# Reverse charge VAT in Malta on services received from suppliers abroad

## Scope

This Guide covers customer liability for a taxable service supplied in Malta under article 20(2): the supplier is not established in Malta and not registered under Article 10, and the recipient satisfies the relevant customer condition. Establish the service's place of supply and taxability first. An invoice showing no VAT alone does not establish reverse charge. Eligible suppliers can be in another EU Member State or outside the EU ([VAT Act, arts 2, 20 and Third Schedule](https://legislation.mt/getpdf/6a7d667d73ff6d305c833d20)).

It covers:

- when a service bought from abroad is taxed in Malta (the general business-to-business rule and its main exceptions);
- who must pay the VAT: Article 10 registrants, Article 11 small enterprises, Article 12 registrants and VAT-identified non-taxable legal persons;
- registration under Article 12 for a customer that is not registered under Article 10;
- the rate, the value, and when the tax becomes chargeable;
- how the VAT goes on the return or the notice of payment, and the right to deduct it as input tax;
- penalties and interest that attach to the reverse charge itself.

Figures are for tax year 2026. VAT is charged per transaction and per tax period, so "tax year 2026" means services whose VAT becomes chargeable in calendar 2026. The law is the VAT Act, Chapter 406 of the Laws of Malta, in the consolidated PDF fetched on 4 November 2026 (the amendment header lists Act III and Legal Notice 75 of 2026): [VAT Act, Cap. 406](https://legislation.mt/getpdf/6a7d667d73ff6d305c833d20). Interest is set by [S.L. 406.19](https://legislation.mt/getpdf/632835ddda6f862638d03ac1). A short section near the end covers 2025 periods still being filed.

The authority is the Malta Tax and Customs Administration (MTCA). This skill does not give box numbers for the Article 10 return or the Article 12 notice of payment: they appear only on MTCA's forms. Take them from the live form (check).

Companion Skills: general return preparation (rates on sales, blocked input tax in full, capital goods, recapitulative statements, OSS, late-return penalties) is in the Malta VAT returns Guide (malta-vat-return) and the quarterly return Guide (mt-vat3-quarterly-return-malta). This skill follows the same reading of the Act and stays on the reverse charge.

Not covered: goods (intra-EU acquisitions, imports, distance sales), services a Malta business supplies to customers abroad, and purchases by private individuals.

## Ask the client first

- Which article are you registered under: 10, 11, 12, or none? Send the registration certificate. An Article 11 number has no MT prefix and is not a VAT identification number ([Act, art. 13(3)](https://legislation.mt/getpdf/6a7d667d73ff6d305c833d20)), so an Article 11 person receiving a service for which it is liable under art. 20(2) must also register under Article 12; an exempt service or a hotel abroad is not enough by itself.
- Who is the supplier, where is it established, and does it have any office, branch or VAT registration in Malta? Did that Malta establishment take part in this supply?
- What exactly is the service? Is it tied to land or a building, passenger transport, admission to an event, restaurant or catering, or hire of a car or boat? Is it a service that would be exempt if supplied in Malta (for example insurance or most financial services)?
- Which of your establishments received the service: the Malta business or a branch abroad?
- Does the invoice show foreign VAT, Maltese VAT, or no VAT with the words "Reverse charge"? What is the invoice date, when was the service performed, and have you paid anything in advance?
- What do you sell? Only taxable or exempt-with-credit sales give a full deduction. Exempt-without-credit sales (for example insurance, most financial services, medical care, education, residential letting) mean part or all of the reverse-charged VAT is a cost.

