# Burundi: individual business and rental income for 2026 v1.3
> **General reference only.** This Guide is general tax/accounting reference material for AI-assisted workflows. It has not been reviewed for any specific person's facts, documents, elections, deadlines, residency, filing status, or local procedures. Do not rely on it to file, pay, amend, or take a tax position without review by a qualified professional in Burundi.
## Who this applies to
Use for individuals under income law arts. 19–29. A Burundi resident includes worldwide income; a nonresident includes Burundi-source income. The residence tests and PE questions are in [cross-border tax](bi-cross-border-tax.md). Classify income before computing: employment and rentals use their annual scale, ordinary business uses profit/minimum rules, capital income and individual gains are a separate category. A nonresident is not automatically subject to one flat rate on every kind of income. [IR arts. 19–23](https://www.obr.bi/images/LOI_N1_14_DU_24_DECEMBRE_2020_PORTANT_MODIFICATION_DE_LA_LOI_N1_02_DU_24_JANVIER_2013_RELATIVE_AUX_IMPOTS_SUR_LES_REVENUS_1.pdf).
## Rates, bands and thresholds
| Item and conditions | Rule / amount | Period | Official source |
|---|---|---|---|
| Annual net employment and rental income, nearest BIF 1,000 | 0% first BIF 1,800,000; 20% next BIF 1,800,000; 30% excess BIF 3,600,000; art. 21 also applies this scale to nonresident employment/rental income | 2026 | [Art. 21](https://www.obr.bi/images/LOI_N1_14_DU_24_DECEMBRE_2020_PORTANT_MODIFICATION_DE_LA_LOI_N1_02_DU_24_JANVIER_2013_RELATIVE_AUX_IMPOTS_SUR_LES_REVENUS_1.pdf) |
| Ordinary individual business profit outside quarterly micro regime | 30% with minimum 1% of turnover where taxable profit < turnover / 30; check statutory free-zone exception | 2026 | [Art. 21](https://www.obr.bi/images/LOI_N1_14_DU_24_DECEMBRE_2020_PORTANT_MODIFICATION_DE_LA_LOI_N1_02_DU_24_JANVIER_2013_RELATIVE_AUX_IMPOTS_SUR_LES_REVENUS_1.pdf) |
| Individual annual business turnover <= BIF 25,000,000 | Quarterly return at 1% of quarterly turnover; above this annual threshold, annual income return and simplified/full books as appropriate | 1 January–30 June 2026 | [Art. 180](https://www.obr.bi/images/PDF/Loi%20de%20Finances%202025-2026%20Modifi%C3%A9e.pdf) |
| Same quarterly business rule continued | Annual threshold BIF 25,000,000, including equality; 1% quarterly turnover | 1 July–31 December 2026 | [Art. 190](https://www.obr.bi/images/LOI_DE_FINANCES_2026-2027_PROMULGUEE_compressed.pdf) |
| Individual capital income and individual gains category | Use [capital income and disposal gains](bi-capital-income-tax.md#rates-bands-and-thresholds) for the exact rate, base and exemptions; payer withholding stays separate | 2026 | [Arts. 23, 88–93](https://www.obr.bi/images/LOI_N1_14_DU_24_DECEMBRE_2020_PORTANT_MODIFICATION_DE_LA_LOI_N1_02_DU_24_JANVIER_2013_RELATIVE_AUX_IMPOTS_SUR_LES_REVENUS_1.pdf) |
## The base
Business income is receipts less allowable business costs and fiscal adjustments. Separately identify asset-disposal proceeds: art. 23 expressly subjects the product of art. 37(2) asset sales to the individual second-category rate; do not tax that disposal automatically as ordinary business profit or equate it to the corporate rule. The [corporate Guide](bi-corporate-income-tax.md) explains the shared expense, depreciation and loss provisions, including the additional EBMS invoice-transmission condition under modified budget art. 243 and July budget art. 268, with the individual regime switch above applied first. For the annual business method, an expense related to an invoice not sent to EBMS when issued is not deductible; the principal-law expense test alone does not establish deductibility. [Modified budget art. 243](https://www.obr.bi/images/PDF/Loi%20de%20Finances%202025-2026%20Modifi%C3%A9e.pdf); [July budget art. 268](https://www.obr.bi/images/LOI_DE_FINANCES_2026-2027_PROMULGUEE_compressed.pdf). Do not use employment bands on ordinary self-employment profit. [IR arts. 21, 37, 54–80](https://www.obr.bi/images/LOI_N1_14_DU_24_DECEMBRE_2020_PORTANT_MODIFICATION_DE_LA_LOI_N1_02_DU_24_JANVIER_2013_RELATIVE_AUX_IMPOTS_SUR_LES_REVENUS_1.pdf).
