# Saint Lucia VAT on imported services
## Scope
Source-cited draft checked 22 October 2026. Start by determining whether the transaction is a taxable import of services. A foreign supplier invoice alone does not answer the exemption, value, time or recipient-use questions. The cited law is the Attorney General Chambers Revised Laws (2023), pending a later-amendment audit.
## Recipient liability
[Section 9(2)(c)](https://attorneygeneralchambers.com/laws-of-saint-lucia/value-added-tax-act/section-9) places import-of-services VAT on the recipient. [Section 28(3)–(4)](https://attorneygeneralchambers.com/laws-of-saint-lucia/value-added-tax-act/section-28) addresses overseas businesses supplying persons or local branches in Saint Lucia. It expressly reaches nonregistered recipients below the ordinary registration threshold or not making taxable supplies. A local branch/affiliate is treated separately from its nonresident home office for this purpose.
For registered recipients, section 28 addresses imports not used in making taxable supplies. Therefore, neither “we are below the VAT threshold” nor “we are VAT registered” is a sufficient answer. Establish actual use, including mixed taxable/exempt activities, before deciding treatment.
## Declaration and timing
Where import tax is payable, [section 28(1)–(2)](https://attorneygeneralchambers.com/laws-of-saint-lucia/value-added-tax-act/section-28), subject to its section 4(12) exception, requires an approved import declaration and payment within 21 calendar days after the tax period in which import occurred.
[Section 26](https://attorneygeneralchambers.com/laws-of-saint-lucia/value-added-tax-act/section-26) determines import timing by applying section 18 as though the import were a supply of services. Do not automatically use the bank-payment date as the tax point. Review the contract, invoice, service period and relevant section 18 rule before choosing the return period.
## Conditional calculation
Assume an overseas service has been established as taxable at the standard rate, its value excluding VAT is EC$10,000, and the recipient is liable under the above provisions. At the [section 10](https://attorneygeneralchambers.com/laws-of-saint-lucia/value-added-tax-act/section-10) rate of 12.5%, VAT is EC$1,250. This example assumes the taxable value; it does not determine valuation for related parties or VAT-inclusive contracts.
An illustrative nonregistered business cannot conclude that no import VAT is due merely because its own turnover is EC$200,000. The import rules require their own review. Do not assume a matching input credit without establishing entitlement.
## Evidence and exclusions
Keep the contract, supplier identity/location, description of services, recipient-use analysis, valuation calculation, tax-point decision, declaration and payment receipt together. Separate withholding-tax and treaty questions from VAT: this Guide determines neither.
Review zero-rating/exemptions, section 4(12), mixed-use treatment, taxable value, input deductions and current submission instructions before filing. The IRD imported-services brochure was located but returned 404 directly; no successful capture is claimed. Independent review remains outstanding, and this is not a complete cross-border tax pack.