## The method, step by step

1. **Is it a service taxed in Malta?** Under the general rule a service to a taxable person acting as such is supplied where the customer has established its business, or at the customer's fixed establishment that receives it ([Act, Third Schedule Part Two item 2(a)](https://legislation.mt/getpdf/6a7d667d73ff6d305c833d20)). If the Malta business is the recipient and no special rule in the boundary table applies, the place of supply is Malta. If a branch abroad received it, it is not a Malta supply: stop.
2. **Is the supplier outside the reverse charge?** Art. 20(2) applies only where the supplier is not established in Malta and is not registered under Article 10. A supplier with a Malta fixed establishment is treated as not established if that establishment does not intervene in the supply ([Act, art. 20(2) proviso](https://legislation.mt/getpdf/6a7d667d73ff6d305c833d20)). If the supplier is established here, or its Malta establishment made the supply, the supplier charges Maltese VAT in the normal way.
3. **Is the service taxable in Malta?** The reverse charge applies to a "taxable supply", which excludes exempt supplies ([Act, art. 2](https://legislation.mt/getpdf/6a7d667d73ff6d305c833d20)). A service that would be exempt if supplied in Malta (Fifth Schedule) carries no reverse charge.
4. **Is the customer liable?** Use the "Who pays" table below. For a general-rule service, any taxable person established in Malta is liable, registered or not, and so is a VAT-identified non-taxable legal person ([Act, art. 20(2)(b)](https://legislation.mt/getpdf/6a7d667d73ff6d305c833d20)).
5. **Register if needed.** A liable customer that is not registered under Article 10 must apply for Article 12 registration by the date it receives the service ([Act, art. 12(3)](https://legislation.mt/getpdf/6a7d667d73ff6d305c833d20)). There is no threshold for this.
6. **Fix when the VAT is chargeable** (see "When the VAT becomes chargeable") and convert any foreign currency at that date.
7. **Compute the VAT** at the Maltese rate for that service on the taxable value (see "Rate and value").
8. **Give the supplier your Malta VAT number** (the MT-prefixed Article 10 or Article 12 number), so it can invoice without VAT and with the mention "Reverse charge" (Twelfth Schedule). An Article 11 number is not a VAT identification number (art. 13(3)).
9. **Declare and pay.** Article 10: include the VAT as output tax on the return for the period in which it became chargeable. Others: pay under art. 21(3) with a notice of payment under art. 30A.
10. **Deduct if entitled.** Only an Article 10 person deducts, and only to the extent the service is used for supplies that carry a right of deduction; the VAT must be reported as due on the same return ([Act, art. 22 and Tenth Schedule item 2](https://legislation.mt/getpdf/6a7d667d73ff6d305c833d20)).
11. **Keep the invoice and records** for at least six years.

## Who pays the VAT ([Act, arts 11(10), 12(3), 20(2), 21 and 30A](https://legislation.mt/getpdf/6a7d667d73ff6d305c833d20))

The supplier must not be established in Malta and must not be registered under Article 10. The customer must be established in Malta.

| Customer established in Malta | General-rule B2B service (art. 20(2)(b)) | Other services taxed in Malta (art. 20(2)(c)) | How the VAT is paid | Deduction |
| --- | --- | --- | --- | --- |
| Article 10 registrant | Liable | Liable | Output tax on the periodic return (art. 22(1)); paid with the return (art. 21(1)) | Yes, to the extent the service is used for supplies that give credit |
| Article 11 small enterprise | Liable, and must also register under Article 12 (art. 11(10)(b)) | Liable once registered under Article 12 | Under art. 21(3), with a notice of payment (art. 30A) | No. It still charges no VAT on its own sales |
| Article 12 registrant (not Article 10) | Liable | Liable | Under art. 21(3), with a notice of payment (art. 30A) | No |
| Taxable person not registered at all (for example a business making only exempt-without-credit supplies) | Liable, and must register under Article 12 by the date it receives the service (art. 12(3)) | Refer | Under art. 21(3) once registered | No |
| Non-taxable legal person identified for VAT (for example a body registered under Article 12 for acquisitions) | Liable: it is treated as a taxable person for place of supply (Third Schedule Part Two item 1(b)) | Liable | Under art. 21(3), with a notice of payment (art. 30A) | No |
| Non-taxable legal person not identified for VAT, or a private individual | Not liable: the service is supplied where the supplier is established (item 2(b)) | Refer | Nothing in Malta under this skill | No |

Two definitions widen the net ([Act, Third Schedule Part Two item 1](https://legislation.mt/getpdf/6a7d667d73ff6d305c833d20)):

- A taxable person that also carries on non-business activities is treated as a taxable person for all services it receives. A company with both trading and non-economic activities cannot treat a service as bought "privately".
- A non-taxable legal person that is identified for VAT purposes is treated as a taxable person.

