# Kosovo tax planning v0.2

> evidence and election history before choosing a method.

## What this file is

A comparison workflow supporting [individual income tax](kosovo-income-tax.md)
and [corporate income tax](xk-corporate-income-tax.md). It does not turn a
company payment into a sole-trader tax or treat the gross method as a tax
exemption. The legal taxpayer, activity and method determine the base.

## Section 1: Scope statement

Compare an existing or proposed business's gross-income method and ordinary
real-income method, with a separate schedule for pensions, employment,
VAT and administration. An employee is a natural person working for pay under
an employer's direction/control regardless of the agreement's form. A
self-employed person falls outside that definition. An invoice or a sole
customer alone does not settle that test ([PIT art. 2(1.4)–(1.5)][pit]).

Do not describe every business below EUR 30,000 as exempt, or apply a company's
ceiling to an individual. Route foreign residence, PE, treaty relief and
nonresident payments to [cross-border](xk-cross-border.md).

## Section 2: Method and filing requirements

A valid real-income election and a previous mandatory-method transition can
continue to bind a later low-turnover year. For both regimes, the election
or crossing year and at least three following tax periods require the
statutory real-income treatment. A new taxpayer uses the first quarterly
statement for its election; an existing taxpayer needs the applicable
1 March notice/application. Returning requires the statutory conditions and
TAK approval, not a retrospective choice of the cheapest result
([PIT art. 33][pit]; [CIT arts. 35 and 38][cit]).

Quarterly gross-method statements/payments are due 15 April, 15 July,
15 October and 15 January for the preceding quarter. A zero-income quarter
still needs its statement, with no payment. Real-income annual returns and
settlement are due 31 March of the next year under the current rules.
The linked tax skills set out instalments and return reconciliation
([PIT arts. 43 and 46–48][pit]; [CIT arts. 37–38][cit]).

## Section 3: Rates and thresholds

| Taxpayer/item | Ordinary 2026 rule | Primary source |
|---|---|---|
| Sole trader, gross method | Annual gross income at or below EUR 50,000, without a real-income election/continuing obligation | [PIT arts. 10, 33, 43][pit] |
| Company, gross method | Annual gross income at or below EUR 30,000, without a real-income election/continuing obligation | [CIT arts. 35, 37–38][cit] |
| Trade/transport/agriculture and similar gross activity | 3% of quarterly gross income | [PIT art. 43(2.1.1)][pit]; [CIT art. 38(2.1.1)][cit] |
| Service/professional/vocational/entertainment and similar gross activity | 9% of quarterly gross income | [PIT art. 43(2.1.2)][pit]; [CIT art. 38(2.1.2)][cit] |
| Positive gross-method quarter | Minimum EUR 37.50; zero-income statement has no payment | [PIT art. 43(2.1)][pit]; [CIT art. 38(2.1)][cit] |
| Company, ordinary real income | 10% of net taxable income | [CIT arts. 6–7][cit] |
| Sole trader, ordinary real-income PIT | Annual 0% to EUR 3,000; 8% on EUR 3,000–5,400; EUR 192 plus 10% above EUR 5,400 | [PIT art. 6, replaced by 08/L-142 art. 5][bands] |
| Dividend income | Exempt for the stated resident/nonresident recipient categories; not an exemption for wages, interest or asset gains | [PIT art. 8(1.26)][pit]; [CIT art. 8(1.8)][cit] |
| Tax-loss carryforward | Sole trader: six successive periods; company: four; respective business/ownership restrictions apply | [PIT art. 26][pit]; [CIT art. 24][cit] |

Rent has a separate computation/withholding-credit route; it is not automatically
3% trade or 9% services ([PIT art. 43][pit]; [CIT art. 38(2.1.3)][cit]).

Other extraction routes carry their own withholding: interest and royalties
paid by a business person are withheld at 10%, and rent at 9%, at the time of
payment ([PIT art. 39(1), (4)][pit]). Compare them on that basis, not as
tax-free alternatives to a dividend.

