# Estonia social contributions, tax year 2026

> **Source-cited draft.** Built by Michael Cutajar and the OpenAccountants team from the Social Tax Act (Sotsiaalmaksuseadus, SMS), the Unemployment Insurance Act (Töötuskindlustuse seadus, TKindlS), the Funded Pensions Act (Kogumispensionide seadus, KoPS), the Income Tax Act (Tulumaksuseadus, TuMS) and the Taxation Act (Maksukorralduse seadus, MKS), with Estonian Tax and Customs Board (EMTA) and Ministry of Finance pages, read on 2026-10-24. No accountant has reviewed it. Do not file or advise from it without review by a qualified Estonian professional.

Estonia has three social charges, all collected by EMTA:

- **Social tax** (sotsiaalmaks): 33%, paid by the employer on top of pay, or by the self-employed person on their own profit. It funds state pension insurance and state health insurance. There is no employee social tax.
- **Unemployment insurance premium** (töötuskindlustusmakse): 1.6% withheld from the employee and 0.8% paid by the employer.
- **Mandatory funded pension contribution** (II pillar): 2%, 4% or 6% withheld from a resident member's pay. The state adds 4 percentage points out of the 33% social tax.

The year is the calendar year for the self-employed and the calendar month for employers. Currency: euro.

## Who this applies to

**Social tax payers** (SMS § 4): resident legal persons, natural persons (including FIE), non-residents with a permanent establishment in Estonia or making taxable payments, and state and local bodies. The state also pays social tax for some people who do not work, such as a parent on parental benefit (SMS § 6).

**What carries social tax** (SMS § 2(1)):
- pay and other remuneration to employees and officials (point 1);
- fees to members of a legal person's management or supervisory board (point 4);
- the FIE's business income after the deductions the Income Tax Act allows (point 5);
- fees under service contracts with natural persons, unless the payee is a registered FIE and the fee is business income (point 6, § 9(1) point 2);
- fringe benefits, grossed up with their income tax (point 7);
- unemployment insurance benefits, and other pay for work set by law (points 8 and 9).

**Unemployment premiums** cover employees, officials and people working under service contracts (TKindlS § 3(1)). They do not cover an FIE, a board member outside the Employment Contracts Act, or a person who has reached pensionable age or receives an early or flexible old-age pension (TKindlS § 3(2)). For that last group the employer still pays its 0.8% (TKindlS § 40(1) point 2).

**The II pillar** binds an "obligated person": a resident individual for whom social tax is paid, from 1 January of the year after they turn 18, until they leave it, retire from it or withdraw their savings (KoPS §§ 6, 7(3)). The pension register shows who is a member. The contribution is due on the same payments as social tax except fringe benefits and state-paid cases (KoPS § 7(1) and (2)).

The EUR 886 monthly rate is the same figure as the 2025 minimum wage; the Ministry of Finance's 2026 summary confirms it and the EUR 292.38 minimum.

## The taxable base

**Employees.** Social tax is 33% of everything paid for the month, with no ceiling, and never on less than EUR 886 (SMS § 2(2)). With several employers, only the employer that gives the basic exemption must top up to the minimum; if it holds a certificate of the other employer's pay, it pays on the gap between EUR 886 and that pay, but at least on what it paid itself (SMS § 2(2¹) and (2²)).

The minimum does not apply, and social tax is paid on actual pay, for (SMS § 2(4)):
- an employee or official with shortened working time under the Employment Contracts Act § 43(4) or (6);
- a parent, step-parent, adopter or guardian raising a child under 3, or three or more children under 19;
- a person insured by the state under the Health Insurance Act § 5(4) point 5 (for example pupils and students);
- for up to 12 months, a person hired after at least six months registered as unemployed;
- a state pensioner or a person with partial or no work capacity;
- a local council member; a qualifying seafarer; a spouse receiving the foreign service allowance.

In a month in which the employee starts or leaves work, or refused work under the Employment Contracts Act § 19 (other than unpaid leave agreed by both sides), the minimum is pro-rated by the time worked (SMS § 2(3)).

