# Gabon payroll and social contributions v0.3

> **General reference only.** This skill is general tax/accounting reference material for AI-assisted workflows. It has not been reviewed for any specific person's facts, documents, elections, deadlines, residency, filing status, or local procedures. Do not rely on it to file, pay, amend, or take a tax position without review by a qualified professional in the relevant jurisdiction.

**2026 draft and currency hold.** This is a research draft for 2026, not a certified consolidation of the law in force. The DGI-hosted 2025 CGI is a historical baseline, read alongside enacted Law 041/2025 of 29 December 2025 and Law 002/2026 of 17 July 2026. The complete intervening amendment chain, transaction-specific commencement and implementing instruments have not been established. Do not use a baseline figure as an operative 2026 filing instruction. A July amendment is identified as such; its promulgation date alone does not establish its first taxable period. No independent pack review or accountant attestation has occurred.

## Who this applies to

Employers paying taxable salary and employees within the relevant private-sector schemes. Public servants, independent workers, pensioners, foreign secondments and exempt benefits require their own tests. The CNSS decree page has a date inconsistency: its issue heading precedes the decree date. The earlier issuer announcement is retained as unverified history; do not use it to establish commencement or a payroll deadline. The original gazette and allocation of the family/occupational branches still need confirmation before final payroll. [Decree0487/PR/MASI arts2-4](https://journal-officiel.ga/22255-0487-pr-masi-/) (ledger P-CNSS); [CNSS issuer-social announcement, unverified history only](https://fr.linkedin.com/posts/cnss-gabon_cnssemployeur-cnsstravailleur-cnsspluspr%C3%A8sdevous-activity-7416830583407910912-XCKD) (ledger P-START).

## Rates, bands and thresholds

| Item and conditions | Rule or amount (XAF unless stated) | Period/status | Official source |
|---|---|---|---|
| CNSS pension branch | 16% total: employer 11%, worker 5% | 18 December 2025 decree; first applicable payroll period held pending official-host evidence | [Decree0487/PR/MASI arts2-4](https://journal-officiel.ga/22255-0487-pr-masi-/) (ledger P-CNSS) |
| CNSS family/maternity branch | 5%; do not infer a combined employer total until allocation is confirmed | Same decree; original gazette/branch allocation hold | [Decree0487/PR/MASI art2](https://journal-officiel.ga/22255-0487-pr-masi-/) (ledger P-CNSSFAM) |
| CNSS occupational branch | 2%; allocation hold as above | Same decree | [Decree0487/PR/MASI art2](https://journal-officiel.ga/22255-0487-pr-masi-/) (ledger P-CNSSACC) |
| CNSS remuneration ceiling | 1,500,000 per month | Same decree | [Decree0487/PR/MASI art4](https://journal-officiel.ga/22255-0487-pr-masi-/) (ledger P-CNSSCAP) |
| Private CNAMGS employer | 4.1%; IRPP elements, separate health ceiling | Undated authority page read in 2026; decree/version hold | [CNAMGS employer page, assessment and private-sector rates](https://cnamgs.ga/payement-des-cotisations-employeurs/) (ledger P-HEALTH) |
| Private CNAMGS worker | 2%; separate health ceiling | Same page | [CNAMGS employer page, private rates](https://cnamgs.ga/payement-des-cotisations-employeurs/) (ledger P-HEALTHWORK) |
| CNAMGS ceiling | 2,500,000 per month | Same page | [CNAMGS employer page, ceiling](https://cnamgs.ga/payement-des-cotisations-employeurs/) (ledger P-HEALTHCAP) |
| Complementary salary tax | 5% on article 92 net base above monthly 150,000 exempt slice; specified bonuses have a separate annual exemption | 2025 statutory baseline; 2026 currency hold | [CGI arts346-351](https://dgi.ga/wp-content/uploads/dgi-content/d1dde772234076c5d2bc0a8d8d3db573ed3d8fdd6c3e869c8c57cd181a81bb70/assets/dgi/2d50ab6c2e-Gabon-CGI-2025.pdf) (ledger P-TCS) |
| Housing-fund levy | 3% on covered salary base within CNSS cap; State excluded | July 2026 amendment; first period unresolved | [LFR002/2026 art4, CGI arts401-404bis](https://dgb-gabon.net/uploads/documentation/Texte%20juridique/178593988623.pdf) (ledger P-HOUSING) |