"Established" follows art. 2(2): a taxable person is established where it has established its economic activity or has a fixed place of establishment from which it carries on that activity; an individual with neither is established where he has a permanent address or usually resides ([Act, art. 2(2)](https://legislation.mt/getpdf/6a7d667d73ff6d305c833d20)).

## Place of supply: when a service from abroad is taxed in Malta ([Act, Third Schedule Part Two](https://legislation.mt/getpdf/6a7d667d73ff6d305c833d20))

- **General rule (item 2(a)).** A service to a taxable person acting as such is supplied where that person has established its business. If the service is provided to a fixed establishment elsewhere, it is supplied where that fixed establishment is. Typical examples: consultancy, legal and accounting services, software licences and subscriptions, cloud hosting, advertising, commissions, staff supply, and most other business services. This is the case art. 20(2)(b) covers.
- **Special rules** override the general rule. The main ones for services bought by a business: services connected with immovable property are supplied where the property is (item 4); passenger transport where it takes place (item 5(1)); admission to cultural, sporting, educational, entertainment or similar events where the event takes place, unless attendance is virtual (item 6(1)); restaurant and catering where physically carried out (item 7); short-term hire of a means of transport where it is put at the customer's disposal (item 8(1)), with "short-term" meaning not more than thirty days, or ninety days for vessels (item 8(3)).
- **Effect of a special rule.** If the special rule puts the supply outside Malta (for example a hotel in Italy), there is no Maltese VAT and no reverse charge here; the foreign VAT charged is not Maltese input tax. If it puts the supply in Malta and the supplier is not established here (for example a foreign contractor's work on a Malta building), art. 20(2)(c) makes an Article 10 or Article 12 customer, or a VAT-identified non-taxable legal person, liable. Refer those cases (see "When to refuse or refer").
- **Use and enjoyment (item 12).** The Commissioner may treat certain services as supplied outside the EU, or in Malta, according to where they are effectively used and enjoyed. The Act gives this as a power ("may"). Whether and how MTCA applies it to a service is not stated in the Act: check before relying on it.

## Rate and value ([Act, art. 19, Seventh and Eighth Schedules](https://legislation.mt/getpdf/6a7d667d73ff6d305c833d20))

The customer charges itself the Maltese VAT that would apply if the same service were supplied in Malta. Rates for 2026:

| Rate | Where it comes from | Examples of services | Official URL |
| --- | --- | --- | --- |
| 18% | Standard rate: "eighteen per cent of the taxable value of the supply" (art. 19(1)) | Most business services: consultancy, legal, accounting, software, advertising, hosting | https://legislation.mt/getpdf/6a7d667d73ff6d305c833d20 |
| 12% | Eighth Schedule | "Custody and management of securities", credit management by a person other than the grantor | https://legislation.mt/getpdf/6a7d667d73ff6d305c833d20 |
| 7% | Eighth Schedule | "Use of sporting facilities"; accommodation in licensed premises | https://legislation.mt/getpdf/6a7d667d73ff6d305c833d20 |
| 5% | Eighth Schedule | "The supply of electricity"; listed minor repairs | https://legislation.mt/getpdf/6a7d667d73ff6d305c833d20 |
| No VAT | Fifth Schedule (exempt with credit or exempt without credit) | No reverse charge: an exempt supply is not a "taxable supply" (art. 2) | https://legislation.mt/getpdf/6a7d667d73ff6d305c833d20 |

Most services bought from abroad by a business fall under the 18% rate. Check the Eighth Schedule item before using a reduced rate; the skill on Malta VAT returns has the fuller rate table.