**Exempt amounts** (SMS § 3): among others the income-tax-free payments in TuMS § 13(3) points 1 to 2³, 6 and 14 (business travel costs and foreign per diems within the limits, among others), and occupational health and safety costs meeting the Occupational Health and Safety Act. Fringe benefits are not exempt: social tax is due on the benefit plus its 22/78 income tax, paid without attributing it to the person (SMS § 2(1) point 7, § 9(1) point 3), so it earns the person no pension or health rights.

**Unemployment premiums** are on the same pay, with no minimum and no ceiling, except statutory severance, compensation or penalty interest for unlawful dismissal, pay due by law for a delayed final settlement, and SMS § 3 amounts (TKindlS § 40(2)). Both premiums are rounded to the cent per person (TKindlS § 42(3)).

**The II pillar** is withheld from the same payments (KoPS § 7(1)) at the rate the member chose, checked by personal code against the pension register (KoPS § 11(1)). Its 4% state addition is not an extra cost: EMTA moves 4 of the 33 points of social tax to the member's pension account (SMS § 10(4)).

**Self-employed (FIE).** The base is business income after the deductions the Income Tax Act allows (SMS § 2(1) point 5). The FIE cannot deduct its own social tax or advances as a business expense; instead EMTA divides the profit by 1.33, so the social tax is 33% of profit ÷ 1.33 (TuMS § 14(5³); EMTA, FIE social tax). The result is then held between:
- **the minimum**, social tax on 12 × EUR 886 = EUR 10,632, so EUR 3,508.56 (SMS § 2(5)). It does not apply to an FIE who was a state pensioner, had partial or no work capacity, or was state-insured as a student for the whole year, nor where an employer already paid social tax on at least that base (SMS § 2(5) and (7)). It is pro-rated by days for an FIE registered, deregistered or suspended during the year (SMS § 2(6) and (8));
- **the maximum**, social tax on 10 times the year's monthly minimum wages, EUR 111,720 for 2026, so EUR 36,867.60.

If the minimum or the maximum applies, the 1.33 division is not used for income tax; the FIE deducts the actual social tax instead (TuMS § 14(5⁴) and (5⁵)).

An FIE is not insured for unemployment and pays no premium (TKindlS § 3(2) point 1). A II pillar member FIE pays the contribution on the same business income, on a notice from EMTA (KoPS § 11(2) and (2¹)). An FIE whose spouse or registered partner is registered as working in the business pays social tax for them on EUR 886 a month (SMS § 6¹).

## Deadlines and filing

| What | When | Source |
|---|---|---|
| Employer's TSD and payment of social tax, both unemployment premiums and the II pillar | 10th of the month after payment | SMS § 9(1) point 4; TKindlS § 42(1) point 3; KoPS § 11(1) |
| FIE social tax advances | 15th of the third month of each quarter, for that quarter | SMS § 9(3) point 1 |
| FIE income tax return with form E (business income) | 30 April of the next year | EMTA, FIE social tax |
| FIE social tax balance | 1 October of the next year, on EMTA's notice | SMS § 9(3) point 2, § 9(6) |
| FIE II pillar contribution | Notice by 1 September; payment by 1 October of the next year | KoPS § 11(2) and (3) |
| Change of II pillar rate | Application by 30 November, effective 1 January of the next year | KoPS § 17²(8) |

**Advances, the detail.** An FIE pays EUR 877.14 a quarter. None is due for a quarter in which the FIE was a state pensioner, had partial or no work capacity, or was state-insured as a student for the whole quarter (SMS § 9(3) point 1); EMTA adds that an FIE under 19 pays no advances. Advances are pro-rated by days where the status, registration or a suspension covers only part of the quarter (SMS § 9(5) and (5¹)). If an employer pays social tax for the FIE in the same quarter, the advance falls by that amount, counted from the start of the year (SMS § 9(4)). EMTA refunds overpaid advances by 1 October (SMS § 9(6) point 2).

