# Kuwait Corporate Income Tax v0.4
Tax year 2026.
> **General reference only.** This skill is general tax/accounting reference material for AI-assisted workflows. It has not been reviewed for any specific person's facts, documents, elections, deadlines, residency, filing status, or local procedures. Do not rely on it to file, pay, amend, or take a tax position without review by a qualified professional in the relevant jurisdiction.
## Who this applies to
Corporate bodies trading in Kuwait, public and closed Kuwaiti shareholding companies, listed Kuwaiti companies and multinational groups. Determine the regime before computing. This Guide computes ordinary income tax only after foreign corporate-body liability is established and no exemption applies. Kuwaiti/Gulf and mixed-ownership income-tax liability is a NON-OPERATIVE HOLD: do not infer it from the broad statutory corporate-body definition. Natural-person own-work income is exempt subject to the corporate-share exception in art. 8. DMTT scope includes the revenue test and exclusions; it is not a blanket tax on every group member.
## Rates, bands and thresholds
| Item | Figure and conditions | Tax year | Official URL |
|---|---|---|---|
| Corporate income tax rate | 15% of the net taxable income of a corporate body (reg. art. 9) | 2026 | https://www.mof.gov.kw/Desicions/Decree/PDF/la2-2008.pdf |
| Who is in scope | Reg. art. 1 defines corporate bodies broadly by legal personality and Kuwait activity, directly or through an agent. This does not settle the held Kuwaiti/Gulf or mixed-ownership exemptions. Law 46/2006 art. 4 excludes special-law government companies and companies subject to Decree 3/1955 from Zakat | 2026 | https://www.mof.gov.kw/Desicions/Decree/PDF/la2-2008.pdf; https://www.mof.gov.kw/Desicions/Decree/PDF/Q46-2006.pdf |
| Individuals | Exempt on income from trade or work in Kuwait, unless the income is shown to be a share of a corporate body (reg. art. 8) | 2026 | same |
| Boursa Kuwait trading gains | Exempt where they arise only from trading on the Kuwait stock exchange, directly or through portfolios or funds (reg. art. 8) | 2026 | same |
| Loss carry-forward | Three following years only. Activity cessation stops carry-forward; compulsory suspension periods do not count. Liquidation, change of legal form, dissolution and merger extinguish unused losses (reg. art. 7) | 2026 | https://www.mof.gov.kw/Desicions/Decree/PDF/la2-2008.pdf |
| Registration | Within 30 days of starting activity or signing the contract; changes and cessation notified within 30 days (reg. art. 11) | 2026 | https://www.mof.gov.kw/Desicions/Decree/PDF/la2-2008.pdf |
| Return deadline | For a body required to file: on or before the 15th day of the 4th month after period end, in Arabic with an auditor report; art. 13 also requires exempt bodies to file. See the original-Decree low-income filing hold in Sources | 2026 | same |
| Extension | Request by the 15th day of the 2nd month after period end; maximum 60 days; no reply within 30 days is a refusal (reg. art. 14) | 2026 | same |
| Payment | One sum or four equal instalments (reg. art. 28), due on the 15th day of the 4th, 6th, 9th and 12th months after period end (Decree art. 8) | 2026 | https://www.mof.gov.kw/Desicions/Decree/PDF/Q3_1955e.pdf |
| Assessment payment | Within 30 days of notification of the assessment letter, subject to the assessment/instalment rules in arts. 29 to 31 (reg. art. 20) | 2026 | https://www.mof.gov.kw/Desicions/Decree/PDF/la2-2008.pdf |
| Objection and appeal | Objection in 60 days; MOF decides in 90 days, silence is refusal; committee appeal in 30 days; court in 60 days (reg. arts. 24 to 27) | 2026 | same |
| Late filing and late payment fine | 1% per 30 days or part, on tax per return or assessment (reg. art. 34) | 2026 | same |
| Retention by payers | 5% of the contract value or of each payment, held by ministries, public bodies, companies, associations, sole establishments and any natural person or other payer named in the executive rules until MOF clears release (reg. arts. 37 and 38) | 2026 | same |
| Retention, FY 2026/2027 public bodies | Within the independent-budget public-body circular only: 5% on foreign-company contracts at start or each payment; the paragraph excludes payments to Decree-Law 157/2024 entities showing a valid card establishing DMTT registration; ministries and public bodies transfer retention held five years to MOF (pp. 26 to 28). Do not extend that carve-out to private payers | 2026 | https://www.mof.gov.kw/Desicions/ExecBudgRules/PDF/mez-generalization-2027.pdf |
| Fund and bank withholding | Investment companies and banks managing portfolios deduct income tax before paying a corporate body and remit it in 30 days (reg. art. 46) | 2026 | https://www.mof.gov.kw/Desicions/Decree/PDF/la2-2008.pdf |
| Limitation | Collection limitation: five years from filing or MOF knowledge of undisclosed activity/data, subject to interruption by assessment, payment notice, appeal decision and Civil Code causes (art. 41). Refund claim: five years from final settlement notice or the date the taxpayer became aware of the right to recover overpaid tax, whichever is earlier (art. 42) | 2026 | same |
