# Kuwait VAT / GST v0.3
Tax year 2026.
> **General reference only.** This skill is general tax/accounting reference material for AI-assisted workflows. It has not been reviewed for any specific person's facts, documents, elections, deadlines, residency, filing status, or local procedures. Do not rely on it to file, pay, amend, or take a tax position without review by a qualified professional in the relevant jurisdiction.
## Who this applies to
Businesses reviewing a Kuwait indirect-tax question. The MOF laws, decree-laws and resolutions lists below were read. No VAT or excise enactment was identified in those lists, but absence from an index is not affirmative evidence that no tax applies. Do not classify a transaction as exempt, zero-rated or outside scope from that finding.
## Rates, bands and thresholds
| Item | Figure and conditions | Tax year | Official URL |
|---|---|---|---|
| VAT, GST and excise status | unverified: NON-OPERATIVE HOLD. MOF title searches did not establish current legal status | 2026 | https://www.mof.gov.kw/MOFDesicions/mofDesicions1.aspx |
| Rate, registration threshold and return frequency | unverified: no current rule established. Do not adopt a GCC framework percentage as Kuwait law | 2026 | unverified |
| Reverse charge, input recovery and invoice requirements | unverified: no current Kuwait procedure established | 2026 | unverified |
| Customs duty | unverified: rate, tariff classification and exemptions require current customs evidence | 2026 | unverified |
## The base
No taxable base or recovery right is established by this Guide. Separate net price, any separately invoiced foreign tax and gross amount. Foreign VAT is not automatically an irrecoverable cost: establish the relevant foreign refund or deduction right before final classification.
## Deadlines and filing
Do not initiate or omit a registration, return or payment on the strength of the old no-VAT statement. Obtain the current enacted text or affirmative competent-authority statement and the transaction facts, then record the applicable filing procedure and due date. The present Guide does not provide that procedure.
## Penalties and interest
Unverified. Do not infer that penalties are absent because no enactment was identified in the index.
## Cross-border points
A foreign supplier's home-state VAT treatment, Kuwait treatment of imported goods or digital services, and any foreign refund right need separate determination. For Kuwait-source corporate income use [corporate income tax](kw-corporate-income-tax.md); this Guide does not supply a permanent-establishment test.
## Two worked examples that recompute
**Example 1.** A foreign supplier's invoice states KWD 1,000 net and KWD 200 foreign tax. The gross invoice is KWD 1,200. Record those components for review; the arithmetic does not establish that KWD 200 is deductible, refundable or a final cost.
```oa-check
name: Reconcile foreign invoice without assuming recoverability
inputs:
net_price: 1000
invoiced_foreign_tax: 200
steps:
- invoice_total: net_price + invoiced_foreign_tax
expected:
invoice_total: 1200.00
```
**Example 2 (decision).** A supplier quotes KWD 2,000 and proposes adding 5% labelled Kuwait VAT without providing the law. That proposal adds KWD 100 and produces a KWD 2,100 invoice. Request the legal basis and hold the disputed KWD 100 for review. Do not accept the charge or reject it as legally impossible solely from the GCC framework or an MOF index search. The 5% is the supplier's hypothetical proposal, not a verified Kuwait tax rate.
```oa-check
name: Quantify proposed disputed charge before deciding its legal basis
inputs:
quoted_price: 2000
supplier_proposed_rate: 0.05
steps:
- disputed_charge: quoted_price * supplier_proposed_rate
- proposed_total: quoted_price + disputed_charge
expected:
disputed_charge: 100.00
proposed_total: 2100.00
```
## Ask the client first
- Seller and customer establishment, and transaction date?
- Goods, services or digital services, and where supplied?
- Import declaration or invoice showing the charge and its legal basis?
- Foreign VAT registration and any proposed refund or deduction route?

Not yet confirmed: NON-OPERATIVE HOLDS. The inherited assertions that Kuwait has no VAT/GST, no general consumption or sales tax, no excise, no registration, return, invoice tax, reverse charge, input recovery or penalties, and that foreign VAT is irrecoverable. Current enactment, commencement and implementation dates require affirmative official evidence. Historical GCC VAT Framework Agreement (2017), claimed 5% framework rate, GCC Excise Framework Agreement (2016) and Kuwait signature/domestic-adoption status have not been read at source. Historical customs 5% of CIF on most goods, higher tobacco/product rates and the description of customs as the main indirect tax remain unverified; customs.gov.kw access failure was reported by the prior writer, not treated as a source reading. Old domestic zero-VAT invoice cases and digital-services no-VAT conclusion must not be used as current tax advice.
