- Identify the data categories that the statute treats as sensitive, including biometric data, precise geolocation, health data, data about known children, and other specially protected categories commonly listed in comprehensive privacy laws
- Where a biometric-specific statute exists alongside the comprehensive privacy law, analyze both regimes independently; the biometric law may impose separate written consent, retention, and destruction requirements, and may carry a private right of action
- Universal opt-out duties require both policy and technical implementation: state privacy laws that recognize browser- or device-based signals require the business to process those signals as actual opt-outs from sale or targeted advertising, not merely log them
- Children’s data analysis should account for constructive knowledge or equivalent notice standards where the product’s design, audience, or surrounding facts would make child use reasonably apparent
- Processor agreements should be checked against the statute’s required data-processing terms, including subject matter and duration, nature and purpose, data types and consumer categories, audit rights beyond desk review, subprocessor controls, and deletion/return obligations

- For children’s data, assess whether product design, marketing, or audience context creates constructive knowledge; if so, recommend age-gating, categorical exclusion, or other data-flow restrictions instead of relying on claimed lack of actual knowledge
- For vendor agreements, review each processor arrangement against the statutory checklist of required terms and note missing terms by gap type, not just by contract quality overall
- For data broker registration, compare the company’s monetization, resale, and disclosure practices to the statutory definition and confirm whether registration has been completed if the definition is met
- For de-identification, compare the company’s methodology to the state law standard and identify any residual reidentification risk, governance gap, or mismatch with internal labeling
- For inferred sensitive data, examine whether analytics outputs, audience segments, or model features convert ordinary data into regulated sensitive data
- For consent records, separate the retention basis for proof-of-consent files from the deletion obligation for the underlying personal data, and identify whether the current program distinguishes those records cleanly
## 5. Vertical / structural / temporal relationships
- The comprehensive privacy law and any biometric-specific law may apply simultaneously; where they overlap, the more restrictive obligation controls as a practical compliance floor
- Technical and legal remediation should be sequenced together: policy updates, contract amendments, system changes, and retention controls are interdependent and should be mapped in the memo as parallel workstreams
- Processor agreement remediation should prioritize the processors most likely to receive sensitive, biometric, or model-training data, then cascade the revised terms through the remaining vendor population
- If the company uses a staged rollout of opt-out processing or consent management, note the gap between current-state logging and future-state compliance as a temporal risk, not a static yes/no defect
- When multiple jurisdictions are in scope, separate the state-specific obligation from enterprise-wide controls so the memo does not overstate one jurisdiction’s rule as universally applicable
## 6. Output structure conventions
- Write the memo as an advisory regulatory impact analysis, not as a checklist
- Organize issues by compliance gap category, with a uniform ordinal severity label defined once at the outset
- For each issue, state the controlling authority by name and section, the affected program or document layer, and the operational or regulatory consequence
- Include a vendor-analysis subsection that groups processor agreement defects by missing statutory term or flow-down issue
- Include a biometric-data subsection that addresses the comprehensive privacy law and any biometric-specific law in parallel
- Include a data-architecture subsection that traces how signals, consent, de-identification, and model outputs move through the system
- Include an enforcement-risk subsection that calls out private-right-of-action exposure, willfulness concerns around opt-out handling, and any separate registration obligation
- End with a Recommended Actions block that uses imperative verbs, assigns the responsible role, and ties each recommendation to a milestone or urgency level
