# DR Congo payroll and CNSS: employer research workpaper v1.0
> **General reference only.** This skill is general tax/accounting reference material for AI-assisted workflows. It has not been reviewed for any specific person's facts, documents, elections, deadlines, residency, filing status, or local procedures. Do not rely on it to file, pay, amend, or take a tax position without review by a qualified professional in the relevant jurisdiction.
## Who this applies to
**RESEARCH HOLD.** Read this as a source-bound employer workpaper. The full 2025 provisions carried into 2026 by Finance Law 25/060 article 16 remain unreconciled, and later social-security orders/current minimum-wage and special-category rules have not been exhaustively established. The 2026 label is a research period. It does not certify a final payroll liability, completed domain or accepted filing. [25/060 art.16](https://www.budget.gouv.cd/wp-content/uploads/budget2026/lf_2026_recettes.pdf); [CNSS legal collection](https://cnss.cd/wp-content/uploads/2024/04/Recueil-de-textes-legal-reglementaires-et-mesures-dexecution-de-la-loi-16-009-du-15-juillet-2016-1.pdf).
The current fund is **CNSS**, replacing the former INSS. Law 16/009 article 3 covers workers principally exercising professional activity in DR Congo for employers without nationality distinction, and lists additional categories. Article 4 covers specified apprentices, students/trainees and others for occupational risks; do not charge every category all three branches automatically. Regulation 146 articles 1–3 includes an employer using one or more workers and workers under direction/authority, including casual, home and domestic workers. A contractor label is not the worker-classification test. [CNSS institutional page](https://cnss.cd/?page_id=1388); [Law 16/009 arts.3–5,PDF 6–7; Regulation 146 arts.1–4,PDF 117–118](https://cnss.cd/wp-content/uploads/2024/04/Recueil-de-textes-legal-reglementaires-et-mesures-dexecution-de-la-loi-16-009-du-15-juillet-2016-1.pdf).
Use separate schedules for CNSS social contributions, salary IRPP withholding, the expatriate-employer levy, and INPP/ONEM. A combined form does not prove identical bases, rates or deadlines. The old Guide's INPP and ONEM percentages and blanket single-return statement are not carried forward as law without their actual governing texts.
## Rates, bands and thresholds
The ordinary CNSS amounts below assume full-branch worker coverage and the correctly established base, no special occupational-risk rate and no later applicable amendment. The authority's current presentation page repeats the three branch rates. [Decree 18/041 arts.1–11,PDF 59–61](https://cnss.cd/wp-content/uploads/2024/04/Recueil-de-textes-legal-reglementaires-et-mesures-dexecution-de-la-loi-16-009-du-15-juillet-2016-1.pdf); [CNSS rates page](https://cnss.cd/?page_id=1388).

Do not apply the old mining expatriate percentage, a neighbouring-country exemption or a blanket “gross salary” contribution base without its actual current source. These remain distinct source questions. Employer expenditure is not the same as take-home pay.
## The base
### CNSS calculation
1. Establish worker category, branches, remuneration period and any cross-border/special scheme. Law 16/009 articles 3–5 and Regulation 146 articles 1–3 must be read for the actual category. [Legal collection, PDF 6–7,117–118](https://cnss.cd/wp-content/uploads/2024/04/Recueil-de-textes-legal-reglementaires-et-mesures-dexecution-de-la-loi-16-009-du-15-juillet-2016-1.pdf).
2. Build remuneration under Regulation 146 article 17: salary, commissions, cost-of-living allowance, bonuses, profit participation, gratuities/additional months, overtime, in-kind value, holiday amounts and specified incapacity/maternity-period pay. It excludes healthcare, housing allowance/in-kind housing, legal family allowances, transport allowance, travel costs and advantages provided exclusively to facilitate duties. Do not substitute the distinct IRPP benefit rules. Article 17(2) separately defines specified assimilated-person remuneration. [Regulation 146 art.17,PDF 123](https://cnss.cd/wp-content/uploads/2024/04/Recueil-de-textes-legal-reglementaires-et-mesures-dexecution-de-la-loi-16-009-du-15-juillet-2016-1.pdf).