## Penalties and interest

| Failure | Consequence | Source |
|---|---|---|
| Social tax, premium, II pillar or FIE advance paid late | Interest at 0.06% a day from the day after the due date to the day of payment, inclusive | MKS §§ 115(1) and (5), 117(1) |
| TSD not filed | New deadline with warning; coercive fine up to EUR 1,300, then EUR 2,000, EUR 3,300 in total for the same return | MKS § 91 |
| Intentionally false or missing data that reduces a tax or withholding | Fine up to 300 fine units (EUR 8 each, EUR 2,400) for a person; up to EUR 32,000 for a legal person | MKS § 153¹; Penal Code (KarS) § 47(1) |
| Instalment schedule for arrears | EMTA may cut the interest rate by up to 50% from the date of the schedule | MKS § 117(2) |

The unemployment premium is a tax for collection and sanctions (TKindlS § 42(4) and (5)).

## Cross-border points

- **Which country's system.** Inside the EU, EEA and Switzerland, Regulation (EC) No 883/2004 decides. A worker posted to Estonia with a valid A1 from another state pays no Estonian social tax or unemployment premium for that work; an Estonian A1 keeps a worker posted abroad on Estonian social tax. EMTA pro-rates an FIE's advances for days not covered by a foreign A1.
- **Non-resident employees** without an A1 are in the Estonian social tax and unemployment system, but are not II pillar members, because KoPS § 6 covers residents only.
- **Foreign employers** acting as employers in Estonia pay social tax and unemployment premiums like a resident employer (SMS § 4 point 3; TKindlS § 4(2) point 4).
- **FIE income exempt under a treaty** (TuMS § 14(10)) still carries Estonian social tax, computed on the profit under the foreign tax rules (SMS § 2(11)).

## Worked examples

### Example 1: employer cost and social tax split, EUR 3,000 gross, II pillar 6% (2026)

Gamma OÜ pays Liis EUR 3,000 in March 2026. She is a resident II pillar member who chose 6% and is under pensionable age.

Gamma pays social tax of 33%, so EUR 990.00. Because Liis is a II pillar member, EMTA sends 16 points to state pension insurance (EUR 480.00), 13 to health insurance (EUR 390.00) and 4 to her II pillar account (EUR 120.00). Gamma also pays the 0.8% premium, EUR 24.00, so its total cost is EUR 4,014.00. From Liis's pay Gamma withholds the 1.6% premium, EUR 48.00, and her 6% contribution, EUR 180.00. Her II pillar account receives EUR 300.00 for the month. Income tax on her pay is in `estonia-payroll`.

### Example 2: self-employed FIE, profit EUR 60,000, minimum and maximum test (2026)

Kristjan is a sole proprietor (FIE) registered all year, with no employer paying social tax for him and none of the exemptions. His 2026 business income after allowed expenses is EUR 60,000.

Social tax is 33% of 60,000 ÷ 1.33. The base is EUR 45,112.78 and the tax EUR 14,887.22. That sits between the minimum (EUR 3,508.56) and the maximum (EUR 36,867.60), so it stands. During 2026 he paid four advances of EUR 877.14, EUR 3,508.56 in all. He files form E by 30 April 2027, and EMTA's notice asks for the balance of EUR 11,378.66 by 1 October 2027. Had his profit been EUR 8,000, the 1.33 method would give EUR 1,984.96 and the minimum of EUR 3,508.56 would apply instead.

## Ask the client first

1. **Employee, board member, contractor or FIE?** It decides who pays social tax, whether unemployment premiums apply and whether there is a minimum base.
2. **Does an SMS § 2(4) exception apply to the employee** (pensioner, partial work capacity, child under 3 or three children under 19, student, recent unemployment, shortened hours)? If so, no EUR 886 minimum.
3. **Is there an A1 certificate from another country, or an Estonian A1 for work abroad?** It can take the person out of, or keep them in, Estonian social tax.
4. **Is the person a II pillar member, and at what rate this year?** None, 2%, 4% or 6%.
5. **For an FIE: registration dates, suspensions, pension or student status, and any employer paying social tax for them this year?** All of these change the minimum and the advances.
6. **For an FIE: profit after allowed expenses for the year?** It fixes where the 1.33 result falls against the minimum and the maximum.
