional service. [Act 5/2026 ss 2,4](https://elibrary.rat.gov.mw/server/api/core/bitstreams/21540b28-6bfd-45b5-a910-b80f13db59b4/content). Earlier 2026 threshold/transition rules require a separate check.

## Rates, bands and thresholds

| Item and condition | Current rule | Official source |
|---|---|---|
| Ordinary taxable supplies | 17.5% standard rate | [VAT 9 amended by Act 37/2025 s 2](https://elibrary.rat.gov.mw/server/api/core/bitstreams/b0ea0034-2169-45bd-9afe-c7321fb17337/content) |
| Ordinary annual taxable business/mining turnover registration | K50,000,000 or more, after Act 5/2026 applies | [Act 5/2026 s 4](https://elibrary.rat.gov.mw/server/api/core/bitstreams/21540b28-6bfd-45b5-a910-b80f13db59b4/content) |
| Nonresident digital supplier/intermediary/marketplace within amended definitions | Registration irrespective of threshold | [Act 5/2026 ss 2,4](https://elibrary.rat.gov.mw/server/api/core/bitstreams/21540b28-6bfd-45b5-a910-b80f13db59b4/content) |
| Monthly return and payment | By 25th of following month | [VAT 34, renumbered 3–4](https://elibrary.rat.gov.mw/server/api/core/bitstreams/90e7cd40-7761-46f6-9b5a-a0e072208879/content); [2021 cutover](https://elibrary.rat.gov.mw/server/api/core/bitstreams/e43a8644-e1e1-46d8-82d7-7e80afd5fd50/content) |
| Refund claim for excess input tax | Six months from relevant period under amended TAA 81(1); not the old twelve-month refund window | [Act 6/2026 s 4](https://elibrary.rat.gov.mw/server/api/core/bitstreams/21540b28-6bfd-45b5-a910-b80f13db59b4/content); [TAA 81](https://elibrary.rat.gov.mw/server/api/core/bitstreams/42eb322b-f2a9-48b9-baaf-01c2ade040f5/content) |

Exemption and zero rating depend on the current statutory schedules and product conditions. Do not use “basic foodstuffs and medicines” as a general zero-rated category. May 2025 replaces First Schedule 9 with ordinary-bread exemption; April 2026 again amends the exemption and zero-rate schedules. This Guide does not give a complete tariff-classification table.

## The base

Compute output VAT on the confirmed taxable consideration for the period, then deduct only eligible input. VAT 30(1) requires wholly/exclusively/necessarily business use and a taxable supply, supported by the compliant tax invoice or import entry. Do not claim an input twice or more than twelve months after deduction accrued; distinguish that deduction timing from the shorter amended refund-claim timing. Exempt-supply input is blocked. Business/personal use must be apportioned; mixed taxable/exempt use needs VAT 32 direct attribution and its apportionment rules, rather than automatic full recovery. [VAT 30–32](https://elibrary.rat.gov.mw/server/api/core/bitstreams/90e7cd40-7761-46f6-9b5a-a0e072208879/content). Exports also require evidence showing export-proceeds deposit into a Malawi financial institution under the 2023 amendment; this working paper does not execute an export refund. [Act 18/2023 s 2](https://elibrary.rat.gov.mw/server/api/core/bitstreams/33eae3f0-090c-4dcc-b47a-cfa2ad663851/content).

Act 5/2026 replaces 30(3): no deduction for exempt-supply purchases/imports or digital-service transactions by a non-resident digital supplier/intermediary/marketplace operator. The simple domestic cases below exclude those supplies, mixed use, restricted vehicle/entertainment input and refund eligibility. Excess credit/refund follows TAA, with the written computation and evidence required by 81; a positive credit is not proof of a payable cash refund. [Act 5/2026 s 8](https://elibrary.rat.gov.mw/server/api/core/bitstreams/21540b28-6bfd-45b5-a910-b80f13db59b4/content); [2021 VAT 31 cutover](https://elibrary.rat.gov.mw/server/api/core/bitstreams/e43a8644-e1e1-46d8-82d7-7e80afd5fd50/content); [TAA 81](https://elibrary.rat.gov.mw/server/api/core/bitstreams/42eb322b-f2a9-48b9-baaf-01c2ade040f5/content).

## Deadlines and filing

Prepare the prescribed monthly VAT return, output transaction schedule, compliant purchase/customs documents, tax point analysis, credit history and any refund workpaper. VAT 34(1) makes the period the calendar month unless directed otherwise;34(3) and(4), after 2021 renumbering, put declaration and payment by the 25th of the next month. TAA 40 governs the prescribed manner and signature, and 38(3) electronic acceptance through a document registration number. Keep that acknowledgement and payment proof. [VAT 34](https://elibrary.rat.gov.mw/server/api/core/bitstreams/90e7cd40-7761-46f6-9b5a-a0e072208879/content); [Act 15/2021 Schedule](https://elibrary.rat.gov.mw/server/api/core/bitstreams/e43a8644-e1e1-46d8-82d7-7e80afd5fd50/content); [TAA 38–40](https://elibrary.rat.gov.mw/server/api/core/bitstreams/42eb322b-f2a9-48b9-baaf-01c2ade040f5/content). Current portal boxes, registration form and electronic-invoice implementation notices remain unverified; the 2024 PartII electronic-invoicing text needs its appointed-date notice before a historical application claim.

## Penalties and interest

Identify late return separately from late payment. Use TAA 87 for late payment and current interest, linked in [company tax](mw-corporate-income-tax.md). Do not lift old VAT Act penalties from the historical consolidation after the 2021 administrative cutover. Invoice/refund-specific sanctions and current currency-point orders require separate checking.

## Cross-border points

Act 5/2026 adds digital supplies to VAT 7(1) and the place rule 26(3): the recipient’s usual residence or establishment controls regardless of contract/payment place. That digital regime is not a generic statement that all imported services use the same procedure. Traditional imported-service reverse charge, B2B exclusions and non-resident registration/payment forms remain outside this current computation. [Act 5/2026 ss 2–3,7–8](https://elibrary.rat.gov.mw/server/api/core/bitstreams/21540b28-6bfd-45b5-a910-b80f13db59b4/content).

## Two worked examples that recompute

Hypothetical current domestic taxable retailer; all stated input VAT is independently established eligible and no excluded/mixed/digital category applies.

```oa-check
name: Ordinary net VAT
inputs:
  tax_exclusive_sales: 10000000
  eligible_input_vat: 700000
steps:
  - output_vat: tax_exclusive_sales * 0.175
  - payable: max(0, output_vat - eligible_input_vat)
expected:
  output_vat: 1750000
  payable: 1050000
```

Second, excess eligible input creates a ledger credit, without asserting refund eligibility.

```oa-check
name: Excess eligible input credit
inputs:
  tax_exclusive_sales: 4000000
  eligible_input_vat: 900000
steps:
  - output_vat: tax_exclusive_sales * 0.175
  - payable: max(0, output_vat - eligible_input_vat)
  - credit: max(0, eligible_input_vat - output_vat)
expected:
  output_vat: 700000
  payable: 0
  credit: 200000
```

**Not yet confirmed:** appointed commencement notices for TAA/cutover and full period allocation; exact April 2026 commencement/registration transition and earlier 2026 threshold; old K25 m threshold and 30-day/voluntary registration conditions not independently established for the earlier period; full zero/exempt tariff schedules, legacy imported-service/reverse-charge scope, appointed electronic-invoicing commencement, operational digital registration, portal fields and refund eligibility. The two MRA December 2025 notices disagree on 30/31 December; no boundary calculation is supplied.