3. Apply the proved legal minimum and any applicable special base rules. Neither a contribution ceiling nor its absence is established by this draft. All noncash valuations and any cap must be independently supported before calculation. [16/009 arts.13–14;18/041 art.8](https://cnss.cd/wp-content/uploads/2024/04/Recueil-de-textes-legal-reglementaires-et-mesures-dexecution-de-la-loi-16-009-du-15-juillet-2016-1.pdf).
4. Apply each covered branch separately, then total employer and worker shares. The employer owes CNSS the entire contribution, including the worker share and missed deductions. It cannot subsequently recover an omitted deduction from the worker. Employer contributions remain exclusively its own charge. Each successive employer is responsible for its own remuneration-based amount. [16/009 art.19;Regulation 146 arts.19,29–30](https://cnss.cd/wp-content/uploads/2024/04/Recueil-de-textes-legal-reglementaires-et-mesures-dexecution-de-la-loi-16-009-du-15-juillet-2016-1.pdf).
5. Reconcile the contribution base, employee deduction, employer expense, total CNSS remittance and payroll journal. CNSS contributions arise for every month containing actual service, paid leave or another legally remunerated period. [Regulation 146 arts.19–20](https://cnss.cd/wp-content/uploads/2024/04/Recueil-de-textes-legal-reglementaires-et-mesures-dexecution-de-la-loi-16-009-du-15-juillet-2016-1.pdf).
### Salary withholding and expatriate-employer levy
For salary IRPP use the [individual research Guide](cd-income-tax.md) for income categories, salary immunities, supported actual contribution deductions and annual reconciliation. Law 23/053 article 119 requires monthly employer withholding on the net base under articles 70–71 by reference to article 118. This draft does not silently divide annual bands or turn annual family relief into a proved monthly schedule. Article 126 assigns withholding collection/remittance modalities to a ministerial order. Obtain the current order and operational form before issuing payslips. Domestic/microenterprise special withholding and annual finality conditions need separate treatment. [23/053 arts.68–71,118–126](https://dgi.gouv.cd/wp-content/uploads/2025/09/loi-is-et-Irpp.pdf).
For an expatriate employee, keep the employer's exceptional levy separate. Articles 145–149 charge enterprises employing expatriate personnel on gross remuneration defined by article 68, apply the salary exemptions/immunities and set the 25% rate. The charge arises on payment or availability of the income. Do not deduct it from the employee's pay or treat all employee expenses as its base. The old mining deduction and bordering-country claims remain unproved. [23/053 arts.145–149](https://dgi.gouv.cd/wp-content/uploads/2025/09/loi-is-et-Irpp.pdf).
## Deadlines and filing
| Obligation | Deadline, records and route | Official source |
|---|---|---|
| CNSS declaration | Within 15 days following the relevant calendar month; business-creator route uses the unique monthly declaration, other categories use territorial CNSS Model DC in triplicate | [Regulation 146 art.21,PDF 124](https://cnss.cd/wp-content/uploads/2024/04/Recueil-de-textes-legal-reglementaires-et-mesures-dexecution-de-la-loi-16-009-du-15-juillet-2016-1.pdf) |
| CNSS payment | Credit CNSS's account within 15 days following the relevant month; separate five-day regularisation rule does not make the original deadline the 20th | [Regulation 146 art.31,PDF 127;Regulation 138 arts.2–3,PDF 69](https://cnss.cd/wp-content/uploads/2024/04/Recueil-de-textes-legal-reglementaires-et-mesures-dexecution-de-la-loi-16-009-du-15-juillet-2016-1.pdf) |
| CNSS attachments/channel | Attach payroll sheets. More than 25 workers: electronic transmission with acknowledgement; fewer than 25: electronic or paper. Exactly 25 is not assigned a channel by this wording, so obtain the CNSS instruction | [Regulation 146 arts.23–25,PDF 125–126](https://cnss.cd/wp-content/uploads/2024/04/Recueil-de-textes-legal-reglementaires-et-mesures-dexecution-de-la-loi-16-009-du-15-juillet-2016-1.pdf) |