**Taxable value.** The value is "the total value of the consideration paid or payable to the supplier ... but excluding the value added tax chargeable under this Act" ([Act, Seventh Schedule item 1](https://legislation.mt/getpdf/6a7d667d73ff6d305c833d20)). It includes other taxes and incidental expenses such as commissions charged by the supplier (item 2) and excludes early-payment discounts and rebates allowed at the time the tax becomes chargeable (item 3). Because the invoice carries no Maltese VAT, the invoiced net amount is normally the value. Foreign VAT is not Maltese input tax. Ask the supplier to correct wrongly charged VAT. Use the evidenced contractual consideration and corrected invoice; the taxable-value treatment of an unrecovered foreign-VAT amount has not been confirmed here and must be resolved before filing.

**Foreign currency.** Convert at "the latest selling rate recorded, at the time the tax becomes chargeable, applied by commercial banks in Malta", or at the latest European Central Bank rate at that time ([Act, Seventh Schedule item 8](https://legislation.mt/getpdf/6a7d667d73ff6d305c833d20)).

## When the VAT becomes chargeable ([Act, Fourth Schedule items 2 and 3](https://legislation.mt/getpdf/6a7d667d73ff6d305c833d20))

- **Chargeable event.** For a service, the chargeable event is "the date when the services are performed" (item 2(1)).
- **Periodic billing.** Where a service gives rise to successive statements of account or payments, it is treated as performed, up to the amount covered, on the last day of each period those statements or payments refer to. A continuous service with no statements or payments during a year is treated as completed at least once a year (item 2(2)).
- **Long reverse-charged services.** Where a service taxed under art. 20(2)(b) runs continuously for more than one year with no statements of account or payments in that period, it is treated as completed at the end of each calendar year until it ends (item 2(3)). So the VAT becomes chargeable on 31 December each year.
- **Advance payments.** The tax becomes chargeable on the earlier of the chargeable event and the date of a payment, to the extent of that payment (item 3). A deposit paid before the service is performed is taxed when paid.
- **Invoice proviso (check).** Item 3 adds that where a tax invoice is issued by the fifteenth day of the month after the chargeable event, the tax becomes chargeable on the invoice date. The Act does not exclude reverse-charged services from this proviso. Where the invoice date and the performance date fall in different tax periods, confirm the period with MTCA before filing (check).

For an Article 10 person, the date fixes which return the VAT goes on. For everyone else it fixes the art. 21(3) payment date together with the invoice date (see "Filing and payment").

## Input tax: who can deduct the reverse-charged VAT ([Act, art. 22 and Tenth Schedule](https://legislation.mt/getpdf/6a7d667d73ff6d305c833d20))

- **Only Article 10.** The input tax credit in art. 22(3) is given to "a person registered under article 10". An Article 11, Article 12-only or non-taxable customer pays the VAT and cannot deduct it. For those customers the reverse charge is a real cost.
- **To the extent of use.** An Article 10 person deducts the VAT to the extent the service is attributable to supplies listed in art. 22(4): taxable supplies, exempt-with-credit supplies, supplies made outside Malta that would be taxable or exempt with credit if made in Malta, and supplies taxed outside Malta that would have been exempt without credit if made in Malta. Art. 22(4) also lists certain insurance and financial transactions (read the paragraph before relying on it).
- **Condition: report it as due.** No amount is input tax unless, "with respect to any tax on a supply which in terms of this Act is payable by that person", the person "has reported that tax as due by him in his tax return" (Tenth Schedule item 2(2)(b)). The supplier's tax invoice must also be held and produced on request (item 2(2)(a) and (c)). Claiming the deduction without declaring the output tax is not allowed.
- **Blocked items.** The Tenth Schedule item 3 blocks apply to reverse-charged services as to any other: services to repair, maintain or keep a motor vehicle, vessel or aircraft (with the listed exceptions), hire or leasing of such vehicles, and services used for receptions, entertainment or hospitality or for staff transport or entertainment (with the listed exceptions). The VAT is still declared as output tax; only the deduction is refused. The Malta VAT returns Guide lists the exceptions.
- **Partial exemption.** If the service is used for both deductible and exempt-without-credit supplies, only the deductible share is credited, under the pro-rata rules. Refer the calculation.
- **Net effect.** For a fully taxable Article 10 business the output tax and the input tax cancel, so the net payable is nil. The entry is still mandatory: the declaration is a condition for the deduction.

