# Reverse charge on intra-EU acquisitions in Malta
## Reverse charge on intra-EU acquisitions in Malta
For EU goods, first establish a taxable intra-Community acquisition in Malta. For services, establish a taxable supply in Malta for which the recipient is liable under article 20(2). The supplier's EU address or an invoice without VAT is not enough. The Article 12 registration trigger and payment rules differ for goods and services ([VAT Act, arts 12, 20-21 and Third/Fourth Schedules](https://legislation.mt/getpdf/6a7d667d73ff6d305c833d20)). Figures cover calendar 2026; the sources below were read on 4 November 2026.
## Who this is for
This Guide is for a taxable person established in Malta : including a self-employed individual : who acquires goods or services from a supplier established in another EU Member State.
Self-employed individuals that are required to register under Article 12 are those which are not registered under Article 10 and who make intra-community acquisitions of goods in Malta whereby the value of such acquisition/s exceeds the threshold in the table below in a calendar year.
It also covers acquisitions of services:
unlike goods acquisitions, there is no monetary threshold for a service for which the Malta recipient is liable under article 20(2). First determine Malta place of supply, taxability and the supplier/recipient conditions. A hotel in another Member State or an exempt service does not trigger Malta reverse charge solely because it was purchased from abroad.
Unless already registered for VAT purposes under article 10, that person would be required to register for VAT purposes under article 12 of the VAT Act and self-charge VAT on the acquisition of such services.
It is not for private individuals who are not taxable persons, and it is not for persons already registered under Article 10, who account for the same acquisitions through their ordinary VAT return rather than through an Article 12 registration.
A point that decides the registration route:
there is no mechanism for the recovery of VAT by article 12 registered persons, therefore where the person has a right to recover the input VAT which is required to be self-charged on the acquisition, that person should consider registration in terms of article 10
.

**Article 12 dates:** for a taxable goods acquisition, pay by the 15th of the month following chargeability under arts 20(1)(b) and 21(2). Fourth Schedule item 6 makes acquisition VAT chargeable on the earlier of the supplier tax-invoice date and the 15th of the month after acquisition. For a service payable under art. 20(2), use art. 21(3): the 15th of the second month following the invoice date or month of receipt, whichever is earlier. Furnish the notice of payment under arts 21(5)/30A. Statutory dates falling on Saturday, Sunday, a national day or public holiday shift under art. 73(5). The actual separate declaration fields/portal mapping remain unverified ([Act](https://legislation.mt/getpdf/6a7d667d73ff6d305c833d20)).
## The method, step by step
1. Establish whether the client is already registered under Article 10. If so, the intra-Community acquisition is self-charged and reported through the ordinary VAT return cycle rather than through an Article 12 registration : see the MTCA VAT return cycle page, https://mtca.gov.mt/personal-tax/self-employed/vat-return-cycle.
2. If the client is not registered under Article 10, test the acquisition against the trigger in the tables above: for goods, the taxable acquisition and calendar-year value test; for services, the article 20(2) liability conditions with no monetary threshold. Both tests are set out at https://mtca.gov.mt/personal-tax/self-employed/registration and in the Registrations & De-Registrations FAQs, https://mtca.gov.mt/docs/default-source/documents/registrations-and-de-registrations-faqs.pdf?sfvrsn=908511fc_1.
3. Before registering under Article 12, check whether the client would have a right to recover the input VAT being self-charged.
There is no mechanism for the recovery of VAT by article 12 registered persons
, so where recovery matters the client should consider Article 10 registration instead : https://mtca.gov.mt/docs/default-source/documents/registrations-and-de-registrations-faqs.pdf?sfvrsn=908511fc_1.
4. Apply for the registration through the MTCA online services.
A Maltese e-ID is generally required to access the MTCA online services.
Registration information for self-employed persons is at https://mtca.gov.mt/personal-tax/self-employed/registration.
5. Determine the Maltese rate to self-charge on the acquisition using the VAT rates page, https://mtca.gov.mt/business-tax/vat1/vat-compliance/vat-rates/vat-rates.