| Zakat and budget contribution | 1% of annual net profit of Kuwaiti public and closed shareholding companies; excludes special-law government companies and companies subject to Decree 3/1955 (Law 46/2006 arts. 1 and 4), and DMTT groups under issuing art. 1 of Law 157/2024 | 2026 | https://www.mof.gov.kw/Desicions/Decree/PDF/Law46_2006e.pdf |
| National Labour Support Tax | 2.5% of annual net profit of Kuwaiti companies listed on the stock exchange (Law 19/2000 art. 12(1)); the provision ceases for in-scope DMTT groups under issuing art. 1. Listed Gulf-company treatment is held in Sources | 2026 | https://www.mof.gov.kw/Desicions/Decree/PDF/LawNo19Of2000NationalLabor.pdf |
| DMTT minimum rate | 15% effective minimum, not 15% of accounting profit. The top-up rate is the shortfall from that minimum; exclusions, adjusted covered taxes, adjusted income and substance exclusion apply (arts. 1, 3 to 12). Detailed calculation requires the held executive-regulations checks | 2026 | https://www.mof.gov.kw/Desicions/Decree/PDF/DecreeLawDMTTNo157of2024.pdf |
| DMTT revenue test | EUR 750m or more in consolidated revenue in at least two of the four preceding tax periods (art. 1) | 2026 | same |
| DMTT start | Tax periods starting on or after 1 January 2025. For these groups Decree 3 of 1955, Law 46 of 2006 and NLST art. 12(1) stop applying (issuing art. 1) | 2026 | same |
| DMTT registration | Within 120 days of becoming subject; changes and complete cessation notified within 120 days (art. 19). Issuing art. 2 granted initial groups a nine-month penalty-free registration period from commencement in 2025 | 2026 | same |
| DMTT return and payment | Within 15 months of period end, with audited statements (arts. 20 and 22) | 2026 | same |
| DMTT late filing | 5% to 30 days; 10% to 90 days; 15% to 365 days; 20% beyond; minimum KWD 1,000 (art. 31). 25%, minimum KWD 5,000, if no return before assessment | 2026 | same |
| DMTT late payment | 1% per 30 days or part (art. 32) | 2026 | same |
| DMTT wrong return | 25% of the difference where it exceeds 10% of the declared tax; 10% if corrected before discovery (art. 33) | 2026 | same |
| DMTT other breaches | KWD 3,000 per listed breach: late registration, late change notification, failure to supply requested documents/information within 30 days, obstruction, or failure to retain books for the statutory period (art. 34) | 2026 | same |
| DMTT initial international phase | Zero only if the group has members in no more than six jurisdictions including Kuwait; tangible-asset net book value outside the jurisdiction with highest such assets when Pillar Two first applies is at most EUR 50m; no Kuwait entity ownership interest is held by a parent applying an income-inclusion rule; and the period does not start after five periods from the first Pillar Two period (art. 16). Executive-regulation application is held | 2026 | same |
## The base
After liability and exemptions are settled, income tax falls on gross income less necessary, real, documented costs allowed under the law (reg. art. 3). Kuwait-source income includes work done wholly or partly in Kuwait wherever the contract was signed, sale or licence of intellectual property, agency commissions, income from lending money in Kuwait, gains on assets including shares in a company holding mainly Kuwaiti real estate, rent on property used in Kuwait, services performed in Kuwait, and activity on the stock exchange (reg. art. 2). A permanent office in Kuwait where sales contracts are concluded is included. The default period is the calendar year; the first period may run to 18 months with approval (reg. art. 10).
## Deadlines and filing
1. Register with the tax administration within 30 days and apply for a tax card with the memorandum, agency contract and address (reg. arts. 11 and 12). Government bodies and companies may not deal with a corporate body lacking a valid card, except registration and licensing procedures needed to start activity (art. 12).
2. MOF electronic-tax service entry point is https://www.mof.gov.kw. The authenticated portal screens, form field numbers, acknowledgement and payment-reference steps have not been read. Do not treat this as a complete electronic filing walkthrough; obtain the current form and instructions from MOF before submission.
3. File the Arabic return on the form attached to the executive rules, with the auditor report from an auditor on the MOF approved list, balance sheet and final accounts, asset schedule, subcontractor schedule with retention held, closing stock, contracts and trial balance (reg. art. 13).
4. Pay in one sum or the first instalment.
5. MOF assesses. Determine the payment amount/date under arts. 20 and 29 to 31 and the separate 60-day objection right. An objection is not presented here as an automatic payment suspension.