## Boundary and exception table

| Situation | Treatment |
| --- | --- |
| Supplier established abroad, no Malta establishment, not registered under Article 10; general-rule service to Malta business | Reverse charge under art. 20(2)(b) |
| Supplier established outside the EU (for example the US or the UK) | Same as an EU supplier: the test is "not established in Malta" (art. 20(2)) |
| Supplier has a Malta fixed establishment that did not intervene in the supply | Supplier treated as not established; reverse charge applies (art. 20(2) proviso) |
| Supplier's Malta establishment made the supply, or supplier established in Malta | No reverse charge; supplier charges Maltese VAT |
| Foreign supplier registered in Malta under Article 10 | Art. 20(2) as written does not apply, so the supplier should charge Maltese VAT. Refer if the invoice shows no VAT |
| Service received by the customer's fixed establishment abroad | Supplied where that establishment is (item 2(a)); not a Malta supply |
| Service would be exempt if supplied in Malta (for example insurance, most financial services) | Not a taxable supply; no reverse charge (art. 2, Fifth Schedule) |
| Service connected with land outside Malta, hotel abroad, meals abroad, event admission abroad | Supplied abroad (items 4, 6(1), 7); foreign VAT is not Maltese input tax |
| Service connected with land in Malta, from a supplier not established here | Taxed in Malta; customer liable under art. 20(2)(c) only if registered under Article 10 or 12 or a VAT-identified non-taxable legal person. Refer |
| Short-term hire of a car put at the customer's disposal abroad | Supplied abroad (item 8(1)) |
| Article 11 person buys a general-rule service | Liable; must also register under Article 12 (art. 11(10)(b)); pays, cannot deduct |
| Business making only exempt-without-credit supplies, not registered | Liable; must register under Article 12 by the date of the service (art. 12(3)); pays, cannot deduct |
| Non-taxable legal person not identified for VAT | Treated as a non-taxable person; supplier's place applies (item 2(b)); no Malta reverse charge |
| Taxable person with some non-business activity | Treated as taxable for all services received (item 1(a)); reverse charge applies |
| Invoice shows foreign VAT on a general-rule service | Supplier has not applied the reverse charge. The foreign VAT is not Maltese input tax. Ask for a corrected invoice, and account for the Maltese VAT in any case |
| Continuous service, no invoices or payments for over a year | Chargeable at the end of each calendar year (Fourth Schedule item 2(3)) |

## Worked cases ([VAT Act, Cap. 406](https://legislation.mt/getpdf/6a7d667d73ff6d305c833d20))

All cases use the [VAT Act](https://legislation.mt/getpdf/6a7d667d73ff6d305c833d20) as in force in 2026. Amounts are hypothetical.

**Case 1: Article 10 company buys consultancy from Germany.** A Malta company registered under Article 10 makes only taxable sales. Its tax period is January to March 2026. A German consultancy with no Malta establishment performs work in March and invoices €4,000 on 20 March 2026, with no VAT and the words "Reverse charge". Place of supply is Malta (Third Schedule Part Two item 2(a)); the company is liable (art. 20(2)(b)). Output tax: €4,000 at 18% = €720, on the January to March return. Input tax: €720, on the same return. Net payable on this purchase: nil. The return is due by 15 May 2026, the fifteenth day of the second month after March (art. 27(1)).

**Case 2: Article 11 designer buys a software subscription from the US.** A graphic designer registered under Article 11 buys a software subscription from a US company with no Malta establishment. The supplier invoices €600 on 5 February 2026, with no VAT. The designer is a taxable person receiving a general-rule service, so it is liable (art. 20(2)(b)) and must also register under Article 12 (art. 11(10)(b)), applying by 5 February 2026, the date it receives the service (art. 12(3)). VAT: €600 at 18% = €108, payable by 15 April 2026 (the fifteenth day of the second month after February, art. 21(3)), with a notice of payment (art. 30A). It cannot deduct the €108, and it still charges no VAT on its own sales.