## The base

Keep separate reconciliations for cash salary, benefits in kind, expense reimbursements, exempt allowances, CNSS remuneration, CNAMGS base and article 92 salary base. The pension branch is not computed on uncapped gross pay. Do not reuse the old combined employer or employee totals. [Decree0487/PR/MASI arts2-4](https://journal-officiel.ga/22255-0487-pr-masi-/) (ledger P-CNSS); [CNAMGS employer page, assessment and private-sector rates](https://cnamgs.ga/payement-des-cotisations-employeurs/) (ledger P-HEALTH).

For salary IRPP, follow the [income-tax](ga-income-tax.md) annual household rules after establishing article 92 mandatory deductions and article 94 professional expenses. Calculate TCS on its own statutory net base, then account for its deductibility under article 351; do not calculate every levy from the same gross salary. [CGI art92](https://dgi.ga/wp-content/uploads/dgi-content/d1dde772234076c5d2bc0a8d8d3db573ed3d8fdd6c3e869c8c57cd181a81bb70/assets/dgi/2d50ab6c2e-Gabon-CGI-2025.pdf) (ledger I-BASE); [CGI art94](https://dgi.ga/wp-content/uploads/dgi-content/d1dde772234076c5d2bc0a8d8d3db573ed3d8fdd6c3e869c8c57cd181a81bb70/assets/dgi/2d50ab6c2e-Gabon-CGI-2025.pdf) (ledger I-FEES); [CGI arts346-351](https://dgi.ga/wp-content/uploads/dgi-content/d1dde772234076c5d2bc0a8d8d3db573ed3d8fdd6c3e869c8c57cd181a81bb70/assets/dgi/2d50ab6c2e-Gabon-CGI-2025.pdf) (ledger P-TCS). July limits the car-allowance exemption to qualifying own-vehicle professional use, without an employer-provided or maintained vehicle. The adjacent baseline article91bis prohibits combining car/maintenance and displacement allowances. [CGI art91bis](https://dgi.ga/wp-content/uploads/dgi-content/d1dde772234076c5d2bc0a8d8d3db573ed3d8fdd6c3e869c8c57cd181a81bb70/assets/dgi/2d50ab6c2e-Gabon-CGI-2025.pdf) (ledger P-CAR). The full current-law and precise July-commencement holds remain. [LFR002/2026 art4, CGI art91bis](https://dgb-gabon.net/uploads/documentation/Texte%20juridique/178593988623.pdf) (ledger P-CAR).

## Deadlines and filing

Baseline salary IRPP and TCS are withheld monthly and remitted in the first fifteen days of the next month using the authority declaration and receipt. [CGI arts95-96](https://dgi.ga/wp-content/uploads/dgi-content/d1dde772234076c5d2bc0a8d8d3db573ed3d8fdd6c3e869c8c57cd181a81bb70/assets/dgi/2d50ab6c2e-Gabon-CGI-2025.pdf) (ledger P-WITHHOLD); [CGI arts346-351](https://dgi.ga/wp-content/uploads/dgi-content/d1dde772234076c5d2bc0a8d8d3db573ed3d8fdd6c3e869c8c57cd181a81bb70/assets/dgi/2d50ab6c2e-Gabon-CGI-2025.pdf) (ledger P-TCS). NONOPERATIVE HOLD: the first quarterly salary-declaration deadline under the new rates has not been verified from an official-host source. The earlier issuer announcement is retained as unverified history; do not use it to set a payroll deadline. [CNSS issuer-social announcement, unverified history only](https://fr.linkedin.com/posts/cnss-gabon_cnssemployeur-cnsstravailleur-cnsspluspr%C3%A8sdevous-activity-7416830583407910912-XCKD) (ledger P-START). The health authority describes a separate quarterly DTR file and bank-payment evidence, with quarter-end reporting windows ending April, July, October and January. [CNAMGS employer page, declaration/payment and schedule](https://cnamgs.ga/payement-des-cotisations-employeurs/) (ledger P-HEALTHFILE).