Agriculture, livestock and fish farming income is exempt under arts. 47–48. Actual fishing has its own gross-receipts limit of BIF 20,000,000 per fiscal year. The taxpayer must retain evidence. Activities that transform the product, even artisanally, fall outside this agricultural exemption; the old alleged BIF 1,800,000 agricultural ceiling is not the rule. [IR arts. 47–48](https://www.obr.bi/images/LOI_N1_14_DU_24_DECEMBRE_2020_PORTANT_MODIFICATION_DE_LA_LOI_N1_02_DU_24_JANVIER_2013_RELATIVE_AUX_IMPOTS_SUR_LES_REVENUS_1.pdf).
For ordinary building rent, start from gross receipts, deduct the statutory 40% repairs/maintenance allowance and actually paid interest on a loan financing acquisition, construction or renewal; for subletting apply the distinct art. 87(2) deduction of rent paid, rather than automatically adding the ordinary letting allowance. The BIF 4,800,000 abatement in art. 84 belongs only to the listed vulnerable persons, not every landlord. Newly constructed buildings receive a two-year first-letting exemption under the budget, excluding subletting. Obtain proof of the first letting and construction before claiming it. [IR arts. 81–87](https://www.obr.bi/images/LOI_N1_14_DU_24_DECEMBRE_2020_PORTANT_MODIFICATION_DE_LA_LOI_N1_02_DU_24_JANVIER_2013_RELATIVE_AUX_IMPOTS_SUR_LES_REVENUS_1.pdf); [Art. 208](https://www.obr.bi/images/PDF/Loi%20de%20Finances%202025-2026%20Modifi%C3%A9e.pdf); [Art. 227](https://www.obr.bi/images/LOI_DE_FINANCES_2026-2027_PROMULGUEE_compressed.pdf).
The budgets move market-operation and land-rental receipts out of business income into rental income; furnished hotels, motels, accommodation establishments and function halls stay business income. The January text expressly describes the rental building base; July art. 80 expressly adds rented land. Do not resolve a first-half land-rent base dispute by silently applying the later wording. From July keep a copy of the lease at the rented premises and use bank/electronic payment for rents in designated A/B neighborhoods. [Arts. 80–81](https://www.obr.bi/images/PDF/Loi%20de%20Finances%202025-2026%20Modifi%C3%A9e.pdf); [Arts. 79–80](https://www.obr.bi/images/LOI_DE_FINANCES_2026-2027_PROMULGUEE_compressed.pdf).
Individual disposal gains require their own asset, acquisition date, sale value, exemptions and statutory valuation under arts. 88–93. Do not apply the headline rate to gross property proceeds or treat the nonresident buyer withholding as the final gain calculation. Detailed property valuation orders and relief claims remain outside this computation.
## Deadlines and filing
1. Obtain NIF, identity, fiscal-year dates, sales/purchase books, allowable costs and withholding/payment certificates. The annual business return is due at the end of the third month following the year; employment collected entirely at source has the annual-filing exemptions in art. 25, not an unconditional exemption for every employee with other income. Rental declarations have a separate 31 March following-receipt-year deadline under both budgets. [IR arts. 24–26](https://www.obr.bi/images/LOI_N1_14_DU_24_DECEMBRE_2020_PORTANT_MODIFICATION_DE_LA_LOI_N1_02_DU_24_JANVIER_2013_RELATIVE_AUX_IMPOTS_SUR_LES_REVENUS_1.pdf); [Art. 79](https://www.obr.bi/images/PDF/Loi%20de%20Finances%202025-2026%20Modifi%C3%A9e.pdf); [Art. 78](https://www.obr.bi/images/LOI_DE_FINANCES_2026-2027_PROMULGUEE_compressed.pdf).
2. For ordinary annual business income use [Déclaration des revenus des personnes physiques](https://www.obr.bi/images/FORMULAIRE_IR_PERSONNE_PHYSIQUE_2021_VF_Corrig%C3%A9_octobre_2021.pdf): identity/period, lines 1–11 products, 12–22 expenses, 23 accounting result, 24–27 fiscal bridge, 28 minimum/29 ordinary tax, and evidenced credits at 32–36. Line 37 is the balance. Sign and attach required accounts/bridge; old printed investment concessions are not automatic entitlements. If subject to procedure art. 29, separately file the detailed and valued stock inventory within thirty days after accounting year-end, before the third-month annual-return deadline. [Procedure art. 29, PDF p. 11](https://www.obr.bi/images/LOI_RELATIVE_AUX_PROCEDURES_FISCALES_ET_NON_FISCALES_2020.pdf).