| No workers / centralised CNSS filing | Report no workers within 15 days; centralised returns still detail each management centre/establishment; missing required attachments counts as no declaration | [Regulation 146 arts.26–28,PDF 126](https://cnss.cd/wp-content/uploads/2024/04/Recueil-de-textes-legal-reglementaires-et-mesures-dexecution-de-la-loi-16-009-du-15-juillet-2016-1.pdf) |
| Salary withholding remittance | By 15th of month after payment/availability, with declaration to employer's managing tax service; nil declaration when salaries are not paid | [23/052 art.1 replacing Procedures Law art.18,PDF 5](https://dgi.gouv.cd/wp-content/uploads/2025/09/loi-is-et-Irpp.pdf) |
| Expatriate-employer levy | Monthly within 15 days after remuneration payment/availability, with employer-service declaration, including nil return | [23/052 art.1 replacing Procedures Law art.19,PDF 5](https://dgi.gouv.cd/wp-content/uploads/2025/09/loi-is-et-Irpp.pdf) |
| Annual salary report | By 31 March: individual sheets and province/alphabetical ordering for the specified corporate/other entities and real/small-business individuals. Separate from the individual's annual return | [25/060 art.22 replacing Procedures Law art.22 ter, PDF 18](https://www.budget.gouv.cd/wp-content/uploads/budget2026/lf_2026_recettes.pdf) |
Prepare employee IDs/registration numbers, coverage category, remuneration breakdown, days/hours, the contribution base and branches, tax withholding, employer levy, payroll sheets, provincial/centre split and bank references. Obtain the correct current form/channel for this employer. Regulation 146 article 25 specifies payroll fields; keep the submitted file and acknowledgement. Public [CNSS e-declaration](https://edeclaration.cnss.cd/) and [i-Impôts](https://i-impots.dgirdc.cd/) entry points are not evidence of authenticated acceptance. A bank debit alone does not establish a filed declaration. [Regulation 146 arts.23–28](https://cnss.cd/wp-content/uploads/2024/04/Recueil-de-textes-legal-reglementaires-et-mesures-dexecution-de-la-loi-16-009-du-15-juillet-2016-1.pdf); [CNSS declaration page](https://cnss.cd/?page_id=1698).
## Penalties and interest
For CNSS, Regulation 138 article 2 gives five days after the original payment deadline to regularise; article 3 starts the 0.5% per-day late-payment increase on the 21st day of the following month and ends it on full payment. Article 4 excludes a late bank credit where a good-faith employer proves outside circumstances. Force-majeure relief requires its own application and proof. The application does not suspend payment of principal contributions (art. 6), and is admissible only after those principal contributions have been paid in full (art. 7); it is not a self-granted waiver. Do not calculate from the 16th without reading that rule. [Regulation 138 arts.2–8,PDF 69](https://cnss.cd/wp-content/uploads/2024/04/Recueil-de-textes-legal-reglementaires-et-mesures-dexecution-de-la-loi-16-009-du-15-juillet-2016-1.pdf).
A missing declaration/required annexes produces an assessment based on the last declaration increased by 30%. If a late declaration replaces that assessment, article 10 uses a 0.5% per-day penalty on declared contributions. These are separate procedural rules; this workpaper does not stack them blindly with late-payment charges or determine a disputed late-declaration day count. A delay caused by CNSS has the specific evidence/minutes route in article 11. [Regulation 138 arts.9–12,PDF 70](https://cnss.cd/wp-content/uploads/2024/04/Recueil-de-textes-legal-reglementaires-et-mesures-dexecution-de-la-loi-16-009-du-15-juillet-2016-1.pdf); [Regulation 146 art.28](https://cnss.cd/wp-content/uploads/2024/04/Recueil-de-textes-legal-reglementaires-et-mesures-dexecution-de-la-loi-16-009-du-15-juillet-2016-1.pdf).
IRPP/expatriate-levy tax penalties follow the amended fiscal Procedures Law through article 151. Current consolidated tax penalty/interest figures and complete appeal rules are not established here; do not borrow CNSS penalties for tax. [23/053 art.151](https://dgi.gouv.cd/wp-content/uploads/2025/09/loi-is-et-Irpp.pdf).