Unless a reduced rate or exemption specifically applies, the standard rate applies to any taxable supply within the scope of VAT taking place in Malta.
6. Declare and pay the self-charged VAT to the MTCA. For Article 10 sole proprietors filing online, the submission and payment extension in the table above applies : https://mtca.gov.mt/personal-tax/self-employed/vat-return-cycle. For Article 12 persons, use the separate goods/service payment rules above and the notice of payment. Do not use the Article 10 electronic window for an Article 12 payment. Obtain the actual annual declaration fields and applicable submission instruction before preparing that declaration.
7. If the client also makes intra-Community supplies to VAT-registered customers in other Member States, file the Recapitulative Statement by the date in the table above : MTCA tax calendar, https://mtca.gov.mt/home.
## Ask the client first
- Is the client already registered under Article 10, Article 11 or Article 12, and what is the registration number format?
- Is the acquisition goods or services? The threshold applies only to goods; services have none.
- What is the cumulative value of intra-Community acquisitions of goods so far in this calendar year, and does the current purchase push it over the threshold?
- Would the VAT that has to be self-charged be recoverable as input VAT if the client were registered under Article 10?
- Is the client a taxable person established in Malta, and is the supplier established in another EU Member State?
- Does the item acquired fall under a reduced rate or an exemption rather than the standard rate?
## When to refuse or refer
- Acquisitions from outside the EU (importations) : these are not intra-Community acquisitions and are not covered here.
- Distance sales, OSS and IOSS registrations and the separate thresholds attaching to them.
- New means of transport and excise goods, where the ordinary acquisition threshold does not operate in the normal way.
- Triangulation, call-off stock and chain transactions involving three or more Member States.
- Article 11 small undertaking clients whose registration status may change as a result of the acquisition.
- The authenticated annual Article 12 declaration fields and any separately directed declaration period/date; the goods/service VAT payment dates above are established, but portal mapping and a disputed late-penalty assessment need separate evidence.
- Whether a specific reduced rate item applies to the acquisition, which requires the relevant Schedule to the VAT Act rather than the summary rate page.
## Two worked examples that recompute
**Goods:** assume an Article 11 shop has EUR 9,000 of relevant acquisitions before a EUR 2,000 taxable acquisition of standard-rated goods on 20 March 2026. The qualifying acquisition crosses EUR 10,000; Article 12 application is due by that acquisition date. Assume the tax invoice is issued the same day: chargeability is 20 March and payment is due 15 April 2026. VAT is charged on the qualifying acquisition, not just the EUR 1,000 excess ([Act, arts 12(1), 19(3), 20(1)(b), 21(2); Fourth Schedule item 6](https://legislation.mt/getpdf/6a7d667d73ff6d305c833d20)). Supplier exemption and special-goods exclusions have been tested before this example.
```oa-check
name: Taxable goods acquisition crossing Article 12 threshold
inputs:
earlier_acquisitions: 9000
current_acquisition: 2000
threshold: 10000
rate: 0.18
steps:
- cumulative_acquisitions: earlier_acquisitions + current_acquisition
- excess_over_threshold: cumulative_acquisitions - threshold
- vat_on_current_acquisition: current_acquisition * rate
expected:
cumulative_acquisitions: 11000
excess_over_threshold: 1000
vat_on_current_acquisition: 360
```
**Service:** assume an Article 11 designer receives a taxable general-rule service in Malta from an EU supplier not established in Malta and not registered under Article 10. Receipt and invoice are 5 February 2026; consideration EUR 600. Article 12 has no monetary threshold for this liability, payment is due 15 April 2026 and there is no input deduction ([Act, arts 12(3), 19-23](https://legislation.mt/getpdf/6a7d667d73ff6d305c833d20)).
```oa-check
name: Taxable foreign service to Article 11 and 12 recipient
inputs:
consideration: 600
rate: 0.18
steps:
- vat_due: consideration * rate
- input_credit: 0
- payable: vat_due - input_credit
expected:
vat_due: 108
input_credit: 0
payable: 108
```