3. For the quarterly regime use [Déclaration trimestrielle](https://www.obr.bi/images/20232024_DECLARATION_TRIMESTRIELLE_IMPOT_SUR_LE_REVENU_DES_PERSONNES_PHYSIQUES_copy.pdf): enter the quarter/identity, turnover column 1, rate column 2, tax column 3, evidenced withholding credits and the balance. Income art. 24 provides quarterly frequency, but the captured clause does not state a quarterly due day. OBR’s undated FAQ lists payment dates for the first three quarters, yet contains other superseded details and no fourth-quarter date; the complete current quarterly filing/payment deadline remains unconfirmed here. If annual turnover crosses the budget threshold, switch to the annual return and required books; keep the quarterly payments for reconciliation rather than taxing the same receipts twice. [Art. 24](https://www.obr.bi/images/LOI_N1_14_DU_24_DECEMBRE_2020_PORTANT_MODIFICATION_DE_LA_LOI_N1_02_DU_24_JANVIER_2013_RELATIVE_AUX_IMPOTS_SUR_LES_REVENUS_1.pdf); [Art. 190](https://www.obr.bi/images/LOI_DE_FINANCES_2026-2027_PROMULGUEE_compressed.pdf).
4. A rental advance is due by 30 September and must equal at least a quarter of the prior assessed rental tax. The source does not provide a four-date rental advance calendar; do not invent one. [Art. 82](https://www.obr.bi/images/PDF/Loi%20de%20Finances%202025-2026%20Modifi%C3%A9e.pdf); [Art. 81](https://www.obr.bi/images/LOI_DE_FINANCES_2026-2027_PROMULGUEE_compressed.pdf).
5. Follow the category-specific links on OBR's [portal page](https://www.obr.bi/index.php/teledeclaration-telepaiement). Keep the signed return, submission acknowledgment and quittance/bank payment proof, matching NIF, period and tax. Published business forms include receipt fields; current rental-form boxes and authenticated submission screens are unresolved.
## Penalties and interest
Use [tax overview: Penalties and interest](bi-tax-overview.md#penalties-and-interest) for the general declaration, payment, withholding-default and interest rules. Identify the actual offence and taxpayer class before applying them.
## Cross-border points
Use [cross-border tax](bi-cross-border-tax.md) for residence, foreign-source business, PE, foreign-tax-credit evidence and source withholding. Monthly employee calculations and salary remittance belong to [payroll](bi-payroll-social.md). Art. 20 does not convert every nonresident income category to the passive-income rate. [IR arts. 20–23](https://www.obr.bi/images/LOI_N1_14_DU_24_DECEMBRE_2020_PORTANT_MODIFICATION_DE_LA_LOI_N1_02_DU_24_JANVIER_2013_RELATIVE_AUX_IMPOTS_SUR_LES_REVENUS_1.pdf).
## Two worked examples that recompute
Assume a natural-person trader with annual turnover expected to remain BIF 20,000,000, quarterly turnover BIF 5,000,000, no special final levy and no withholding credit. The quarterly turnover tax is BIF 50,000; expenses do not reduce that turnover base.
```oa-check
name: Quarterly micro-business income
inputs:
quarter_turnover: 5000000
steps:
- tax: quarter_turnover * 0.01
expected:
tax: 50000
```
Compare annual turnover of exactly BIF 25,000,000 with BIF 26,000,000 for an ordinary individual business, assuming a 10% taxable margin and no credits/special levy. The first falls within quarterly 1% turnover taxation, total BIF 250,000. The second requires annual filing: BIF 780,000 ordinary tax exceeds BIF 260,000 minimum. Classification changes the computation; do not elect the cheaper regime after crossing the limit.
```oa-check
name: Annual regime decision at the threshold
inputs:
at_limit: 25000000
over_limit: 26000000
margin: 0.1
steps:
- quarterly_regime_year_tax: at_limit * 0.01
- annual_profit: over_limit * margin
- annual_ordinary: annual_profit * 0.30
- annual_minimum: over_limit * 0.01
- annual_tax: max(annual_ordinary,annual_minimum)
- difference: annual_tax - quarterly_regime_year_tax
expected:
quarterly_regime_year_tax: 250000
annual_tax: 780000
difference: 530000
```
## Ask the client first
- What are residence facts, income sources and any foreign PE?
- Is the income employment, business, ordinary rent, farming/fishing or a disposal gain?
- What are actual year-to-date turnover and expected annual turnover, including special final-levy products?
- What costs, losses, ownership facts and withholding/payment proof exist?
- For rent, what were construction and first-letting dates, receipts, financing interest and vulnerable-person status?