**Case 3: exempt insurer buys IT consultancy from the UK.** A Malta insurance company makes only exempt-without-credit supplies and is not registered under Article 10. A UK consultancy with no Malta establishment invoices €10,000 on 12 June 2026 for IT work, no VAT. The insurer is a taxable person, so it is liable (art. 20(2)(b)) and must register under Article 12 by 12 June 2026 (art. 12(3)). VAT: €10,000 at 18% = €1,800, payable by 17 August 2026: the art. 21(3) baseline of 15 August falls on a Saturday/public holiday and shifts under art. 73(5). No deduction: the €1,800 is a cost.

**Case 4: late Article 12 registration, payment and notice.** An Article 11 person receives a general-rule service from a French supplier on 10 January 2026 and is invoiced €2,000 that day, no VAT. The receipt date is 10 January 2026; because that is Saturday, its application deadline shifts to 12 January 2026 under art. 73(5). It applies on 20 April 2026 and pays the VAT the same day with the notice of payment.

- VAT: €2,000 at 18% = €360, due by 16 March 2026: 15 March is Sunday, so art. 73(5) shifts the date.
- Late registration (art. 39(2)): 12 January to 20 April is three months and part of a fourth, so four months. Reading the penalty as the higher of 1% of the VAT and €20 for each month, as the Malta VAT returns Guide does: 1% of €360 is €3.60, less than €20, so €20 a month for four months = €80. The VAT (€360) is €2,000 or less, so the €250 cap applies and is not reached.
- Interest (art. 21(4), [S.L. 406.19](https://legislation.mt/getpdf/632835ddda6f862638d03ac1)): 0.6% for each month or part month unpaid. 16 March to 20 April is one month and part of a second, so two months: €360 x 0.6% = €2.16 a month, €4.32 in total.
- Late notice of payment (art. 38(2)(a)), a reading (check): art. 30A binds "a person registered under article 12", and this person was not registered until 20 April 2026, so the Act does not settle whether a notice was late before registration. If the penalty runs from the shifted 16 March 2026 deadline: €10 for each month or part month, two months = €20, below the €120 cap. Confirm with MTCA before quoting it.

**Case 5: hotel in Italy for staff.** An Article 10 company pays an Italian hotel for staff accommodation during a trade fair in Milan. The hotel charges Italian VAT. Accommodation is a service connected with immovable property and is supplied where the property is (Third Schedule Part Two item 4). There is no Maltese VAT, no reverse charge, and the Italian VAT is not Maltese input tax. Any recovery goes through Italy's refund procedure.

**Case 6: German supplier charges German VAT by mistake.** An Article 10 company receives a general-rule marketing service from a German agency, which charges German VAT. The place of supply is still Malta and the company is still liable for the Maltese VAT (art. 20(2)(b)). It requests a credit for the German VAT, establishes the correct contractual consideration and accounts for Maltese output tax and the legally allowed input deduction. An unrecovered foreign-VAT amount is not assumed to have a verified taxable-value treatment. The German VAT is not Maltese input tax.

## When to refuse or refer

- Goods: intra-EU acquisitions, imports, distance sales and supplies of goods under art. 20(2)(a). They follow different rules; use the Malta VAT returns Guide.
- Services the client supplies to customers abroad (the mirror case), recapitulative statements and OSS: use the Malta VAT returns Guide.
- Services taxed in Malta under a special rule and supplied by a non-established supplier (for example work on a Malta building, admission to a Malta event): art. 20(2)(c) liability depends on the customer's registration. Refer.
- A foreign supplier registered in Malta under Article 10 that invoices without Maltese VAT: art. 20(2) as written does not apply. Refer before accounting either way.
- Doubt about where the supplier or the customer is established, or which establishment received the service (fixed establishment questions).
- Any reliance on the use-and-enjoyment power in Third Schedule Part Two item 12.
- Partial exemption: services used for both deductible and exempt-without-credit supplies.
- An invoice-date and performance-date mismatch across tax periods (the invoice proviso in Fourth Schedule item 3).
- Corrections of earlier periods, assessments, objections and appeals.
- Recovery of foreign VAT charged by a supplier in another State.
- Private individuals. A service bought for private use is generally supplied where the supplier is established (Third Schedule Part Two item 2(b)). Telecommunications, broadcasting and electronically supplied services to a non-taxable person are supplied where that person lives (item 10, subject to the small-supplier exception in item 10(2)), but an individual is never liable under art. 20(2): the supplier pays (art. 20(1)(a)). There is no reverse charge for the individual.

