# Saint Lucia first-time landowner interest deduction
## Source and timing
Source-cited draft checked 22 October 2026. Section 3 of [Income Tax (Amendment) (No. 2) Act 10 of 2026](https://npc.govt.lc/laws/download/UjVlcXRvZTd3RG93ODVaQ0tsbWNwY3BZUU5uNEVJM3lpam1HV0lqRS9SRUNzTmp6YisvZFBmQTR2RUw1MFprRHJYRytQRkJMOUo0c0tWQ0YwY2ZoUzJNRUNWSVhnWjEvSll1MW9DSnBIUndsMTNkTDFVOWN0UHpZRk9XZmxhdWg=) inserts section 59D. The Act bears an assent date of 16 July 2026 and a bracketed date of 21 July 2026. The qualifying deed rule expressly reaches registrations **from 2 May 2026**. Do not substitute the Act's July date for that deed-registration test.
## Eligibility sequence
Under section 59D, establish all of these facts:
1. The claimant is a resident individual.
2. The claimant has never previously held a legal interest, solely or jointly, in residential land in Saint Lucia.
3. The acquired Saint Lucia parcel is intended for residential purposes and is no larger than **22,000 square feet**.
4. Its deed is registered at the Registry of Land from **2 May 2026**.
5. Money borrowed by the claimant was used to purchase the land, and the claimed amount is interest paid during the income year.
The deduction is **50% of that qualifying paid interest** and is excluded from the EC$40,000 aggregate cap in section 44(4)(a). [Act 10, section 3, printed page 138](https://npc.govt.lc/laws/download/UjVlcXRvZTd3RG93ODVaQ0tsbWNwY3BZUU5uNEVJM3lpam1HV0lqRS9SRUNzTmp6YisvZFBmQTR2RUw1MFprRHJYRytQRkJMOUo0c0tWQ0YwY2ZoUzJNRUNWSVhnWjEvSll1MW9DSnBIUndsMTNkTDFVOWN0UHpZRk9XZmxhdWg=). Loan principal and the purchase price are not interest. A previous jointly held residential-land interest fails the statutory first-time definition even if this purchase is the claimant's first sole ownership.
## Worked example and boundaries
Assume a resident individual with no previous residential-land interest purchases an eligible 20,000-square-foot parcel, registers the deed on 10 May 2026, and pays EC$12,000 qualifying loan interest during the income year. The deduction is 12,000 × 50% = **EC$6,000**. It sits outside the aggregate 40,000 cap; it is not an EC$6,000 reduction in tax itself.
A parcel of exactly 22,000 square feet meets the size boundary; 22,001 does not. A deed registered on 1 May 2026 fails the stated registration-date condition. These examples test only the named conditions and do not replace the other eligibility checks.
## Evidence and return preparation
Retain the registered deed, parcel survey, prior-title evidence, loan agreement, trace of loan use and lender statement separating interest paid from principal. Record residential intent and residence evidence. Reconcile this claim separately from owner-occupied dwelling-house deductions and avoid claiming the same expenditure twice without a legal basis.
Joint purchasers, refinanced loans, mixed-use borrowing, pre-registration interest and insufficient assessable income require review of the full Act and the facts. Section 59D does not supply a special credit or a transfer-tax exemption. Current filing mechanics and independent accountant review remain outstanding.