## Cross-border points
Law 16/009 article 3 expressly includes a Congolese worker employed by a DR Congo enterprise and sent abroad for no more than six months, and a foreign worker employed by a foreign enterprise working in DR Congo for more than six months. Those conditions do not prove the negative case is exempt: review residence, employer, principal work, special schemes and any applicable coordination instrument. Nationality alone does not decide ordinary worker coverage. [16/009 art.3,PDF 6;Regulation 146 art.3,PDF 117–118](https://cnss.cd/wp-content/uploads/2024/04/Recueil-de-textes-legal-reglementaires-et-mesures-dexecution-de-la-loi-16-009-du-15-juillet-2016-1.pdf).
CNSS coverage, IRPP residence/source and the employer's expatriate levy are distinct tests. Obtain assignment dates, employer/host contracts, work location, other coverage and treaty/international-organisation facts before computing. The [individual Guide](cd-income-tax.md) owns the IRPP residence/source workpaper; the [cross-border Guide](cd-cross-border.md) does not approve an employee's complete treaty or social-security position.
## Two worked examples that recompute
Invented conditional research inputs only. Assume established ordinary full-branch coverage, supported valuations/exclusions, pay above the independently verified minimum, no ceiling/special risk adjustment, no later applicable amendment, and no separate tax/levy amount computed from this example. These schedules do not produce final net pay.
### 1. Ordinary employee, split base and branch remittance
Assume CDF 2,000,000 salary, CDF 200,000 bonus, CDF 300,000 housing allowance and CDF 100,000 transport allowance. Under the cited article 17 exclusions the CNSS base is CDF 2,200,000, rather than the CDF 2,600,000 cash total. Worker pension is CDF 110,000; employer pensionCDF 110,000,familyCDF 143,000 and ordinary occupational risksCDF 33,000,total employerCDF 286,000. The CNSS remittance is CDF 396,000. Cash after only the worker CNSS deduction is CDF 2,490,000; IRPP and any other lawful deductions still need separate work.
```oa-check
name: Ordinary CNSS remuneration exclusions and three-branch allocation
bonus: 200000
cnss_remittance: employer_total + employee_pension
cash_before_other_deductions: cash_remuneration - employee_pension
expected:
contribution_base: 2200000
employee_pension: 110000
```
### 2. Decision: pay on time or credit CNSS after penalty starts
Assume CDF 396,000 supported CNSS due for a month, a timely declaration and no outside-circumstance/force-majeure issue. If credited by the 15th of the next month, this late-payment charge is zero. If credited on the 25th, assume the competent authority confirms five chargeable days,21st through 25th inclusive: the cited daily rate produces CDF 9,900,bringing principal plus charge to CDF 405,900. The five-day count is an explicit case assumption, not a general resolution of every payment-day dispute. Compare actual bank credit date with the statutory start; proof of when money left the employer is insufficient.
```oa-check
name: CNSS timely-payment versus five chargeable days decision
inputs:
principal: 396000
confirmed_chargeable_days: 5
steps:
timely_charge: 0
daily_charge: principal * 0.005
late_charge: daily_charge * confirmed_chargeable_days
late_total: principal + late_charge
avoidable_cost: late_charge - timely_charge
expected:
daily_charge: 1980
late_charge: 9900
late_total: 405900
avoidable_cost: 9900
```
## Ask the client first
- Who employs/directs each worker, which coverage branches apply, and are there casual, domestic, apprentice, public, expatriate or seconded staff?
- What pay components, actual benefits/valuations, paid periods and legal minimum apply, with supporting contracts and payroll sheets?
- How many workers and establishments are declared, which CNSS/tax offices manage them, and what current filing instruction/form applies?
- What are payment/availability dates, actual CNSS bank-credit dates, prior declarations, missed deductions and acknowledgements?
- Which INPP/ONEM and sector/coordination instruments apply, and what facts determine the IRPP and expatriate-levy calculation?