The public e-tax link does not prove a complete filing route. This draft has not inspected an authenticated account, current return identifier, box numbers, payment reference generation or acceptance receipt. Obtain the current authority form and preserve the accepted declaration and payment receipt before treating the job as complete.

## Penalties and interest

Use the relevant institution and obligation, not a single blended late-payment percentage. Tax withholding defaults follow the CGI and its July amendment. [CGI artsP998-999](https://dgi.ga/wp-content/uploads/dgi-content/d1dde772234076c5d2bc0a8d8d3db573ed3d8fdd6c3e869c8c57cd181a81bb70/assets/dgi/2d50ab6c2e-Gabon-CGI-2025.pdf) (ledger G-DELAY); [LFR002/2026 art4, CGI artP1000](https://dgb-gabon.net/uploads/documentation/Texte%20juridique/178593988623.pdf) (ledger G-PAY). CNSS sanctions and the complete current social collection calendar have not been verified. CNAMGS late-payment and declaration sanctions were read but the underlying operative decree has not been reconciled, so no final social penalty calculation is supplied.

## Cross-border points

CGI article 95 has special rules for foreign personnel supplied by a nonresident, including duration and missing salary-detail cases. Establish who pays, who benefits, who employs and where work is performed before using ordinary payroll. [CGI arts95-96](https://dgi.ga/wp-content/uploads/dgi-content/d1dde772234076c5d2bc0a8d8d3db573ed3d8fdd6c3e869c8c57cd181a81bb70/assets/dgi/2d50ab6c2e-Gabon-CGI-2025.pdf) (ledger P-WITHHOLD). Use [cross-border](ga-cross-border.md) for residence and treaty questions.

## Two worked examples that recompute

**Pension component below the cap.** For an employee with CNSS-assessable monthly remuneration 1,000,000, the decree pension branch gives worker 50,000 and employer 110,000. Other branches, health and tax remain separate.

```oa-check
name: CNSS pension branch only
inputs:
  salary: 1000000
steps:
  - base: min(salary, 1500000)
  - worker_pension: base * 0.05
  - employer_pension: base * 0.11
expected:
  worker_pension: 50000
  employer_pension: 110000
```

**Decision: apply each ceiling independently.** For 2,000,000 assessable remuneration under both schemes, pension uses the CNSS cap while private health uses its different cap. Worker pension is 75,000, not 100,000; worker health is 40,000. This demonstrates two component calculations, not final net pay or a certified total social rate.

```oa-check
name: Decision different contribution ceilings
inputs:
  salary: 2000000
steps:
  - pension_base: min(salary, 1500000)
  - health_base: min(salary, 2500000)
  - worker_pension: pension_base * 0.05
  - worker_health: health_base * 0.02
  - uncapped_pension: salary * 0.05
  - overstatement: uncapped_pension - worker_pension
expected:
  worker_pension: 75000
  worker_health: 40000
  overstatement: 25000
```

## Ask the client first

- Which employment category, institutions and payroll month apply?
- What salary, benefits, allowances, reimbursements and mandatory contributions are documented?
- Which family shares and foreign employment or secondment facts apply?
- What are the separate CNSS, CNAMGS and salary-tax bases?
- What registration, prior declarations and accepted payment receipts exist?
