# Burundi: employment withholding and ordinary INSS for 2026 v1.2

## Who this applies to
Use for an employer paying taxable employment remuneration and an ordinary civilian worker within the INSS regime. Identify principal versus secondary employment, casual work and genuine qualifying termination compensation before calculating. The ordinary contribution example does not cover police, military or other difficult-work rates, voluntary insurance or public-service schemes. [IR arts. 30–34 and 112–119](https://www.obr.bi/images/LOI_N1_14_DU_24_DECEMBRE_2020_PORTANT_MODIFICATION_DE_LA_LOI_N1_02_DU_24_JANVIER_2013_RELATIVE_AUX_IMPOTS_SUR_LES_REVENUS_1.pdf); [INSS calculation guidance](https://inss.gov.bi/calcul-des-cotisations/).
The actual [Law 1/05 of 30 April 2026](https://primature.gov.bi/wp-content/uploads/2026/05/loi_modification_code_protection_sociale.pdf) amends public-sector pension benefit calculations and prior pensions, with implementing orders/decrees; it is not a basis for replacing the ordinary private-sector contribution rates displayed by INSS. Pension benefits and the public-sector implementation are outside this payroll job.
## Rates, bands and thresholds

## The base
For income withholding, total cash pay and taxable benefits, remove the art. 32 exclusions, and apply only art. 33 permitted deductions. Retained and actually paid employee pension/health contributions are deductible; a hypothetical contribution is not. Transport allowance deduction is capped at 15% of basic salary unless transport is provided in kind; rent allowance deduction is capped at 60% of basic salary. The separate qualifying complementary pension deduction has its 20% gross-employment limit. Do not apply those percentages to every item of gross pay. [IR arts. 30–34](https://www.obr.bi/images/LOI_N1_14_DU_24_DECEMBRE_2020_PORTANT_MODIFICATION_DE_LA_LOI_N1_02_DU_24_JANVIER_2013_RELATIVE_AUX_IMPOTS_SUR_LES_REVENUS_1.pdf); [Art. 147](https://www.obr.bi/images/PDF/Loi%20de%20Finances%202025-2026%20Modifi%C3%A9e.pdf); [Art. 155](https://www.obr.bi/images/LOI_DE_FINANCES_2026-2027_PROMULGUEE_compressed.pdf).
INSS uses remuneration and benefits in cash, with its own exclusions, including family allowances and reimbursement of expenses; its base is not automatically taxable pay after income-tax allowances. Compute each month’s pension and risk bases with their own caps, then the employee and employer shares separately. INSS also requires the base not to be below the applicable legal minimum salary; no current minimum-wage number is supplied here. [INSS base and worked schedule](https://inss.gov.bi/calcul-des-cotisations/).
For casual employees income law art. 119 provides a special rate and protected lower band, with practical terms delegated to an order. Do not force a casual employee through the permanent-worker example without the implementing classification. Payroll annualisation and any employee’s other income must be reconciled under the income law, not by adding arbitrary allowances.
## Deadlines and filing
1. Keep employee identity/NIF where issued, contract, principal-employer status, dates, basic salary, allowances, actual contributions and INSS affiliation number. Produce a payslip showing gross components and tax withheld. Remit and declare employment withholding to OBR within the first fifteen days of the following month. Keep an individual annual recap and submit it within thirty days after year-end, with regularisation required by art. 115. A tax-exempt employer does not necessarily exempt its employees: art. 116 requires monthly self-declaration in that situation. [IR arts. 112–116](https://www.obr.bi/images/LOI_N1_14_DU_24_DECEMBRE_2020_PORTANT_MODIFICATION_DE_LA_LOI_N1_02_DU_24_JANVIER_2013_RELATIVE_AUX_IMPOTS_SUR_LES_REVENUS_1.pdf).
2. Use [monthly joint return section III](https://www.obr.bi/images/DECLARATION_TVA-_IRE-_PF_ET_AUTRES_RETENUES_A_LA_SOURCE-2021-VF-juillet-2022-vf-1.pdf): principal permanent employees on lines 1–4, casual employees on 5–7, secondary employees line 8, early-retirement/complementary-pension rows on lines 9–11, qualifying termination compensation lines 12–15, total line 16. Lines 9–11 are the historical form’s pension block, not a political/public-office category and not independent authority for current pension treatment. Record counts, taxable bases, statutory rates and tax in the displayed columns. IR art. 117 applies the principal progressive scale to political/public-office holders and end-of-mandate compensation beneficiaries; do not route them to pension lines 9–11. Confirm the current category-specific form placement with OBR before submission. [IR art. 117, PDF p. 39](https://www.obr.bi/images/LOI_N1_14_DU_24_DECEMBRE_2020_PORTANT_MODIFICATION_DE_LA_LOI_N1_02_DU_24_JANVIER_2013_RELATIVE_AUX_IMPOTS_SUR_LES_REVENUS_1.pdf). The old printed form is a field map, not authority to override the current law.