## Filing and payment ([Act, arts 21, 27, 30A, 37-39](https://legislation.mt/getpdf/6a7d667d73ff6d305c833d20))

| Article 10 | The periodic tax return, with the reverse-charged VAT as output tax and, where deductible, as input tax | By the fifteenth day of the second month after the month in which the tax period ends (art. 27(1)) | Net amount by the same date (art. 21(1)) |
| Article 12, including an Article 11 person also registered under Article 12, and a VAT-identified non-taxable legal person | A notice of payment for purchases where the customer is liable under art. 20(2)(b) and (c) (art. 30A, art. 21(5)) | With the payment | By the fifteenth day of the second month after the invoice date or the month the service is received, whichever is earlier (art. 21(3)) |

- **Calendar adjustment.** Statutory filing, registration-application and payment dates falling on Saturday, Sunday, a national day or public holiday move to the first following working day other than Saturday ([art. 73(5)](https://legislation.mt/getpdf/6a7d667d73ff6d305c833d20)). The public-holiday list is in [Cap. 252](https://legislation.mt/eli/cap/252/eng/pdf).
- **Box numbers (check).** The Act does not say which box of the Article 10 return or of the notice of payment carries reverse-charged services. Take them from the live MTCA form. MTCA's own filing calendar should also be checked against the statutory dates above.
- **Electronic filing relief.** No interest is due where an Article 10 return is filed electronically with payment not later than seven days after the tax became payable (art. 21(4A)). Late-return penalties are in the Malta VAT returns Guide.
- **Interest.** Unpaid VAT carries interest at 0.6% for each month or part month ([S.L. 406.19, reg. 2](https://legislation.mt/getpdf/632835ddda6f862638d03ac1); Act, art. 21(4)). Balances that became payable before 1 September 2022 keep the old rate of 0.33%.

### Penalties specific to the reverse charge ([Act, arts 37, 37A, 38 and 39](https://legislation.mt/getpdf/6a7d667d73ff6d305c833d20))

| Default | Penalty |
| --- | --- |
| Late application for Article 12 registration (art. 39(2)) | The higher of 1% of the VAT on the services received and €20, for every month or part month from the date the application was due until it is made or the Commissioner registers the person. Cap: €250 where that VAT is €2,000 or less; 20% of that VAT where it is more than €2,000 |
| Late notice of payment under art. 30A (art. 38(2)(a)) | €10 for every month or part month, maximum €120 per notice |
| Notice of payment by an Article 12 person understates the tax payable under art. 21(2) or (3), or the Commissioner assesses that person's tax under art. 33(2) (art. 37A) | 20% of the understated tax or the assessed tax |
| Article 10 return understates output tax or overstates deductions (art. 37(1)) | 20% of the understatement or overstatement; 10% if corrected under art. 28(1) before a provisional assessment (art. 37(2)) |

For a fully taxable Article 10 business, leaving out a reverse charge often has no net tax effect, but the output tax is still understated. Because deduction depends on declaring the tax (Tenth Schedule item 2(2)(b)), correct both sides together.

### Cancelling Article 12 registration

A person registered under Article 12 because it receives reverse-charged services may apply to cancel at any time once it no longer receives such services (art. 12(8)). The cancellation takes effect on 1 January of the year in which the application is made (art. 12(10)(b)). If the person later registers under Article 10, the Commissioner cancels the Article 12 registration from the effective date of the Article 10 registration (art. 12(10)(a)). Where the Article 12 registration also rests on intra-EU acquisitions or on services supplied abroad, the cancellation rules for those grounds apply as well.