## Section 4: Computation rules

1. Identify the taxpayer, genuine activity, annual gross receipts, quarter
   profile and election/threshold history. Keep separate activity categories.
2. Calculate gross-method tax **by quarter**, including each applicable
   minimum. An annual percentage alone misses low-income-quarter minima.
3. For real income, start from documented business income, deduct only allowed
   expenses, replace accounting depreciation with tax depreciation, and test
   allowable pensions and losses under the correct statute. Do not deduct
   costs twice or treat capital purchases as unrestricted current expenses
   ([PIT arts. 12–30][pit]; [CIT arts. 9–24][cit]).
4. Apply the individual's progressive PIT or the company's 10% CIT. A
   sole-trader withdrawal is not a company dividend. A genuine company
   dividend's exemption does not erase company tax on earned profits, turn
   salary into a dividend, or exempt a gain on distributed property
   ([PIT arts. 2, 6, 8 and 9][pit]; [CIT arts. 6–8, 25–26][cit]).
5. Compare the full continuing term. Add actual employer/owner contribution
   liabilities, VAT effects, deductible versus nondeductible costs, accounting
   obligations and any tax on actual asset transfers. Do not select an entity
   from this income-tax-only comparison. The new health-law collection/phase
   instruments remain unresolved in the [contribution skill](kosovo-social-contributions.md).
6. Record the election deadline, approval/notice evidence, future cash-flow
   assumptions and review decision. Incorporation or reorganisation does not
   automatically transfer an individual's losses to a company
   ([PIT art. 26][pit]; [CIT arts. 24 and 27][cit]).

### Illustration: gross service payments versus company profit tax

Assume a company is eligible for the gross method, has no binding real-income
history, and forecasts EUR 5,000 service receipts and EUR 4,000 of fully
allowable ordinary expenses in each of four quarters. Gross-method tax is
EUR 450 each quarter, EUR 1,800 annually. With a valid real-income election,
annual taxable profit is EUR 4,000 and CIT EUR 400. The EUR 1,400 difference
is an income-tax comparison, before pensions, payroll, VAT, compliance costs
and future binding years. Expenses and activity are assumptions, not a
statutory profit margin ([CIT arts. 6–7, 35, 38][cit]).

  annual_gross_tax: 1800
  annual_taxable_profit: 4000
  annual_corporate_tax: 400

```
### Illustration: a low positive quarter is not the zero-income exception
An eligible gross-method trader receives EUR 600 in one quarter and zero in
the next. Three percent of EUR 600 is EUR 18, so the first-quarter minimum
raises tax to EUR 37.50. The zero-income quarter has no tax payment but still
needs a statement ([PIT art. 43(2.1)][pit]; [CIT art. 38(2.1)][cit]).
```oa-check
name: Kosovo positive-quarter minimum and zero-income quarter
inputs:
  positive_quarter_receipts: 600
  trade_rate: 0.03
  minimum: 37.50
  zero_quarter_receipts: 0

  zero_quarter_tax: zero_quarter_receipts * trade_rate
expected:
  percentage_tax: 18
  positive_quarter_tax: 37.50
  zero_quarter_tax: 0
```
## Section 5: Edge cases and special rules
A dividend exemption is a classification rule, not permission to describe all
profit extraction as tax-free. Property distributions/liquidation can create
a company market-value gain under CIT arts. 25–26. Controlled transactions
need arm's-length pricing under CIT art. 28/PIT art. 35; an invoice from an
owner or related company does not establish deductibility. The absence of
several customers does not substitute for the employment direction/control
assessment. Keep actual contracts and conduct.
Splitting one business across several persons or entities to keep each under
the EUR 30,000 or EUR 50,000 ceiling does not work without real substance: TAK
may disregard a transaction with no substantial economic effect and
re-characterise one whose form does not reflect its substance or that is part
of a scheme to avoid tax ([08/L-257 art. 41][tap]).
Do not promise tax holidays, investment incentives, sponsorship credits,
VAT exemptions or tax-neutral reorganisations without their specific law,
approvals and conditions. Donations reduce tax only if their eligibility,
limits and documentation are satisfied; spending money solely for a deduction
does not make the expenditure a saving of the same amount
([PIT art. 28][pit]; [CIT arts. 11, 18 and 27][cit]).
## Section 6: Self-checks
- Use the correct company or individual ceiling, activity and current bands.
- Reconcile all quarters, minima, annual income and method history.
- Verify deductions, assets, pensions, loss vintages and credits once.
- Include actual contributions and administration before making an entity recommendation.
- Keep the employment, related-party and property-distribution classifications supported.
- Obtain qualified-professional review before action.
## Section 7: Disclaimer
This skill produces general working papers. A qualified professional must
review the actual facts, deductions, method/election and filing position before
any return or tax-planning action.