6. Ask for the clearance certificate. Retained money is released only with MOF approval: not taxable, exempt or a loss; all tax paid; or a bank guarantee (reg. art. 38).
DMTT: register within 120 days, file and pay within 15 months of period end, and send questions to DMTT@mof.gov.kw as named on the MOF DMTT page.
## Penalties and interest
Income tax: 1% per 30 days or part on the applicable tax/instalment base and starting date in art. 34. Filing and payment are separate breaches. A payer that fails to retain or remit is liable for the tax itself (reg. art. 39), and unreported subcontractor payments are disallowed (reg. art. 37). MOF may assess on an estimated basis if no return is filed (reg. art. 19). DMTT: see the rates table; tax evasion by falsifying, concealing or destroying tax-relevant records carries up to three years in prison and/or a fine up to three times evaded tax; repeat offences within five years after completion or expiry of the earlier punishment carry up to five years and/or five times tax (art. 36).
## Cross-border points
Tax is territorial as set out under The base. Exemptions under international agreements stand for their term (reg. art. 8). Non-residents are caught through agents. For DMTT, a construction/assembly/installation site or related supervision lasting over six months in twelve, and non-resident services aggregating over six months in twelve, are among the PE cases (art. 2). This is not the ordinary income-tax PE rule. Equipment may not be exported until a clearance certificate is shown (reg. art. 46).
## Two worked examples that recompute
**Example 1.** A foreign branch outside DMTT with confirmed income-tax liability, no exemption or losses, has net taxable income of KWD 100,000 and files 70 days late. Assume its tax payments were timely and no statutory excuse or remission applies; only the filing fine is calculated. Tax is KWD 15,000. Seventy days is three 30-day blocks or parts, so the fine is 3% of the tax, KWD 450.
```oa-check
name: Foreign branch, net taxable income KWD 100,000, filed 70 days late
inputs:
income: 100000
late_days: 70
steps:
- blocks: ceil(late_days / 30)
- tax: income * 0.15
- fine: tax * 0.01 * blocks
- total: tax + fine
expected:
blocks: 3
tax: 15000.00
fine: 450.00
total: 15450.00
```
**Example 2 (decision).** Tax per return is KWD 40,000. Paying in one sum puts KWD 40,000 out on the first date. Paying by instalments puts KWD 10,000 out on each of the four dates, with no fine if each date is met. Instalments win on cash unless the company prefers to close the liability. Where an extension is granted, all instalments already due are paid together when the return goes in (reg. art. 28).
```oa-check
name: Decision: pay in one sum or four instalments, tax KWD 40,000
inputs:
tax: 40000
steps:
- one_sum: tax
- instalment: tax / 4
- first_due: instalment
expected:
one_sum: 40000.00
instalment: 10000.00
first_due: 10000.00
```
## Ask the client first
- Is the group's consolidated revenue EUR 750m or more in two of the last four periods?
- Is the entity foreign, Kuwaiti or Gulf owned, and in what shares?
- Is it a public or closed shareholding company, and is it listed?
- What is the period end, and was an extension requested in time?
- Does it hold a valid tax card, and what retention is held by customers?
- Does it hold a Law 116 of 2013 exemption?

Not yet confirmed: NON-OPERATIVE HOLDS. Original Decree art. 8 contains a reasonable-cause exception to the filing/payment fine and a KWD 5,250 low-income filing exception; their present interaction with the 2008 legislation and reg. arts. 13/34 has not been resolved, so do not use this Guide to reject a claimed statutory excuse or decide whether a low-income body must file. Authenticated portal form fields, acknowledgements and payment reference steps; listed Gulf-company NLST treatment and the correct scope/current effect of Ministerial Decision 3/1989. Mixed ownership: how the 15% applies to a company part owned by Kuwaiti and part by foreign holders, and the Kuwaiti and Gulf exemption itself, including the earlier statements here that Gulf nationals are foreign and also exempt (the texts read define the taxpayer as any corporate body; Ministerial Decision 3 of 1989 on equal treatment of Gulf nationals is named in the NLST rule but the copy on the MOF site is a different document); historical KFAS 1% contribution on net profit after transfers to statutory reserve and loss offsets (NON-OPERATIVE HOLD; neither rate, base nor applicability is verified); the 2.5% and 1% interaction with Free Trade Zone exemptions under Law 26 of 1995; the extension of the FY 2026/2027 DMTT retention carve-out and five-year transfer direction to private payers (ordinary retention under reg. arts. 37 to 39 remains sourced); DMTT Executive Regulations detail (Ministerial Resolution 55 of 2025, not read beyond the title page); any business profits tax draft, for which no enacted text was found; the old cap of 50% on the late filing fine, which no text read supports; the earlier statements that dividends carry no withholding tax and that interest and royalties have no fixed withholding rate, with tax collected through the 5% retention