3. Use the category-specific OBR [portal link](https://www.obr.bi/index.php/teledeclaration-telepaiement), retaining return acknowledgment and separate quittance/bank payment proof. The exact current taxpayer submission/payment-reference screens and current annual recap download have not been verified.
4. INSS is quarterly for employers: complete the Déclaration des rémunérations et cotisations, Modèle VI, from the monthly capped employee calculations and payroll detail. Declaration and contribution payment are due within the first fifteen days of the month following the calendar quarter. The INSS Q3 2026 notice asks that payment identify employer, affiliation number and quarter, with the payment reference attached to the declaration. Keep the submitted schedule and bank/payment evidence. Voluntary members have a different monthly frequency. [INSS declaration/payment instructions](https://inss.gov.bi/declaration-et-versement-des-cotisations/); [Q3 2026 employer notice](https://inss.gov.bi/declaration-et-paiement-des-cotisations-du-3eme-trimestre-2026-a-linstitut-national-de-securite-sociale/).
5. For foreign employees separately assess the budgets' annual employer charge and keep contract visa, annual gross salary and payment evidence. Do not deduct this employer charge from an employee as an INSS contribution. [Art. 103](https://www.obr.bi/images/LOI_DE_FINANCES_2026-2027_PROMULGUEE_compressed.pdf).
The budget's replacement employment definition requires notifying OBR of the absence of employment-tax payers three months before contract termination or activity cessation. Record the notice and seek OBR direction where that advance condition cannot be met; do not substitute the old post-cessation month. [Art. 147](https://www.obr.bi/images/PDF/Loi%20de%20Finances%202025-2026%20Modifi%C3%A9e.pdf); [Art. 155](https://www.obr.bi/images/LOI_DE_FINANCES_2026-2027_PROMULGUEE_compressed.pdf).
## Penalties and interest
Use [tax overview: Penalties and interest](bi-tax-overview.md#penalties-and-interest) for the general declaration, payment, withholding-default and interest rules. Identify the actual offence and taxpayer class before applying them.
INSS separately states declaration-delay additions of 1.5% for each month or part, and a further 1.5% for contribution-payment delay. These are INSS rules, not the OBR income-tax penalty. [INSS delay rules](https://inss.gov.bi/declaration-et-versement-des-cotisations/).
## Cross-border points
Nonresident employment income is not automatically subject to the passive-income withholding rate. Residence/source and treaty questions go to [cross-border tax](bi-cross-border-tax.md). Employers of foreign labor must check both the ordinary payroll obligations and the separate annual budget charge above; no treaty/social-security exemption is presumed. [IR arts. 20–21](https://www.obr.bi/images/LOI_N1_14_DU_24_DECEMBRE_2020_PORTANT_MODIFICATION_DE_LA_LOI_N1_02_DU_24_JANVIER_2013_RELATIVE_AUX_IMPOTS_SUR_LES_REVENUS_1.pdf); [Art. 103](https://www.obr.bi/images/LOI_DE_FINANCES_2026-2027_PROMULGUEE_compressed.pdf).
## Two worked examples that recompute
Assume an ordinary principal employee has BIF 500,000 cash gross pay, no allowances/exempt items and no health contribution. Pension employee BIF 18,000; employer pension BIF 27,000; employer risk BIF 2,400. With employee pension actually withheld and paid, taxable pay BIF 482,000, income tax BIF 84,600, cash net BIF 397,400 and employer cost BIF 529,400. This excludes any foreign-labor charge or unverified levy.
```oa-check
name: Ordinary monthly payroll with distinct caps
inputs:
gross: 500000
steps:
- employee_pension: min(gross,450000) * 0.04
- employer_pension: min(gross,450000) * 0.06
- risk: min(gross,80000) * 0.03
- taxable: gross - employee_pension
- income_tax: min(max(taxable-150000,0),150000)*0.20 + max(taxable-300000,0)*0.30
- net: gross-employee_pension-income_tax
- employer_cost: gross+employer_pension+risk
expected:
employee_pension: 18000
employer_pension: 27000
risk: 2400
income_tax: 84600
net: 397400
employer_cost: 529400
```
Assume BIF 200,000 monthly taxable pay after valid deductions. A principal employer computes BIF 10,000 under the bands; a secondary employer must withhold BIF 60,000. The BIF 50,000 difference is determined by the employee’s actual principal-employer status, not an option to select the lower result.
```oa-check
name: Principal versus secondary employment decision
inputs:
taxable: 200000
steps:
- principal: min(max(taxable-150000,0),150000)*0.20 + max(taxable-300000,0)*0.30
- secondary: taxable*0.30
- difference: secondary-principal
expected:
principal: 10000
secondary: 60000
difference: 50000
```
## Ask the client first
- Which employer is principal, and is the worker permanent, casual or receiving a qualifying termination payment?
- What are cash salary, basic pay, benefits, transport/housing arrangements and actual pension/health payments?
- What INSS affiliation and ordinary/difficult/public-sector classification apply?
- Is the worker foreign, and what are the contract visa date and annual gross salary?
- Which months and quarter are being reported, and what filing and payment evidence exists?
