# Haiti: personal income tax under the new Code
## Effective date and source
The replacement Tax Code was published in *Le Moniteur*, Special 48-A, on 30 September 2026. Article 540 sets commencement at **1 October 2026** and provides for ministerial implementation decisions. This Guide describes the enacted new-code rules; it does not apply them retrospectively to the fiscal year ending 30 September 2026. [2026 Code, articles 540–543, page 169](https://mef.gouv.ht/storage/app/uploads/public/6ac/fb4/9bc/6acfb49bca658143176190.pdf#page=169).
The [DGI posted the replacement decree on 19 October 2026](https://dgi.gouv.ht/dgi_doc/decret-remplacant-le-decret-du-19-decembre-2022-portant-le-code-fiscal/). Current implementation decisions, filing forms and exceptional deadline changes still require checking before a filing. Independent source review and accountant attestation are pending.
## Annual progressive scale
Article 132 applies these rates to the corresponding slices of annual taxable income, in Haitian gourdes (HTG). The rates are marginal: do not multiply the whole income by the highest applicable percentage. [2026 Code, articles 132, page 45](https://mef.gouv.ht/storage/app/uploads/public/6ac/fb4/9bc/6acfb49bca658143176190.pdf#page=45).
| Annual taxable-income slice | Rate |
|---|---:|
| Up to HTG 360,000 | 0% |
| Above 360,000 through 540,000 | 12% |
| Above 540,000 through 1,080,000 | 18% |
| Above 1,080,000 through 2,160,000 | 25% |
| Above 2,160,000 | 30% |
For **HTG 600,000** taxable income, tax before withholding credits is 180,000 × 12% + 60,000 × 18% = **HTG 32,400**. For **HTG 1,200,000**, it is 180,000 × 12% + 540,000 × 18% + 120,000 × 25% = **HTG 148,800**. These examples start with taxable income after allowable deductions, not gross receipts. [2026 Code, articles 126, 132, page 43–45](https://mef.gouv.ht/storage/app/uploads/public/6ac/fb4/9bc/6acfb49bca658143176190.pdf#page=43).
## Final declaration and credits
Article 125 requires a signed general and detailed annual declaration covering all income, submitted by the taxpayer or representative **by 31 January for the preceding fiscal year's income**, on the administration's free form. Article 133 credits non-final source withholding and provisional payments against annual global-income tax. A withholding marked final must not automatically be treated as a credit under this rule. [2026 Code, articles 125, page 43](https://mef.gouv.ht/storage/app/uploads/public/6ac/fb4/9bc/6acfb49bca658143176190.pdf#page=43); [2026 Code, articles 133, page 45](https://mef.gouv.ht/storage/app/uploads/public/6ac/fb4/9bc/6acfb49bca658143176190.pdf#page=45).
The filing date alone does not decide which rate schedule applies. Keep the fiscal period separate from the submission date. This Guide supplies the new-code schedule only and does not calculate the return for the fiscal year ending 30 September 2026 using the new bands. [2026 Code, articles 540, page 169](https://mef.gouv.ht/storage/app/uploads/public/6ac/fb4/9bc/6acfb49bca658143176190.pdf#page=169).
## Deductions require documents and correct classification
Article 126 allows the listed deductions only with supporting evidence and only when not already deducted in the relevant income category. Examples include 25% of annual rent of the principal residence; qualifying principal-residence mortgage interest and built-property tax; statutory salary levies other than income tax; qualifying retirement/housing savings; qualifying life/health insurance; and medical costs not covered by insurance. The principal-residence and lender/insurer conditions in the article must be satisfied. [2026 Code, articles 126, page 43–44](https://mef.gouv.ht/storage/app/uploads/public/6ac/fb4/9bc/6acfb49bca658143176190.pdf#page=43).
The same article addresses training and education expenditure, with children's tuition limited to HTG 100,000 per minor child and HTG 300,000 in aggregate for eligible Haitian institutions, supported by records. It also lists evidenced professional-travel accommodation/meals and donations to the specified recognised and tax-registered bodies. The donation ceiling is **10% of income remaining after the preceding article 126(a)–(h) deductions**, not automatically 10% of gross income. [2026 Code, articles 126, page 44](https://mef.gouv.ht/storage/app/uploads/public/6ac/fb4/9bc/6acfb49bca658143176190.pdf#page=44).
If annual qualifying principal-residence rent is HTG 240,000, the stated rental deduction is HTG 60,000, subject to the residence and evidence conditions. If income remaining after the earlier deductions is HTG 500,000, the donation ceiling is HTG 50,000; a donation itself and its qualifying recipient still need proof. [2026 Code, articles 126, page 43–44](https://mef.gouv.ht/storage/app/uploads/public/6ac/fb4/9bc/6acfb49bca658143176190.pdf#page=43).
Category losses offset only income of the same category under article 126(2). Keep a schedule by income category rather than netting every loss against salary. [2026 Code, articles 126, page 44](https://mef.gouv.ht/storage/app/uploads/public/6ac/fb4/9bc/6acfb49bca658143176190.pdf#page=44).
## Scope still to complete
Residence, source rules, treaties, category-specific profit calculations, capital gains and the full effect of ministerial implementation decisions are outside this initial Guide. Gather the period, income-category schedules, withholding receipts and deduction documents before preparing a return. The enacted bands have been visually checked against page 45; this is not an accountant attestation.