## Records ([Act, art. 48 and Eleventh Schedule](https://legislation.mt/getpdf/6a7d667d73ff6d305c833d20))

- **Article 10 person:** keep the VAT account and all tax invoices received (Eleventh Schedule item 1), including the supplier's reverse-charge invoice and the working showing the rate, value, exchange rate and chargeable date.
- **Anyone not registered under Article 10, and any VAT-identified non-taxable legal person:** keep records detailed enough to determine the value of purchases made under art. 20(2), including a description of the services and the consideration paid, the invoices, and other supporting documents (Eleventh Schedule item 9).
- **Retention:** at least six years from the end of the year to which the records relate. If a return is filed late or corrected under art. 28(1), the six years run from the filing or correction request (art. 48(4)).
- **The supplier's invoice** should carry the mention "Reverse charge" where the customer is liable (Twelfth Schedule). A missing mention does not change who is liable, but ask for a corrected invoice.

## Returns being filed now for 2025 ([S.L. 406.19](https://legislation.mt/getpdf/632835ddda6f862638d03ac1))

The Act as in force from 1 January 2025 ([VAT Act as at 1 January 2025](https://legislation.mt/getpdf/6811d40a495e132a18426aea)) already contained the same rules used above: Article 12 registration by the date a reverse-charged service is received (art. 12(3)), payment by the fifteenth day of the second month after the invoice date or month of receipt, whichever is earlier (art. 21(3)), the notice of payment (art. 30A), and the 18% standard rate. So:

- An Article 10 return for a tax period ending in December 2025 (for example October to December 2025) had a baseline of 15 February 2026, shifted to 16 February 2026 under art. 73(5), and includes reverse-charged services whose VAT became chargeable in that period. Tax periods are set per registration, so check the client's own dates.
- Article 12 VAT on a service invoiced in December 2025 had a baseline of 15 February 2026, shifted to 16 February 2026 because the 15th was Sunday (art. 73(5)).
- Unpaid 2025 amounts carry interest at 0.6% for each month or part month.

## Completion checklist ([VAT Act, Cap. 406](https://legislation.mt/getpdf/6a7d667d73ff6d305c833d20))

- Registration article confirmed from the certificate; Article 11 persons buying services from abroad also hold an Article 12 registration.
- Supplier's establishment checked: not established in Malta, no intervening Malta establishment, not registered under Article 10.
- Service classified: general rule (item 2(a)) or a special rule; received by the Malta establishment.
- Service is not exempt if supplied in Malta.
- Rate checked: 18% unless an Eighth Schedule item applies.
- Value is the net consideration; foreign currency converted at the Maltese bank selling rate or the ECB rate on the chargeable date.
- Chargeable date fixed: performance, advance payment, periodic billing or calendar-year end for long continuous services.
- Article 10: VAT in output tax on the right return; deduction only to the extent of deductible use and not a blocked item.
- Others: VAT paid under art. 21(3) with the notice of payment; no deduction taken.
- Box numbers taken from the live MTCA form.
- Supplier invoice held; records kept for at least six years.

## Two worked examples that recompute

Assume the supplier/recipient, taxable Malta general-rule service, 18% rate and evidenced consideration tests above are met. Case A is an Article 10 recipient with wholly deductible use. Case B is an Article 11/12 recipient with no input-credit entitlement ([Act, arts 19-23 and Tenth Schedule](https://legislation.mt/getpdf/6a7d667d73ff6d305c833d20)).

```oa-check
name: Fully deductible Article 10 service reverse charge
inputs:
  consideration: 4000
  rate: 0.18
steps:
  - output_tax: consideration * rate
  - input_credit: output_tax
  - net_payable: output_tax - input_credit
expected:
  output_tax: 720
  input_credit: 720
  net_payable: 0
```

```oa-check
name: Article 11 and 12 service has no input deduction
inputs:
  consideration: 600
  rate: 0.18
steps:
  - output_tax: consideration * rate
  - input_credit: 0
  - net_payable: output_tax - input_credit
expected:
  output_tax: 108
  input_credit: 0
  net_payable: 108
```
